PROGRAM SCOPE OF WORK Circuit Rider Program ** TWO OPTIONS YEARS AVAILABLE The Circuit Rider Program is designed to assess and then motivate Nevada tribal communities to address issues related to underground injection control (domestic and industrial on-site waste disposal) wells and underground storage tanks. South Fork Band PART I Phase I- Assessment of The Universe of Facilities with UIC wells or USTs EPA R9 maintains a database of all known UIC wells and USTs on tribal lands. However, this database is not comprehensive and needs to be updated. The circuit rider must conduct a search to identify all facilities located on tribal lands, including leased land which could maintain injection wells and/or USTs; this list will be used by the circuit rider to confirm presence or absence of injection well(s) and USTs. At a minimum the following sources should be consulted: phone books, local Indian Health Service branches, Bureau of Indian Affairs records, EPA Indian Programs Environmental Assessments, and other EPA databases, etc. The circuit rider must maintain a Excel 97or Lotus 1-2-3 97 list of all information resources which were utilized to develop the inspection list. Circuit rider must document where the information was obtained and the final fact sheet must be sent to EPA for approval before used. EPA will be sent a hard copy and an electronic copy. Each facility listing must have the following information: Name of the Tribe Name of facility Address Phone number The contractor must also identify all waste haulers, recycling facilities, waste disposal facilities and waste pumpers in the state of Nevada and 100 miles outside the state boundaries in the states of Idaho, California, Arizona, and Utah. This list must be in the form of a fact sheet in Excel 97or Lotus 1-2-3 97 format and have the following information: Name of company Address (Street, City, State) Phone Number (include area code) Cost per unit for removal of hydrocarbon, solvent, and pesticide waste streams Distance in miles from nearest large city Circuit rider must document where the information was obtained and the final fact sheet must be sent to EPA for approval before any distribution to the tribes occur. EPA will be sent a hard copy and an electronic copy. Phase II -- Inspections and Closure Oversight From the information compiled in the Phase I list and information in EPA's databases, all the facilities identified in at least 16 of the tribes listed above must be inspected for UIC wells and USTs. The list of tribes must be submitted to EPA for approval prior to inspections. During this inspection, it is expected that the inspector will identify all UIC wells, abandoned wells, and USTs on the facility. The circuit rider must notify the facility at least two days prior to the inspection date and send a letter to the tribal chairman and environmental coordinator prior to inspection date. The circuit rider must then contact environmental coordinator to coordinate joint inspections if desired by the tribe. Underground Injection Control (UIC) UIC wells can encompass industrial and domestic on-site waste disposal devices. If a UIC well is found, the inspector must collect UIC inventory information and an inspection report. The UIC inventory information will be submitted to the region on a semi-annual basis. Circuit rider must ensure that they collect all required information which is listed in Attachment 1. If no UIC well(s) exists, only an inspection report needs to be completed. If no UIC wells are found, the circuit rider must still note any other threats to ground water, such as surface spills or signs of past soil contamination. If no UIC well exists, the circuit rider is to maintain a separate list which details: Name of Tribe Name of facility Address (physical and mailing) City, State, Zipcode Facility manager/operator Contact phone number Fax number GPS reading If closure of a UIC well is required at a facility, the circuit rider will be required to oversee the closure activities to ensure that closure done according to EPA, Region 9 guidance. Underground Storage Tanks (UST) If a UST exists, the inspector must complete a UST form 7530-1 or update the existing form for each individual UST at the facility. The UST form is Attachment 2. If no UST exists, the circuit rider is to maintain a separate list which details: Name of Tribe Name of facility Address (physical and mailing) City, State, Zipcode Facility manager/operator Contact phone number Fax number GPS Reading If a UST was previously used by the facility and is currently closed, the circuit rider is to maintain a separate list which details: Name of Tribe Name of facility Address (physical and mailing) City, State, Zipcode Facility manager/operator Contact phone number Fax number The circuit rider must also photocopy for EPA records, any documentation related to the purpose of the closure, the date of closure, location of tank, data of tank removal, and the alternative storage mechanism used. There are five principal goals for all Phase II inspections, each of these goals must be handled through discussions and/or written inspection reports, and are as follows: 1. Proper maintenance tasks and procedures will be reviewed with the operator and staff. Recommendations will be made on possible improvements in preventive maintenance performance. Well and/or UST condition will be reviewed with staff. The facilities will be toured and any system deficiencies or specific training requirements will be noted in the Observations and Recommendations section of the Phase I report. Proper record keeping and log sheets will be reviewed and noted (copies attached to inspection form is possible). 2. The presence of a public or private drinking water well within a mile radius of the facility or other potential sources of drinking water will be identified and the use discussed. The location of all public and private drinking water wells must be GPSed. If the Tribe has a Wellhead Protection Program (WHPP), the circuit rider will discuss the WHPP and provide contact information. 3. Needed improvements and alternative options will be addressed in the Observations and Recommendations. Photos will be included as necessary. 4. The facility will be inspected for overall condition and improvements. A sketch of the facility and surrounding areas and building will be included. The map/sketch should identify clearly the facility, the buildings surround the facility (including roads and streets), the UIC well(s), UST(s), abandoned wells, and drinking water wells identified during the inspection. The map must include other significant contaminants discovered during the inspection 5. Septage and waste disposal storage, handling, and disposal practices will be reviewed with the operations staff. 6. The location of all UIC wells, UST, abandoned wells, and drinking water wells identified in the inspections will be GPSed by the circuit rider. The contractor must work with appropriate EPA personnel before any GPS measurements are taken. EPA will provide authorization after an appropriate level of training is given to the contractor. See Attachment 3 for detailed information on GPS procedures. Reporting The circuit rider must submit a list of all facilities that will be inspected that month at the beginning of each month. All inventory forms and inspection reports should be submitted to EPA no later than 45 days after the inspection. The circuit rider is further required to submit two comprehensive reports each year. One report will be due October 31 for the period April 1-September 30 and the second report will be due April 30 for the period October 1-March 30. Format is attached. Inspection Report Format (one report per facility) 1. A -- Presence of Well USTs B -- Facility condition, included BMPs C -- Purpose of Well and/or USTs D -- Waste Streams entering Well and /or USTs E -- Record Keeping F- Abandoned Wells G- GPS Location of USTs, UIC, Drinking Water Wells, and Abandon Wells 2. A -- Site Investigation and Needed Improvements 3. A -- Observations and Recommendations The inspection report must summarize all the information that was collected and present concrete solutions to the problems identified. At the end of the inspection, the inspector will discuss the findings with the facility manager and or operator. Outreach materials will be given to the manager operator describing why ground water resources need to be protected and a list of where all local waste haulers and pumpers are located. Note all best management practices to prevent ground water contamination and obtain copies of waste removal receipts. If this is not possible, the inspector should note the date, the type of waste, and the quantity of waste removed. PART II -Integration of Federal Tribal Program and State UIC Program The Circuit Rider will provide assistance to the state UIC program by conducting inspections within and near the tribal reservations. The appointed circuit rider will coordinate field investigation activities with the Nevada UIC staff. Inspections will be conducted to achieve compliance with existing state UIC permit(s), to investigate complaints, and/or to identify unpermitted injection wells. A standardized inspection report will be completed which addresses the following information: 1. Site Address 2. GPS location of each well 3. Presence and number of injection well(s) 4. Facility condition, including BMPs 5. Purpose of well 6. Waste Streams entering well 7. Record keeping 8. Presence of public or private drinking water wells within 1 mile of the facility 9. Observations and Recommendations The circuit rider is responsible for alerting DEP staff to an any non-compliance with state law within 10 working days. The circuit rider will be responsible for entering ground water data in the state database and filing the compiled data at the state office located in Carson City. The circuit rider is also responsible for distributing literature associated with underground injection wells and their potential role in ground water contamination. A final inspection report will be due no more than 45 days after the inspection has been completed. Activities performed for the state UIC program should be included in the Nevada State progress report due every 6 months to EPA. Posted 09/03/98 (W-SN245922). (0246)
