65 -- MEDLITE IV Q-SWITCHED FREQUENCY DOUBLED ND:YAG LASER SYSTEM SOL DADA09-98-Q-0695 DUE 091898 POC Contracting Specialist, MAXINE COBURN, (210) 916-2578, Contracting Officer, Bruce Strauch, (210) 916-3142 (Site Code DADA09) This is a combined synopsis/solicitation for commercial items prepared in accordance with the information in FAR Subpart 12.6 as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation. Quotes are being requested and a written solicitation will not be issued. Solicitation number is DADA09-98-Q-0695 and is issued as a Request for Quotes (RFQ). The RFQ incorporates provisions and clauses in effect through Federal Acquisition Circular 97-05. This requirement is restricted 100% to small business. The Standard Industrial Code (SIC) is 3841 and the small business size standard is 500 employees. The government intends to award a contract for the following name brand MEDLITE IV Q-Switched, Frequency Doubled ND:YAG Laser System manufactured by Continuum Biomedical, 6533 Sierra Lane, Dublin, CA 94568, or EQUAL. (1) MEDLITE IV Q-Switched, Frequency Doubled ND:YAG Laser System to include: 4 PR Laser Safety Eyewear; 1 LOT Handpieces for 1064 nm: 3,4,6,& 8mm and 532 nm: 2,3,4, & 6mm; 100 EA Patient Pamphlets-Pigmented Lesion Pamphlets; 100 EA Patient Pamphlets-Tattoo Removal; 1 EA Patient Education Video; On-Site Installation; On-Site In- Service Training for 40 personnel; (2) 1 EA Replacement Polymer Dye Barrel for 585nm; and (3) 1 EA Replacement Polymer Dye Barrel for 650nm. All products offered other than that specifically referenced by brand name will be required to meet the needs of the Government in essentially the same manner as the brand name product. Funds are not currently available for this requirement, however, it is anticipated year-end funds may become available. The commercial item FAR clauses and provisions applicable to this requirement are 52.212-1, 52.212-2, 52.212-3, 52.212-4, 52.212-5 and are available in full text on the World Wide Web at: http://www.medcom.amedd.army.mil/medcom/mcaa. FAR Provision 52.212-1, Instructions to Offeror-Commercial Items (For this solicitation offerors shall submit quotes on letterhead stationery to include all information required by this provision as well as name of manufacturer if other than brand name, model number, warranty information, delivery time after receipt of award, and extended price). FAR provision 52.212-2, Evaluation-Commercial Items (For this solicitation, the Government will award a contract from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Past performance of contractors may be taken into consideration for evaluation). DFARS 252.211-7003, Brand Name or Equal is incorporated by referenced. FAR 39.106 and Year 2000 Compliant- Commercial Supply Items applies: "The contractor warrants that each hardware, software, and firmware product delivered under this contract and listed below shall be able to accurately process date/time data (including, but not limited to, calculating, comparing, and sequencing) from, into, and between the twentieth and twenty-first centuries, and the years 1999 and 2000 and leap year calculations to the extent that other information technology, used in combination with the information technology being acquired, properly exchanges date/time data with it. If the contract requires that specific listed products must perform as a system in accordance with the foregoing warranty, then that warranty shall apply to those listed products as a system. The duration of this warranty and the remedies available to the Government for breach of this warranty shall be as defined in, and subject to, the terms and limitations of the contractor's standard commercial warranty or warranties contained in this contract, provided that notwithstanding any provision to the contrary in such commercial warranty or warranties, the remedies available to the Government under this warranty shall include repair or replacement of any listed product whose non-compliance is discovered and made known to the contractor in writing within ninety (90) days after acceptance. Nothing in this warranty shall be construed to limit any rights or remedies the Government may otherwise have under this contract with respect to defects other than Year 2000 performance".
