This announcement constitutes the only solicitation. Quotes are being requested and a written solicitation will not be issued. Solicitation number is DADA09-98-Q-0778 and is issued as a Request for Quotes (RFQ). The RFQ incorporates provisions and clauses in effect through Federal Acquisition Circular 97-05. This requirement is restricted 100% to small business. The Standard Industrial Code (SIC) is 3841 and the small business size standard is 500 employees. The government intends to award a contract for the following name brand: touchSCAN-SR Microbiology System manufactured by Dade MicroScan Inc., 1584 Enterprise Boulevard, West Sacramento, CA 95691 OR EQUAL. CLIN 0001 2 ea TouchSCAN SR System, to include the Sonic Reader, IBM 586 Computer with the DMS Software, and a DMS Reports Printer; CLIN 0002 7 ea Data Management Systems. All products offered other than that specifically referenced by brand name will be required to meet the needs of the Government in essentially the same manner as the brand name product. Funds are not currently available for this requirement, however, it is anticipated year-end funds may become available. FAR 39.106 and Year 2000 Compliant-Commercial Supply Items applies: "The contractor warrants that each hardware, software, and firmware product delivered under this contract and listed below shall be able to accurately process date/time data (including, but not limited to, calculating, comparing, and sequencing) from, into, and between the twentieth and twenty-first centuries, and the years 1999 and 2000 and leap year calculations to the extent that other information technology, used in combination with the information technology being acquired, properly exchanges date/time data with it. If the contract requires that specific listed products must perform as a system in accordance with the foregoing warranty, then that warranty shall be as defined in, and subject to, the terms and limitations of the contractor's standard commercial warranty or warranties contained in this contract, provided that notwithstanding any provision to the contrary in such commercial warranty or warranties, the remedies available to the Government under this warranty shall include repair or replacement of any listed product whose non-compliance is discovered and made known to the contractor in writing within ninety (90) days after acceptance. Nothing in this warranty shall be construed to limit any rights or remedies the Government may otherwise have under this contract with respect to defects other than Year 2000 performance."
