commercial items prepared in accordance with the format in FAR Subpart
12.6, as supplemented with additional information included in this
notice. This announcement constitutes the only solicitation. Proposals
are being requested and a written solicitation will not be issued.
Solicitation Number N00164-98-R-0136 is issued as a Request for
Proposal. Solicitation documents and incorporated provisions and
clauses are those in effect through Federal Acquisition Circular 97-05
and Defense Acquisition Circular 91-13. The Standard Industrial Code
is 3484. The Small Business size standard is 1000 employees. The
government is requesting offers for the minimum contract quantity
listed under CLIN 0001 and the maximum quantity listed under CLIN 0002.
This is a Brand Name or Equal requirement and is shown as follows: CLIN
0001 281 each Leupold Mark 4 M3- 10x40mm Tactical RifleScopes (or
Equal) in accordance with the Brand Name or Equal Clause. CLIN 0002 274
each, Leupold Mark 4 M3- 10x40mm Tactical RifleScopes (or Equal) in
accordance with the Brand Name or Equal Clause. This is an
indefinite-delivery, indefinite quantity requirement. The maximum
quantity then for this contract is 555 (CLIN 0001 combined with CLIN
0002). The contract minimum quantity listed as CLIN 0001 shall be
purchased at time of contract award. The estimated quantity for the
three out years (CLIN 0002) of 274 may/may not be ordered in the three
year period following award. NOTE: If providing other than the Brand
Name items the offeror must provide the Manufacture's name, Brand, and
Model or Part Number along with a technical description of the items
being offered in sufficient detail to evaluate compliance with the
requirements of this announcement. This may include product literature
or other documents as necessary. Salient Characteristics : Scope: Mark
4 M3 10x40mm, Actual Magnification: 9.90 to 10.00, Optimum Eye Relief:
3.0 to 3.5 inches, Unrestricted Objective Lens Diameter: 40.0 mm
(1.574 inches +/- 0.001 in), Maximum Weight: 1.35 pounds, Minimum
Elevation Adjustment: 75 minutes of angle, Minimum Windage Adjustment:
70 minutes of angle, Minimum field of view @ 100y: 2.0 degrees,
Maximum Overall Length: 14.0in, Minimum Front Ring Space: 2.00in,
Minimum Rear Ring Space: 2.00in, Minimum Eyepiece Diameter: 1.675in,
Tube Diameter: 30mm (1.180 1.185in), Focus Range: +0.5 to 3.5 Diopters,
Minimum Light Transmission: 90%, Maximum Weapon Impulse: 13.5
pound-seconds, Maximum Weapon Recoil Energy: 120 foot-pounds, Maximum
Submersion: 3 atmospheres for 120 minutes in 70 water, Temperature
Extremes: 140 F(60 C) to 40 F(-40 C). Elevation Adjustment: Adjustment
knob must be located on top of the center of the scope. Clockwise
rotation lowering bullet impact and counterclockwise rotation raising
bullet impact. Elevation adjustment must double as a bullet drop
compensator for the M118 -7.62X51mm rifle cartridge. The dial must be
calibrated for bullet drop increments from 100 meters to 1,000 meters
all adjustments must be made in less than a full revolution. Knob must
be capable of being reset once the scope is sighted in. Adjustment
knob must be protected by a threaded cap and must not extend 0.750"
above the bottom of the knob. The protective cap must prevent the
unintentional adjustment of the elevation setting. Windage Adjustment:
Adjustment knob must be located on the right side of the scope as
mounted on the rifle. Clockwise rotation shifting the bullet impact to
the right and counterclockwise rotation shifting bullet impact to the
left. Adjustments must have -minute clicks. Knob must be capable of
being reset to zero once the scope is sighted in. Focus: Adjustment
knob must be located on the left side of the turret as mounted on the
rifle. Clockwise rotation shifting the focus from infinity to close
range and counterclockwise rotation shifting focus from close range to
infinity. The eyepiece must be capable of diopter adjustment to enable
the shooter to focus on the reticle (adjustments to range from at least
+0.5 to 3.5 diopters). Mil Dot Reticle: Reticle must conform to the
standard USMC mil dot reticle. Both sides of the horizontal and
vertical duplex crosshair contain four dots. The space between dot
centers subtends one milliradian(mil). One mil. Subtends 3.6 inches at
100 yards or 36 inches at 1,000 yards. Each dot is minutes in
diameter. (A detailed drawing of the reticle dimensions to be provided
upon request) Shock: The scope shall be capable of withstanding the
recoil of a 50 caliber Browning Machine Gun(BMG) Sniper Rifle weighing
no less than 22 pounds. Maximum Impulse of 13.5 pound-seconds, Maximum
Recoil Energy of 120 foot-pounds. Serial Number: Serial number shall
not exceed ten characters and must be unique to each item. Color: Color
of the scope must be black matte, non-reflective finish. SPECIAL NOTICE
The Director, Defense Procurement has revised DFARS to require
contractors to be registered in the Central Contractor Registration
(CCR) as a condition for receipt of contract award effective 1 June
1998. Offerors may obtain information on registration and annual
confirmation requirements by calling 1-888-227-2423, or via the
Internet at http://ccr.edi.disa.mil. For further details regarding the
requirements of CCR, offerors are advised to review the requirements
of DFAR 252.204-7004 contained herein. EXPEDITING CONTRACT CLOSEOUT
(NAVSEA)(DEC 1995)(a) As part of the negotiated fixed price or total
estimated amount of this contract, both the Government and the
Contractor have agreed to waive any entitlement that otherwise might
accrue to either party in any residual dollar amount of $500 or less at
the time of final contract closeout. The term "residual dollar amount"
shall include all money that would otherwise be owed to either part at
the end of the contract except that, amounts connected in any way with
taxation, allegations of fraud and/or antitrust violations shall be
excluded. For purposes of determining residual dollar amounts, offsets
of money owed by one party against money that would otherwise be paid
by that party might be considered to the extent permitted by law. (b)
This agreement to waive entitlement to residual dollar amounts has
been considered by both parties. It is agreed that the administrative
costs for either part associated with collected such small dollar
amounts could exceed the amount to be recovered. This is anticipated to
be an indefinite -delivery, indefinite-quantity Firm-Fixed Price
contract. The shipping terms will be F.O.B. Destination, Naval Surface
Warfare Center, 300 Highway 361, Crane IN 47522-5001 with
inspection/acceptance at Destination. Delivery for orders placed under
this contract will be 90 days from the effective date of the order.
Delivery orders shall be placed utilizing an 1155 format from the date
of the award of the basic contract for a period of 36 months.
NAVSURWARCENDIV Crane is the only agency authorized to place orders

Priority and allocation Requirements. STANDARD COMMERCIAL WARRANTY
(NAVSURFWARCENDIV) The contractor shall extend to the Government the
full coverage of any standard commercial warranty normally offered in
a similar commercial sale, provided such warranty is available at no
additional cost to the Government. Acceptance of the standard
commercial warranty does not waive the Government's rights under the
"Inspection" clause nor does it limit the Government's rights with
regard to the other terms and conditions of this contract. In the event
of a conflict, the terms and conditions of the contract shall take
precedence over the standard commercial warranty. The standard
commercial warranty period shall begin upon final acceptance of the
applicable material and/or services listed in the Schedule. The
contractor shall provide a copy of its standard commercial warranty (if
applicable) with its offer. The warranty covers a period of months.
(Offeror is to insert number.) (t) PAST PERFORMANCE During the source
selection process, the Government will assess the offeror's past
performance in the evaluation for contract award. Accordingly, each
offeror is required to submit a list of its five most recent contracts
for the same or similar items. It is preferred that these contracts be
with U.S. government customers, but contracts with other commercial
concerns are also acceptable. Offerors are authorized to provide
information relative to any problems encountered on the identified
contracts and any corrective actions taken by the offeror. The Source
Selection Authority (SSA)/Contracting Officer will evaluate the
offeror's past performance; based upon the information furnished by the
offeror, or other information obtained by the Contracting Officer. The
Contracting Officer is not responsible for locating or securing any
information not identified in the offer. The SSA/Contracting Officer
may, however, utilize all available information, including information
not provided by the offeror, in the past performance evaluation. Past
performance is assessed by the SSA/Contracting Officer and is assigned
a narrative rating in the evaluation. Each offeror will be given an
adjectival rating on past performance: highly favorable, favorable,
unfavorable, or highly unfavorable. Offerors who do not have same or
similar past performance information reasonably available to the
Contracting Officer will be rated neither favorably nor unfavorably.
Offerors without corporate past performance history are encouraged to
submit past performance information, or key personnel data, previous
subcontracting experience, etc. for the Government to evaluate. In the
event there are substantial differences among the offerors in terms of
past performance, the Government reserves the right to award to other
than the lowest priced offer in favor of an offeror with substantially
better performance history. In addition, the Government may accept
other than the lowest priced offer if doing so would result in greater
value to the Government in terms of technical performance, quality,
reliability, life cycle cost, or lower overall program risk. As a part
of the past performance evaluation, the Government will assess the
offeror's previous compliance with the requirements of FAR 52.219-8 and
52.219-9 as applicable. Small disadvantaged business concerns may
receive evaluation preference as provided elsewhere in this
solicitation. (End of provision) Offerors responding to this
announcement must provide the information contained in 52.212-1,
Instructions to Offerors-Commercial Items with the deletion of the
following this clause is tailored: (h) (d) (e) (b)(5). Must include a
completed copy of provision FAR 52.212-3, Offeror Representations and
Certifications-Commercial Items deleting (f)and (g) as not applicable
DEVIATION and provision DFAR 252.212-7000 Offeror Representations and
Certifications -- Commercial Items. The offeror should also provide its
Commercial and Government Entity (CAGE) code, Contractor Establishment
code (DUNS Number) and Tax Identification Number. Past performance
information required is found in FAR 52.212-1(10). If a change occurs
in this requirement, only those offerors that respond to this
announcement within the required time frame will be provided any
changes/amendments and considered for future discussions and/or award.
All responsible sources may submit a proposal that shall be considered
