This is a combined synopsis/solicitation for commercial items prepa= red in = accordance with the format in Subpart 12.6, as supplemented with addition= al = information contained in this notice. This announcement constitutes the = only = solicitation; proposals are being requested and a written solicitation wi= ll not = be issued. Solicitation N00140-99-R-0099 is issued as a Request for Prop= osal. = This acquisition is restricted to the software publishers or distributors= for = electronic distribution of the Raxco Software, Inc.=92s InstaNT since the= y are = the only sources able to provide the required licenses, software upgrade = licenses, and maintenance. Software licenses, maintenance and services a= re = required for forty-eight (48) months. All software licenses, upgrades, a= nd new = versions must be provided via electronic distribution technology (EDT) = downloading from the Internet. EDT encrypts the software and creates an = electronic container for transmission over the Internet. A password is t= hen = Emailed to the customer to unlock the encrypted container. EDT security = features must include verification of authorized Internet domain, three l= evels = of encrypted password verification, unlinked secure URL location, previou= sly = approved Email address for software unlock key, and self-checking contain= ers to = ensure product has not been infected with a virus or otherwise corrupted = during = shipment. All software updates, upgrades and new versions shall be avail= able = via Internet same day received from the publisher; notice of availability= shall = be sent to the end-user. Twenty-five hard copies of media and documentat= ion = shall be required for each software product initially and as products are= = revised or updated. Award will result in a firm fixed price IDIQ contrac= t. The = contract minimum will be 10% of the value of the basic contract and the = contract maximum will be the total value of the total quantities. Raxco = Software, Inc.'s InstaNT will be required on an enterprise purchase, annu= al = basis only for approximately 45,000 PCs over the four year period. The following FAR provisions apply to = this = solicitation and are incorporated by reference. FAR 52.212-1, Instructio= ns to = Offerors -- Commercial Items, 52.212-2 Evaluation -- Commercial Items. The= = Government will award a contract resulting from this solicitation to the = responsible offeror whose offer conforms to the solicitation, is determin= ed = most advantageous to the Government price and technical factors considere= d. = The evaluation will consider technical of equal importance to price. The= = following factors will be used to evaluate offers: price and technical, t= he = technical evaluation factors of delivery mechanisms and past performance = are of = equal importance. Offerors shall demonstrate in sufficient detail a deli= very = mechanism that will successfullyaccomplish the SOW. Offerors should des= cribe = the risks associated with the SOW and any risks associated with the offer= or=3Ds = proposed delivery mechanism; describe any techniques, methods, and action= s that = will be used by the offeror to mitigate the risk(s) identified in the SOW= and = in the offeror=3Ds proposed delivery mechanism and provide an explanation= of = whether the techniques and methods identified for risk mitigation have be= en = successfully used by the offeror. The Government=3Ds evaluation of the q= uality = of past performance is distinct and separate from the Contacting Officer=3D= s = responsibility determination. The assessment of the offeror=3Ds past per= formance = will be used as a means of evaluating the relative capability of the offe= ror = and other competitors to successfully meet the requirements of the = solicitation. The offeror shall describe its past performance on directl= y = related or similar contracts held within the last five years which are of= = similar scope, magnitude and complexity to that which is detailed in the = solicitation. Offerors which describe similar contracts shall provide a = detailed explanation demonstrating the similarity of the contracts to the= requir ements of the solicitation. The Government will consider termination for= = default, delinquencies, failure to comply with specifications and/or SOW = requirements, cost overruns, amount of rework and any other information w= hich = reflects the overall quality of the offeror=3Ds past performance. The of= feror = shall provide the following information regarding past performance -- cont= ract = number(s), name and reference POC at the federal, state or local governme= nt or = commercial entity for which the contract was performed, dollar value of t= he = contract, detailed description of the work performed, names of subcontrac= tor(s) = and number and severity of any quality, delivery or cost problems in perf= orming = the contact, the corrective action taken and the effectiveness of the cor= rective action. The Government reserves the right to obtain information = for = use in the evaluation of past performance from any and all sources includ= ing = sources outside the Government. Offerors lacking relevant past performan= ce = history will receive a neutral rating for past performance. However, the= = proposal of an offeror with no relevant past performance history, while r= ated = neutral for past performance, may not represent the most advantageous pro= posal = to the Government and thus may be an unsuccessful proposal when compared = to the = proposal of other offerors. An offeror failing to provide the past perfo= rmance = or to assert that it has no relevant directly related or similar past = performance will be considered ineligible for award.
