combined synopsis/solicitation for non-personnel construction
inspection, advisory, and administrative services prepared IAW FAR
Subpart 12.6, as supplemented with additional information included in
this notice. This announcement constitutes the only solicitation;
proposals are being requested and a written solicitation will not be
issued. This solicitation DAHA14 99 R 4001 is issued as an RFP. This is
a solicitation document and incorporates provisions are those in effect
through Federal Acquisition Circular 97-10. SIC code is 8742. This
requirement is for the Kansas Air National Guard, Forbes Field, Topeka,
Kansas. The contractor shall provide written and verbal inspection
reports, advice and advisory opinions, and limited administrative
services to the Contracting Officers Technical Representative (COTR) on
matters relating to current and future construction projects performed
at Forbes Field, Topeka, Kansas. At no time during the performance of
this contract shall the contractor change/substitute or subcontract
out the individual inspector assigned to this contract without prior
written approval of the contracting officer. Inspection
Responsibilities -- The contractor shall on a daily basis, or as
required by the COTR, inspect the work by comparing the work
requirements of the drawings and specification with the work performed
by the construction contractor(s) and his subcontractor(s), and shall
make written reports when work, in the inspectors opinion, is not
being performed as required by the contract documents. (Drawings and
specifications) In no instance, shall the contractor provide
instructions, render opinions or in anyway direct the activities of a
construction contractor. Providing instructions, rendering opinions, or
directing construction contractors/subcontractors may result in the
inspection contractor being found personally liable for the cost(s)
related to the specific instruction provided. The COTR is the only
person specifically authorized to make a final judgment on the validity
of the inspector's report of non-compliance with contract documents.
Written reports shall be submitted in the format required by the COTR.
Advisory Responsibilities -- The contractor shall review the
construction contractors itemized application for payment request (AIA
Form G702) and provide to the COTR a written evaluation of its
accuracy to include a review of the materials stored on site. Assist
the COTR in evaluation of construction contractors progress reports and
material submittal evaluations (AF Form 3000) to insure conformance
with contract specifications; construction contractor/subcontractors
Requests for Information (RFI) and Proposed Change Orders (PCO); and
will provide, when requested, opinions on the accuracy of the prices
proposed by the construction contractors for these changes to the work.
The contractor may on occasion be required to develop cost estimates
for proposed changes to the work. Administrative Responsibilities --
The contractor shall maintain the official project file.
Responsibilities include filing contract change documents, material
submittals documents, pay requests, all other written correspondence
concerning the contract, and insure the contractor is documenting any
changes on the "red-line as-built" drawings. Equipment Requirements --
The contractor shall provide his/her own vehicle and personal
computer. All memoranda shall utilize MS Word software. The contractor
shall subscribe to an Internet service enabling him/her to have an
e-mail address. Computer generated reports shall be e-mailed daily to
the COTR. The Government shall furnish the following at no cost to the
contractor: office space, desk, chair, office supplies, utilities,
telephone, communications radio, filing cabinet, fax, and computer
printer capabilities. Performance Period: The contractor shall be
required to perform these services daily Monday through Friday normally
between the corps hours of 6 a.m. and 6 p.m. The COTR as dictated by
the work inspection requirements may adjust work hours. In no event
shall the contractor be required to work more than 40 hours per week.
The contractor will not be required to work on the following federal
holidays: Christmas; New Years; Independence Day; Memorial Day;
Thanksgiving, and Labor Day. All other federal holidays remain required
workdays. The contractor may be absent without a reduction in the
contract price for vacation and sick leave purposes not to exceed a
total of 160 hours in one contract year. Prior approval of the COTR is
required for vacation time and in all cases the contractor shall
verbally notify the COTR when sick. When the contractor exceed the 160
hours of approved leave, the contract price will be reduced on a
prorated daily basis. (E.g. basic contract price/ 26 pay periods/80
hours = rate per hour) If contractor absence substantially exceeds the
160 hours of approved leave, it will be considered breach of contract
and may be a basis for termination of the contract for default.
Contract Period: This contract will be awarded for a one-year period
with the Governments options to extend the terms of the contract four
(4) additional one-year periods. This is a non-personal administrative
assistance service contract and the contractor will not be considered
an employee of the Federal Government nor shall the contractor be
entitled to any health or retirement benefit package. The contractor
shall not be an employee of an Architect-Engineer firm that is
currently working on design projects at Forbes Field, Kansas nor firms
that plan to solicited design work during the period of this contract.
It has been determined that this is not a service contract as defined
in Part 541 of Title 29, Code of Federal Regulations. The individual
employed under this contract is performing in a professional capacity.
Contractor Qualifications: Offerors are required to submit two (2)
copies of their proposal. The proposal shall include at a minimum the
following information: (a) Resume of experience to include 10 years
past employment information, technical expertise, education, and
professional qualifications to include schools, degrees, or skills. (b)
Past Performance -- The contractor shall furnish at least three letters
of reference indicating successful achievement as a construction
inspector or related experience. An Engineering degree and/or a PE
license is a positive, but is not required under this contract. (c)
Price -- A lump sum price per year to perform the service specified in
the above statement of work and a price for each of the option years.
Award Factors -- Award shall be made to the offeror whose proposal
represents the "best overall value" to the Kansas Air National Guard
considering these factors: (1) Experience as it relates to construction
inspection. (2) Past Performance as it relates to construction
inspection. (3) Price, when combined base year plus all option years.
Price shall include all cost associated with performance of the
contract services. All of the evaluation factors other than cost or
price, when combined, are approximately equal to price. "Best overall
value" is defined as an award based on the greatest overall benefit
received in response to the requirement. Price and the technical
evaluation factors listed above are approximately equal. The Government
will conduct personal interviews with the persons submitting one of the
top three rated proposals. The provision at FAR 52.212-3, Offeror
Representations and Certifications (Oct 1995) applies to this
acquisition. A completed-signed copy of this provision shall be
submitted with any proposal. The clause at FAR 52.212-4, Contract Terms
and Conditions (Apr 1998). The clause at FAR 52.212-5, Contract terms
and Conditions Required to Implement Statutes or Executive
Orders-Commercial Items (Jun 1998 applies to this acquisition. Under
paragraph b, the following clauses are incorporated: 52.203-6,
Restrictions on Subcontractor Sales to the Government, with Alternate
I; 52.222-26, Equal Opportunity; 52.222-35, Affirmative Action for
Disabled Veterans and Veterans of the Vietnam Era; 52.222-36,
Affirmative Action for Workers with Disabilities; 252.222-37,
Employment Reports on Disabled Veterans; 52.225-3, Buy American
Act-Supplies. The clause 52.232-33, Mandatory Information for
Electronic Funds Transfer Payment (Aug 1996) applies to this
solicitation. The clause at DFARS 252.212-7001, Contract Terms and
Conditions Required to Implement Statutes to Defense Acquisition of
Commercial Items (Nov 1995), is applicable to this acquisition. Offers
