a combined synopsis/solicitation for commercial items prepared in
accordance with the format in Subpart 12.6, as supplemented with
additional information included in this notice. This announcement
constitutes the only solicitation; proposals are being requested and a
written solicitation will not be issued. This synopsis/solicitation
represents a Request for Proposal (RFP) and proposals submitted in
response must reference 52-PAPT-9-01008. This RFP incorporates all
required provisions and clauses in effect through Federal Acq. Circular
97-10 as if stated in full text, as well as the Department of Commerce
Agency Level Protest Procedures listed at
http://www.uspto.gov/web/offices/ac/ comp/proc/protest.htm. The Patent
and Trademark Office (PTO) has a requirement for a Microsoft Select
4.0 Enterprise Agreement. This agreement will be awarded by contract
and has been designated as a small business set-aside, utilizing
Standard Industrial Classification Code 7372. In order to submit a
proposal an offeror must be a small business who is an authorized
reseller of Microsoft Select Agreements. A firm fixed priced contract
will be awarded for PTO's base year requirements and will include the
ability to exercise options for two additional years. This requirement
is a follow-on renewal of PTO's Microsoft Select Agreement that
included software maintenance/upgrade advantage. For informational
purposes, the PTO's current install base is 7,000 desktop computers
that will increase to 8,000 prior to the end of 1999. The desktop
computers maintained by PTO consist of the following Microsoft
products: 32 Bit Operating System, Office Professional and BackOffice
Client. The contract will cover the base period of twelve months
beginning no later than 04/01/99, to be followed by two option periods
of twelve months each (if options are exercised). The items to be
included in this Agreement are as follows: Item 0001: Base Year -- Item

consisting of Microsoft NT Workstation Upgrade Licenses OR Windows 98

based on the actual cost of each respective year. As described in the
Select Agreement, the PTO reserves the right to "true up" and order
additional software as needed as well as provide upgrade advantage for
the additional quantities ordered. Software deliveries shall be
accomplished within 30 days after award of contract. Software shall be
shipped FOB Destination to Arlington VA. Specific delivery information
will be provided in the contract. For new licenses, or as updates
occur, the PTO will require two complete sets of the CD-ROMs for each
software title except for Visual Studio which will require 10 sets. The
Government will award a contract resulting from this synopsis to the
responsible offeror whose proposal conforms to this solicitation and is
determined to be the best value to the Government with price and other
factors considered. A contract award will include FAR 52.212-4
Contract Terms and Conditions -- Commercial Items, 52.212-5 Contract
Terms and Conditions Required to Implement Statutes or Executive Orders
-- Commercial Items as well as FAR clauses 52.217-7 Option for
Increased Quantity-Separately Priced Line Item, 52.222-26 Equal
Opportunity, 52.222-35 Affirmative Action for Special Disabled and
Vietnam Era Veterans, 52.222.36 Affirmative Action for Handicapped
Workers, 52-222-37 Employment Reports on Special Disabled Veterans and
Veterans of the Vietnam Era, 52.225-3 Buy American Act-Supplies. In
addition to the evaluation factors listed below, your proposal must
include: 1) Completed Representation and Certifications (FAR 52.212.3);
2) Documentation or Certificate that confirms offeror's ability to
provide Microsoft "Select" Agreements; and, 3) Statement confirming
offeror's unconditional acceptance to all the terms and conditions of
this solicitation. Proposals that do not contain these three elements
will be found unacceptable and will not be further evaluated. The
following factors will be used to evaluate offers: (A) Technical
Capability (A.1) Past Performance/ Experience as a Microsoft Select
Agreement Provider; (A.2) Delivery/Performance Plan; and, (B) Price.
Factor A is approximately equal to Factor B in importance. Subfactor
A.1 is substantially more important than subfactor A.2. Past
Performance/Experience shall include a minimum of five (5) references
that are no more than 5 years old. All references must include current
information that can be verified. This reference data shall include
contract number, agency or company name, point of contract including
valid phone numbers and fax number, description of the service provided
and how it relates to this requirement. Reference info. should include
the names of those who can verify that you have previously provided
similar effort and that you have performed quality services in the
past. The Delivery/Performance Plan shall include a brief description
of the offeror's plan to meet PTO's requirements for a 3 year Select
Agreement especially with regard to delivery of updates, revisions and
patches as they become available. Proposals shall include pricing for
all items and subline items shown above. The Government will evaluate
offers for award purposes by adding the total price for all options to
the total price for the basic requirement. The Government may determine
that an offer is unacceptable if the option prices are significantly
unbalanced or all items are not priced. The provisions of FAR 52.212.1
shall apply. The exact part numbers shall be utilized unless special
manuf. pricing programs are available for identical products. All
offers are due on March 08, 1999, no later than 2:00 PM, Eastern
Standard Time (EST). One original plus two copies, shall be addressed
