Armament Center WGK anticipates award of a firm fixed price, sole
source contract modification to PGSUS, Limited Liability Company,
Orlando, Florida. This award, subject to receipt of funds, will be for
the purchase of extended warranties for approximately one hundred
forty-four (144) AGM-142 missiles, associated hardware (e.g. CATMs,
Data Link Pods, Test Sets, and TV Seekers), and those spare sections
that were procured on current and previous contracts that are
compatible with Lot 6, 7, 8, and 9 missiles, and provides for a common
warranty end date. This modification will also include provision for
the refurbishment of CATMs or Data Link Pods. The contract modification
will also include three options for extension of the warranty, with the
first two options requiring refurbishment of either CATMs or Data Link
Pods. This action is contemplated in accordance with 10 U.S.C. 2304 C
(1), since PGSUS is believed to be the only known responsible source
that can satisfy the government's requirements. No Government technical
data or Government furnished equipment is available for this
procurement. All responsible sources may submit a statement of
capability in accordance with Notes 22 and 23, which will be
considered. Synopsis responses should also address the following areas:
a. Technical knowledge of the AGM-142 weapon system sufficient to
reliably maintain and repair AGM-142 AURs & components to meet
specification requirements; b. Capability to refurbish CATMs and Data
Link Pods to meet original design specifications; and c. Ability to
perform acceptance tests of the AGM-142 weapons system hardware in
accordance with approved procedures. Interested parties must submit a
written statement of capability to the contracting office no later than
15 days from the publication of this announcement. This is not a
request for proposal and is not to be construed to be a commitment by

been appointed to address concerns from offers or potential offerors
during the proposal development phase of this acquisition. The
Ombudsman does not diminish the authority of the program director or
contracting officer, but communicates contractor concerns, issues,
disagreements, and recommendations to the appropriate government
personnel. When requested, the Ombudsman will maintain strict
confidentiality as to the source of the concern. The Ombudsman does not
participate in the evaluation of proposals or in the source selection
