responsible sources and obtain information in regard to the
privatization of utility systems in accordance with 10 USC 2688,
"Utility Systems: Conveyance Authority." The Naval Facilities
Engineering Command, Southwest Division, is seeking interest and
information for the privatization of the electrical, natural gas,
water, and wastewater utility systems located at: (1) U.S. Naval Air
Station (NAS) at Point Mugu, CA; (2) U.S. Naval Air Station (NAS)
Family Housing Complex, Camarillo, CA; and (3) U.S. Naval Construction
Battalion Center (NCBC) at Port Hueneme, CA. The resulting
privatization will include assumption of ownership, operation and
maintenance responsibility, and an obligation to continue the service
for an indefinite and ongoing period. Should privatization result, the
ownership of the entire utility distribution and/or collection system,
including all operating responsibility, shall transfer to a municipal,
private, regional, district, or cooperative utility company or to
another entity. All responsibility for maintaining reliable service,
including such items as environmental compliance, maintenance costs,
major system renovations, construction, equipment, manpower, and
overhead costs shall become the utility provider's responsibility.
System descriptions have been developed for the above Navy Activities,
and will be provided through electronic medium. System descriptions
will be available for download on or about 12 March 1999 free of charge
via the Internet World Wide Web at http://www.efdswest.navfac.navy.mil.
The official system descriptions (plan) holders list will be maintained
on and can be printed from the website. All interested parties are
encouraged to register as (plan) holders of the system descriptions on
the website. System descriptions (plan) holders lists will not be
faxed and will only be available from the website. Registering parties
must provide a complete name, mailing address, area code and phone
number, interest type (prime contractor, sub contractor, supplier,
etc.), email address and size (large business, small business, small
disadvantaged business, woman owned small business or other).
Notification of any changes (amendments) to the solicitation will be
made only through the Commerce Business Daily or the above Internet
site. It will be the contractor's responsibility to check the website
for any posted changes. The Government cannot guarantee that it will
enter into a contract at the end of the procurement process. The award
of a privatized utility service contract is contingent upon the
ability of the Government to certify to Congress that the long-term
economic benefit of a conveyance of the Government-owned utility system
exceeds the long-term economic costs, and the conveyance will reduce
the long-term costs for the provision of distribution or collection
service. The Government shall not be held responsible for the cost of
a party's expression of interest or, if a formal request for proposals
(RFP) is issued, the cost of an offeror's proposal. This request for
information (RFI) is a required component of a complete and systematic
process to implement the Department of the Navy's utility
privatization program. In order to minimize costs both to potentially
interested parties and the Government, this notice is being issued as
an element of that process to determine the interest, responsive
capability and economic feasibility of proceeding with formal requests
for proposals. If responsive statements of interest are received, a
follow-on element of the process will be an industry forum to be held
at either NCBC or NAS. The forum will be scheduled four weeks from the
receipt of expressions of interest. Should insufficient credible
interest or responsive capability be identified for a privatization
action, it is likely that no formal solicitation will be issued;
otherwise a formal request for proposals may be forthcoming. It is
anticipated that any proposal received in response to a privatization
RFP will require a certification of an offeror's legal right to provide
the required service and capability to initiate the service within a
reasonable time after contract award. It is further anticipated that
the failure to initiate the required service after contract award would
be deemed a termination for default and that liquidated and other
appropriate damages may be assessed. Interest may be expressed for one
or more of the utility systems located at the above U.S. Navy
installations. Interested parties should submit a statement of interest
on company letterhead to 1220 Pacific Highway, San Diego, CA
92132-5190, to the attention of H. Douglas Powell, Code 4PW2.HP. Only
one statement of interest should be submitted by any one company, and
should not exceed 15 pages in length, plus two additional pages
specific to each installation and/or utility system for which interest
is expressed. Interest statements are due at the address above on or
before 12 April 1999, or 30 days after being published in the Commerce
Business Daily, which ever date is later.The statement of interest
submitted shall address all of the following general criteria, as a
minimum: (1) capability and experience in the ownership, operation,
expansion and maintenance of similar systems; (2) financial capacity to
purchase, expand, maintain, and operate a utility system; (3) a
statement expressing a willingness and understanding of an obligation
to provide continuous utility service; (4) understanding of any
applicable state or local utility law or franchise requirements,
capability of complying with such requirements, capability of direct
cooperation with private, local, municipal, and state entities and the
capability of obtaining legal certification to provide the applicable
service; (5) understanding of the federal, state, and local
environmental laws and regulations, familiarity and experience with
environmental compliance procedures and regulations for the applicable
state(s), and US Environmental Protection Agency, and a statement of
willingness to comply with same. Elaborate proposals or pricing
information are neither required nor desired. Any innovative and/or new
conceptual ideas, recommendations for utility system aggregation to
achieve the stated objectives and requirements are encouraged. Joint
ventures and partnering concepts designed to improve the economic and
service benefits to the Government are also acceptable and encouraged,
and should be identified in the submitted statement of interest. The
Government does not intend to issue a conveyance document on the basis
of this announcement. It should be noted that other RFIs for different
U.S. Navy or U.S. Marine Corps installations and utility systems may be
issued in the same time frame, or at a later date. A separate response
to each RFI is required. Site visits are not considered necessary for
preparation and submittal of statements of interest. If site visits
forum are later determined necessary, notification will be provided by
