combined synopsis/solicitation for commercial items prepared in
accordance with the format in Subpart 12.6, as supplemented with
additional information included in this notice. This announcement
constitutes the only solicitation; proposals are being requested and a
written solicitation will not be issued. The solicitation number is
USZA95-97-R-0027 for modification of 12 each #40 KVA Mobile Frequency
Converters, Part Number: PPC032-V-40-AM-12P-CM. The modification will
enable these units to power two aircraft rather than one. This
solicitation incorporates provisions and clauses that are in effect
through Federal Acquisition Circular 97-7. Standard Industrial
Classification (SIC) Code applicable to this acquisition is 3679. The
size standard is 500. The U.S Army Special Operations Command intends
to issue a firm fixed price to the intended source FCX Systems, Inc.,
3216 Earl L. Core Road, Morgantown, WV 26508 Delivery is estimated to
be April 1999. FCX Systems, Inc possesses engineering expertise and
technical data to provide 40 KVA Mobile Frequency Converters to the
Government. The 40 KVA Mobile Frequency Converters is a commercial
item. Commercial procedures are applicable at FAR Parts 12 and 13.6.
The Government does not own technical data for 40 KVA Mobile Frequency
Converters FCX Systems, Inc owns all design rights and is the only
known manufacturer. The proposed contract action is for supplies or
services for which the Government intends to solicit and negotiate with
only one source under the authority of FAR 6.302. A determination by
the Government not to compete this proposed contract action for 40 KVA
Mobile Frequency Converters that are based upon responses to this
notice is solely within the discretion of the Government. Information
received will normally be considered solely for the purpose of
determining whether to conduct a competitive procurement. The
inspection/acceptance and FOB Point are Destination Modifications to be
at (DODDAC W80N5C): MSSA/CRP HHC 160th SOAR (ABN), 7262 Nightstalker
Way, Attn: MSG McGowan, Ft. Campbell, KY 42223-6012). The provision at
52.212-1, Instructions to Offerors -- Commercial, applies to this
acquisition without addenda. The provision at 52.212-2 "Evaluation
Commercial Items" applies to this solicitation. Award will be made to
the low technically acceptable offer. The clause at 52.212-4, Contract
Terms and Conditions -- Commercial Items, applies to this acquisition
without addenda. The clause at 52.212-5, Contract Terms and Conditions
Required To Implement Statutes Or Executive Orders -- Commercial Items,
applies to this acquisition. The following optional clauses cited
within 52.212-5 apply: 52.222-26 -- Equal Opportunity / 52.222-35 --
Affirmative Action for Special Disable and Vietnam Era Veterans /
52.222-36 -- Affirmative Action for Handicapped Workers / 52.225-18 --
European Union Sanction for End Products / 52.247-64 -- Preference for
Privately Owned U.S. Flag Commercial Vessels. The clause at DFARS
252.212-7001, Contract Terms and Conditions Required to Implement
Statutes or Executive Orders Applicable to Defense Acquisitions of
Commercial Items, applies to this acquisition. The following optional
clause cited within 252.212-7001 applies: 252.225-7001 -- Buy American
Act and Balance of Payment Program. As previously noted, the known
source of supply is Signal Processing Systems, San Diego California.
Specifications, plans or drawings relating to the procurement described
are not available and cannot be furnished by the government. All
responsible Sources may submit a quotation which shall be consider.
Quotations are due 24 March 1999, 3:00 p.m. local time. Written
