17. ATTENTION UNRESTRICTED FIRMS. This proposed contract is
unrestricted. Responses are being accepted from all firms. Firm Fixed
Price Contract. Provide for purchase 6.0 tons/yr of Air Pollution
Emission Reduction Credits (ERC's) for Volatile Organic Compounds
(VOC's). The Navy will accept lesser quantities under multiple awards
in order to satisfy Navy's requirement. Minimum quantity shall not be
less than 1.0 ton/yr and may accept amounts in increments of .10 ton/yr
above the 1.0 ton/yr (i.e. 1.10 ton/yr, 1.20 ton/yr). Selection
criteria will include (in order of importance): (1) Technical
capability of the ERC to meet the requirement. Transfer to the Navy the
proposed tons per year of Air Pollution Emission Reduction Credits
(ERC's) for Volatile Organic Compounds (VOC's) that are currently
banked with the San Diego County Air Pollution Control District (APCD)
pursuant to APCD Rule 26, et seq. APCD ERC Certificate ownership is
required. The ERC's evidenced by this certificate must be registered in
the APCD Banking Registry and shall have been determined by the APCD to
be Class A, real and permanent reductions in emissions. In addition to
the above paragraph, the ERC's shall be otherwise fully recognized by
appropriate federal, state and local authorities as legally valid for
use as permanent emissions offsets to obtain necessary permits under
all applicable laws pertaining to the control and abatement of air
pollution. Such laws include but are not limited to legal requirements
applicable to "major sources" or "major modifications" of sources of
air pollutants. NOTE: The contractor, at time of proposal submission,
is warranting the validity of all ERC's in accordance with the
requirements the warranty language set forth in the Request for Quote
(RFQ). Transfer of banked emission reductions shall be made pursuant to
APCD Rule 26.3. The contractor shall provide original certificate of
ownership to the APCD and banked ERC's shall be transferred in whole or
in part by any means or conveyance permittedby the state of California.
The contractor shall provide evidence to the Government that the APCD
has been informed, in writing, of the transfer and that the Air
Pollution Control Officer has recorded the transfer in the Banking
Registry. The transaction shall be complete upon the Navy's receipt of
certificate of ownership of transferred ERC's from the San Diego Air
Pollution Control Officer. The contractor shall be responsible for all
banking application fees, banked emission transfer application fees,
reclassification application fees and fees for an advisory opinion (if
any) paid in accordance with labor rates specified in APCD Rule 40.
(2) Ability to meet required delivery date and FOB terms. The official
transfer process for the ERC's shall be initiated with the San Diego
County Air Pollution Control District (APCD) within 10 working days
after date of contract and shall be delivered (i.e. transfer complete)
no later than 14 calendar days after contract award, exclusive of
delays solely attributed to the APCD. All certificates shall be
registered to USN, PUGET SOUND NAVAL SHIPYARD, and delivered to
SOUTHWEST DIVISION, NAVAL FACILITIES ENGINEERING COMMAND, Attn: Code
5SEN.KB, at 1220 Pacific Highway, San Diego, CA 92132-5190. (3) Price.
Lowest price for ERC's meeting the requirements above for (1) and (2).
Those firms that meet the requirements described in this announcement
and wish to be considered must submit one completed copy of the SF18.
