Department of Veterans Affairs, Austin Automation Center (AAC) is
hereby issuing a sole source combined synopsis/solicitation for
commercial items prepared in accordance with the format in FAR 12.6,
and supplemented with information included in this notice. THIS NOTICE
IS THE SOLICITATION, RFP 200-19-99, and is being issued as a request
for quotation; a written solicitation will not be issued. Requests for
a written solicitation will be considered non-responsive. Proposals
are due by NOON CST on March 31, 1999. The solicitation incorporates
provisions and clauses in effect through Federal Acquisition Circular
97-11. The AAC previously acquired the RSD base software for EOS Web
API for customization to suit the requirements of the AAC. Now, the AAC
intends to award a sole source contract to RSD (300 Frank W. Burr
Blvd., Teaneck, NJ 07666) for their proprietary software license to
Enterprise Output Solution (EOS) Web Application Program Interface
(API) and to the customized portion. The software license is perpetual.
Offerors are required to provide pricing for the following line items:
100 user license fee, and maintenance fee for period 3/31/99 to
3/30/00; 250 user license fee, and maintenance fee for period 3/31/99
to 3/30/00; 500 user license fee, and maintenance fee for period
3/31/99 to 3/30/00; 1000 user license fee, and maintenance fee for
period 3/31/99 to 3/30/00; 5000 + users site license fee, and
maintenance fee for period 3/31/99 to 3/30/00; and, maintenance fee for
period 3/31/00 to 3/30/01 for each of the different user license fees.
Description of Requirements: RSD will grant the software license to
the customized EOS Web API and provide software maintenance (updates
and enhancements, and technical support) for the RSD EOS Web API
software during the period 3/31/99 to 3/30/00. The AAC will make award
on one of the user license fee line items and the associated
maintenance fee for the period 3/31/99 to 3/30/00; pricing is required
for all line items for evaluation purpose only. TERMS AND CONDITIONS:
FAR 52.212-1, Instructions to Offerors-Commercial, applies. FAR
52.212-2, Evaluation-Commercial Items, applies. Offers will be
evaluated based on price and technical ability to provide the software
license and software maintenance. Offers failing to meet the minimum
criteria identified in "Description of Requirements" will be rejected.
Offerors are required to include a completed copy of the Provision at
52.212-3, Offeror Representations and Certifications-Commercial Items,
in their proposal. FAR 52.212-4, Contract Terms and
Conditions-Commercial Items, applies. FAR 52.212-5, Contract Terms and
Conditions Required to Implement Statutes or Executive
Orders-Commercial Items, applies and is incorporated. Addendum to FAR
52.212-4: (n) Title. Unless specified elsewhere in this contract, title
to the software furnished under this contract shall remain the sole
property of the Contractor or as defined in the software license
agreement; (o) Warranty. (Year 2000 Compliance) The Contractor warrants
that information technology delivered under this contract shall be able
to accurately process date/time data (including, but not limited to,
calculating, comparing, and sequencing) from, into, and between the
twentieth and twenty-first centuries, and the years 1999 and 2000 and
leap year calculations, to the extent that other information
technology, used in combination with the information technology being
acquired, properly exchanges date/time with it. If the contract
requires that specific listed products must perform as a system in
accordance with the foregoing warranty, then that warranty shall apply
to those listed products as a system. The duration of this warranty
and the remedies available to the Government for breach of this
warranty shall be as defined in, and subject to, the terms and
limitations of the contractor's standard commercial warranty or
warranties contained in this contract, provided that notwithstanding
any provision to the contrary in such commercial warranty or
warranties, the remedies available to the Government under this
warranty shall include repair or replacement of any listed product
whose non-compliance is discovered and made known to the contractor in
writing within ninety (90) days after acceptance. Nothing in this
warranty shall be construed to limit any rights or remedies the
Government may otherwise have under this contract with respect to
defects other than Year 2000 performance. Non-compliant information
technology shall be upgraded to be Year 2000 compliant prior to the
earlier of (1) the earliest date on which the information technology
may be required to perform date/time processing involving dates later
than December 31, 1999, or (2) December 31, 1999. The FAR references
