The U.S. Dept. of Commerce/NOAA, National Weather Service (NWS), intends to negotiate and award a sole source five year requirements contract with Andrew Canada for the provision of Antenna Assembly spare parts originally manufactured by Andrew Canada through Unisys/Loral and later Lockheed Martin as a component of the WSR-88D Weather Radar System. The patent and data rights to the Antenna system are proprietary to Andrew Canada. The Government does not own rights in data or drawings rights for re-procurement. The Government intends to give Andrew Canada Government owned tooling acquired from the closeout of the prime contract with Unisys/Loral. The U.S. Government would cede ownership of the tooling to Andrew Canada for a set of reflector panels valued at $22,896.00. Further, The U.S. Government would maintain right of first refusal to buy back the tooling for the same price. Andrew Canada will maintain the tooling for a period of five years, the Government will order antenna parts as needed of this period of time. The intended procurement is for supplies for which the Government intends to acquire from one manufacturer under the authority of 41USC253 (c)(1). The Government knows of only one source authorized to manufacture the components. This is not a request for proposals and there is no solicitation available at this time. This acquisition is being conducted pursuant to the guidelines set forth in FAR Part 15. The Government reserves the right to award this requirement without further notice. All interested parties must respond to this announcement within 30 calendar days of publication.
