Ord, Contract Officer (304)296-4416 ext 290 (i) This a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in the notice. This announcement constitutes the only solicitation; offers are being requested and written solicitations will not be issued. (ii) This solicitation is issued as Request for Quotation 103-0019-9. (iii) The solicitation document and incorporated provisions are those in effect through Federal Acquisition Circular FAC 97-10. (iv) This solicitation is unrestricted and is not set-aside for small business. The Standard Industrial Classification Code (SIC) is 8322, with a size standard of $5.0 million. (v) A list of contract line item numbers, items, and quantities, including options, are as follows: (1) Base year -- 1040 sessions/year=price per session; (2) Option year 1 -- 1040 sessions/year=price per session; (3) Option year 2 -- 1040 sessions/year=price per session; (4) Option year 3 -- 1040 sessions/year=price per session; (5) Option year 4 -- 1040 sessions/year=price per session. Offers must separately provide session prices for the base year and each option period. The periods of performance shall be as follows: Base year shall be from date of award through 12 months; Option 1 shall be from 13 months through 24 months; Option 2 shall be from 25 months through 36 months; Option 3 shall be from 37 months through 48 months; and Option 4 shall be from 49 months through 60 months. Pursuant to FAR 17.203(d), offerors may propose varying prices for any or all of the option periods. (vi) (1) The Federal Correctional Institution, Morgantown, WV, intends to make a contract award for the implementation of a Family Enrichment Program which meets the requirements listed below. (2) The contractor shall provide the service on a nondiscriminatory basis and shall adhere to all the rules and procedures of the FCI and all applicable federal, state and local laws and requirement in effect during the term of the contract. The manner and method of performing the requirements are within the sole discretion of the contractor who shall perform in accordance with professional standards and methods as outlined in the Bureau of Prisons Family Enrichment Policy Statement. The BOP has the sole discretion to determine the contractor's compliance with the contract. (3) The contractor shall provide a program which meets the following standards: (a) The program shall support the development and maintenance of positive relationships between inmates, their spouses or custodial parents, and their children; (b) In space provided by the FCI, the contractor shall structure programs which provide an opportunity for inmate parents, visiting spouses or custodial parents and children to interact in ways designed to strengthen family relationships; (c) The contractor shall provide structured family enrichment education courses to inmates and parents, and, when feasible, to visiting spouses of custodial parents. These courses will be in addition to those ordinarily offered by the FCI. The curriculum shall address the following subject areas: (1) Parenting Skills: Building family relationships, sensitivity to the impact of a parent's incarceration on children and family members, how to assist in childhood development and related activities; (2) Skills for Family Support: Analyzing and meeting the needs of families, including job search and retention skills, family budgets, stress management, problem solving and setting priorities; (3) Substance Abuse Education: Addressing the effects of substance abuse, its impact on children and family members and strategies to break substance addiction. (4) The contractor shall be required to maintain records on Family Enrichment Programs which show the following: (a) Expenditures during the course of the contract period; (b) The number of inmate parent non-duplicated enrollments and completions in structured parenting classes; and the number of hours per week, per year, per enrollee and the totals of each for the contract period; (c) The number of children, non-duplicated, involved in the program and the number of hours involvement of each child per year and the total for the contract period; (d) The number of non-duplicated visiting spouses or custodial parents, in visiting room parenting activities, per week; the number of hours per week of their activities and the total for the contract period; (e) A copy of all curriculums used in Family Enrichment Education and related courses; (f) A full description of the scope of the program, including the numbers of volunteers and their affiliation, if any, the names of social services accessed, costs, if any, services provided, and related information. (5) The contractor shall identify and facilitate the use of Community based volunteers and the free services of such organizations as Boy/Girl Scouts, Children's Television Workshop (CTW), Literacy Volunteers of America (LVA) and such other organizations which make available volunteer and free services. All volunteers are subject to the minimum security and training standards as outlined in P. S. 3000.03, Human Resource Management Manual, and P. S. 5300.14, Volunteers, Involvement in Programs. (6) The contractor must provide no less than 10 hours of supervised visiting room activities and 4 hours of family enrichment education classes per week for a period of 36 weeks. Class hours shall be established after appropriate discussion and coordination with institution staff. The contractor's performance should be contingent upon continued inmate participation in family enrichment programs and it will not be compensated if its only participants are outside individuals. (7) Total participation during the contract period, base year and each option year, is estimated as follows: Inmates=100, Visiting Spouses or Custodial Parents=100, and Visiting Children=125. (8) The contractor shall provide at least one part-time on site position to fulfill the requirements of the contract. This position will act as the coordinator and shall be responsible for the implementation and maintenance of the total Family Enrichment Program. His/her responsibilities shall include recruiting program activities, establishing and coordinating program activities and structured classes, developing course curriculums and the maintenance and provision to the FCI of all records and required reports associated with the implementation of the Family Enrichment Program. (9) The contractor will not be responsible for the direct management of inmates. All program supplies will be furnished by the Government. The contractor shall agree to adhere to all regulations prescribed by the institution for safety, security, custody and conduct of inmates. The awarded contractor shall attend an orientation session, prior to assuming contract effort. Reimbursement to the contractor for time spent in the institution security orientation shall be at the contract rate. In accordance with the Prompt Payment Act, contract payments will be made monthly, based on sessions received by the Government. For security reasons, the Government reserves the right to prohibit certain individuals from work under this contract. (vii) The place of performance shall be Federal Correctional Institution (FCI), Morgantown, West Virginia. The schedule shall consist of 1040 sessions per year and 1040 sessions per year per option period (a session is defined as one (1) hour), not to exceed more than thirty sessions per week. Sessions shall be held Monday through Friday, excluding federal holidays. The exact times of the sessions may be negotiable. (viii) FAR provision 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition and is hereby included by reference. The following are addenda to FAR provision 52.212-1: At paragraph (c), Period for Acceptance of Offers, the amount of time an offeror must hold its prices firm is hereby changed to 60 calendar days from the date specified for receipt of offers. Paragraph (e) Multiple offers, has been determined by the Contracting Officer to be non-acceptable to this solicitation and is hereby removed in its entirety for the purpose of this requirement. Evaluation factors for Award: Offerors are advised that proposals shall be evaluated without discussions. An award may be made without discussions, to the responsible offeror whose proposal is responsive to the terms of the RFQ and is most advantageous to the Government. Business references: In accordance with FAR Subpart 9.104-1, each offeror is required to provide information on a reasonable number of recent and relevant contracts for the same or similar items, as well as, the offeror's primary financial institution, to include contract numbers, points of contact, telephone numbers and any other relevant information which will be used by the Contracting Officer to make a responsibility determination about a prospective offeror. (ix) FAR provision 52.212-2 Evaluation-Commercial Items, applies to this solicitation and the following evaluation criteria are hereby incorporated: Technical proposal, price and past performance. (x) Offerors must include a complete copy of the FAR provision 52.212-3 Offeror Representations and Certifications-Commercial Items, with their proposals. (xi) FAR clause 52.212-4 Contract Terms and Conditions-Commercial Items hereby applies to this acquisition. The following are addenda to FAR clause 52.212-4(l). The following FAR clauses are hereby incorporated by reference: 52.224-1 Privacy Act Notification; 52.224-2 Privacy Act; 52.225-11 Restrictions on Certain Foreign Purchases, 52.232-18 Availability of Funds; 52.217-5 Evaluation of Options and 52.203-3 Gratuities. The following clauses are hereby incorporated in full text: FAR 204-1 Approval of Contract: This contract is subject to the written approval of the Bureau of Prisons, Federal Correctional Institution, Morgantown, WV, and shall not be binding until so approved; FAR 52.216-1 Type of Contract: The Government contemplates an award of a firm fixed price contract resulting from this solicitation; FAR 52.217-8 Option to Extend Services. The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed six months. The Contracting Officer may exercise the option by a written notice to the Contractor no less than 14 calendar days before contract expiration; FAR 52.217-9 Option to Extend the Term of the Contract: The Government may extend the term of this contract by written notice to the Contractor within the first day of the ensuing option period, provided that the Government shall give the contractor a preliminary written notice of intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. If the Government exercises this option, the extended contract shall be considered to include this option provision. The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years. The following terms and conditions are hereby incorporated: In accordance with Bureau of Prisons Acquisition Policy 37.103, Security Requirement: A security file will be maintained on each of the contractor's employees for the contract duration. The following information will be maintained in the file: National Crime Information Check; DOJ-99, Name Check; Fingerprint check (FD- 258); authority for release of information (OPM-329A); Law Enforcement Agency Checks, Vouchering of Employers over the past five years; Resume/Personal Qualifications; OPM-329- A (Authority for Release of Information; and NACI check, if applicable. A urinalysis test shall be required (for detection of marijuana and other drug usage) before the contract is awarded. If the proposed contract is with an individual, and if the test is positive, the proposed contractor shall be disqualified from being awarded the contract. If the proposed contract is with a company and the individual (s) assigned to perform the work test positive, the individual(s) shall be excluded and the proposed contractor shall provide acceptable replacement personnel subject to the same security requirements; Justice Acquisition Regulation (JAR) clause 2852.270-70, Contracting Officer's Technical Representative. The contractor's performance shall be monitored by the Contracting Officer's Technical Representative (COTR). The COTR is responsible for: receiving all deliveries, inspecting and accepting the supplies or services provided hereunder in accordance with the terms and conditions of this contract, providing direction to the contractor which clarifies the contract effort, fills in details or otherwise serves to accomplish the contractor scope of work; evaluating performance; and certifying all invoices/vouchers for acceptable of the supplies or services furnished for payment, prior to forwarding the original invoice to the payment office and confirmed copy to the Contracting Officer. The COTR does not have the authority to alter the contractor's obligations under this contract, direct changes that fall within the purview of the General Provisions clause, entitled"Changes" and/or modify any of the expressed terms, conditions, specification, or cost to the Government. If as a result of technical discussions, it is desirable to alter/change contractual obligations or the scope of work, the Contracting Officer shall issue such changes in writing with a signed modification. The contractor shall be aware that (1) The service is a contractual arrangement and not a personnel appointment; (2) Payment is based on the provision of an end product or the accomplishment of a specific result; (3) The service does not constitute an employer/employee relationship; and (4) The contractor will not be subject to Government supervision, except for security related matters. However, Contractor performance shall be closely monitored. (xii) In accordance with FAR clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. The following additional FAR clauses cited in the clause are applicable to the acquisition: 52.203-6 Restrictions on Subcontractor Sales to the Government, Alternate I; 52.203-10 Price or Fee Adjustment for Illegal or Improper Activity; 52.219-8 Utilization of Small Business Concerns and Small Disadvantaged Business Concerns; 52.219-14 Limitations on Subcontracting; 52.222-26 Equal Opportunity; 52.222-35 Affirmative Action for Special Disabled and Vietnam Era Veterans; 52.222-36 Affirmative Action for Handicapped Workers; 52.222-37 Employment Reports on Special Disabled Veterans of the Vietnam Era; 52.222-41 Service Contract Act of 1965; 52.222-42 Statement of Equivalent Rates for Federal Hires; and 52.225-19 European Community Sanctions for Services. 52.232-28 Electronic Funds Transfer Payment Method; 52.237-2 Protection of Government Buildings, Equipment and Vegetation. (xiv) The Defense Priorities and Allocations System (DPAS) and assigned rating, is not applicable. (xv) There are no Commerce Business Daily numbered notes.
