COMMERCE BUSINESS DAILY ISSUE OF APRIL 21,1999 PSA#232951 -- TOOLS, HAND HELD (POWERED AND NON-POWERED), TOOL KITS, PORTABLE
TOOL BOXES, WOODWORKING AND METALWORKING MACHINERY AND EQUIPMENT, AND
RELATED ACCESSORIES. The synopsis which was sent to the CBD and posted
on the Electronic Posting System (EPS) on January 26, 1999,
Solicitation Number 6FES-980203-R3, is modified to notify vendors of a
new reporting requirement. Effective January 12, 1999, no contract
valued at over $25,000 may be awarded or exercised until the
Contracting Officer has determined that the contractor has submitted
the most recent VETS 100 report. In addition, certain clauses have been
updated since issuance of the above solicitation. In order to provide
further information concerning the VETS 100 and to update the above
solicitation to include the most recent clauses, an amendment will be
issued. The amendment willl include the following: REPORTING COMPLIANCE
WITH VETERANS EMPLOYMENT REQUIREMENTS (a) The Offeror represents that,
if it is subject to the reporting requirements of 38 U.S.C. 4212 (d),
(i.e. the VETS-100 report required by the Federal Acquisition
Regulation clause 52.222-37, Employment Reports on Disabled Veterans
and Veterans ofthe Vietnam Era), it has [ ], has not [ ] submitted the
most recent report required by 38 U. S. C. 4121 (d). (b) An offeror
who checks "has not" may not be awarded a contract until the required
reports are filed (31 U. S. C. 1354). Prior to contract award,
contractors will be required to comply with the provisions of 52.222-37
and to submit the required report(s). For informational purposes,
Clause 52.222-35, Affirmative Action for Special Disabled and Vietnam
Era Veterans and Clause 52.222-37, Employment Reports On Special
Disabled Veterans and Veterans Of the Vietnam Era (APR 1998) will be
provided in full text in Amendment One to the above solicitation. These
clauses were incorporated by reference in the solicitation. Contractors

are also advised that delivery for most items under this solicitation
will be FOB destination. However, the FOB Origin clause has been
included in the solicitation to cover situations where the items are so
large or bulky as to be "freight-intensive." This is particularly
applicable to machines under Federal Supply Classes 3220, 3405, 3413,
3415, 3416, 3417, 3418, 3431, 3433, 3441, 3442, 3444, and 3445. FOB
Origin terms may be negotiated as applicable -- at the discretion of
the contracting officer -- taking into account such factors as the size
