for commercial items prepared in accordance with the format in FAR
Subpart 12.6 and FAR Part 13, as supplemented with additional
information included in this notice. THIS ANNOUNCEMENT CONSTITUTES THE
ONLY SOLICITATION; QUOTES ARE BEING REQUESTED AND A WRITTEN
SOLICITATION WILL NOT BE ISSUED. Solicitation number N00421-99-Q-1108
is issued as a Request for Quote (RFQ). The incorporated provisions and
clauses are those in effect through Federal Acquisition Circular (FAC)
97-11, Defense Acquisition Circular (DAC) 98-01, and Defense Change
Notice (DCN) 98-1014. This action is 100% set-aside for small
businesses. The applicable SIC code is 7373. All changes to this
solicitation will be sent electronically to the Commerce Business Daily
as amendments. The following items are required, "BRAND NAME OR EQUAL"
(one each): CLIN 0001 Cyberware 3030RGB/PS Head/Face Scanner Bundle.
CLIN 0001 consists of the following subline items: 000101 Head/Face 3D
Color Scanner; 000102 External Portrait Style Motion System; 000103
Subject Chair; 000104 Power Supply and Cables; 000105 Graphics
Workstation; 000106 Test Cylinder; 000107 CYScanNT (Scan control and
data rendering software); 000108 CySurf (Post production editing
software); 000109 Decimate (Polygon reduction software); 000110
Conversion Utilities, Mtool: Conversion to industry standard software
(output DXF, ASCII, PLY, STL, IGES formats); 000111 On-site
installation and training; 000112 One year "return-to-factory"
warranty; 000113 Telephone and email technical support for a year;
000114 Software upgrades for one year. Cyberware is located at the
following address: 2110 Del Monte Ave., Monterey, CA 93940. The
3030RGB/PS Head/Face Scanner system is described in Cyberware
literature entitled, "Rapid 3D Color Digitizer Model 3030". CLIN 0001
shall meet the following minimum characteristics (Note: Additional
characteristics are provided on a subline item basis): 1) The system
shall require no contact with the subject to accomplish the scan; 2)
The assembled system shall fit within a room with a ten-foot ceiling;
3) The system shall require no field calibration; 4) Assembly of the
system shall take no longer than three hours by two people; 5)
Disassembly shall take no longer than three hours by two people; 6) The
disassembled system shall fit through double doors (84" length x 65"
width of open space); 7) The system shall be PC Based/Microsoft NT; 8)
The system shall be compatible with the Helisys LOM (Laminated Object
Manufacturing) 2030E; 9) The system shall be compatible with Imageware
Surfacer Software (Imageware Headquarters: 4251 Plymouth Rd. Bldg. #3,
Ann Arbor, MI 48105). 10) The system shall be Y2K compliant. Subline
Item 000101 shall meet the following minimum characterisitcs: 1) The
scanner shall use a low intensity light source that is CDRH Class I
certified; 2) The scanner shall be color balanced for use under cool
white fluorescent lighting conditions at 60 Hz line frequency; 3) The
mirror assembly shall be quartz coated; 4) The scanner shall include a
first-surface mirror assembly; 5) The scanner shall have high-quality
imaging optics; 6) The scanner shall have 100% blemish-free CCD video
range and color sensors. 7) The scanner shall have resolution such
that spacing between neighborhood points never exceeds 3mm. Subline
Item 000102 shall meet the following minimum characteristics: 1) The
external portrait style motion system shall be height adjustable; 2)
The external portrait style motion system shall have a scan path that
is circular. Subline Item 000103 shall meet the following minimum
characteristics: 1) The subject chair shall be castorless; 2) The
subject chair shall be backless. Subline Item 000104 shall meet the
following minimum characteristics: 1) The power supply shall operate at
1500W; 2) The power supply shall be switchable for European voltages
and frequencies. Subline Item 000105 shall include/meet the following
minimum characteristic: 1) The workstation shall include a computer
that is Pentium based; 2) The workstation shall include a Windows NT
operating system 3) The workstation shall include a super VGA 17" Color
Monitor 4) The workstation shall include an Adaptec or Symbios Logic
SCSI Interface Card (An Adaptec PCMCIA SCSI Card may also be used); 5)
The workstation shall include a SCSI-1 Cable and a terminator; 6) The
workstation shall include one free SCSI Address; 7) The workstation
shall include an Accelerated 3D-Graphics Card and Drivers that support
OpenGL; 8) The workstation shall have a minimum of 128Mb RAM; 9) The
workstation shall have a minimum of 120Mb of free hard disk space; 10)
The workstation shall have a CD-ROM Drive; 11) The workstation shall
have a 3.5 disk drive; 12) The workstation shall include and operate
utilizing a two or three button mouse. Quotations from offerors
providing an equal must include: the manufacturer's name, the model or
part numbers, and descriptive literature. This will be a firm-fixed
price contract. All items shall be delivered FOB Destination within 90
days after contract award to: Controlled Humidity Warehouse / Supply
Receipt Control Branch, Bldg. 665, Naval Air Station, 47179 Vaughn Road
Unit NASSU Patuxent River, MD 20670-1614, M/F: (TBD at issuance of
order). Inspection and acceptance shall be made at the destination. FAR
52.212-1 Instructions to Offerors Commercial Items (Aug 1998) and DFARS
252.211-7003 Brand Name or Equal (Dec 1991) are incorporated by
reference and apply to this acquisition. Within FAR 52.212-1, any
reference to "offer" is changed to read as "quote". The provision at
FAR 52-212-2 Evaluation Commercial Items (Jan 1999) does not apply to
this acquisition. Instead, the following will be used for evaluation of
quotes: An award shall be made to that responsible offeror submitting
descriptive literature (i.e., brochures) and offering the lowest
evaluated price for technically acceptable supplies. Technical
acceptability for "equals" will be determined solely on the content and
merit of the descriptive literature submitted in response to this
provision as it compares to the minimum characteristics provided above
for CLIN 0001 and all subline items. Therefore, it is essential that
offerors proposing an "equal" provide sufficient technical literature
in order for the Government evaluation team to determine their product
technically acceptable. Price shall be the deciding factor among
technically acceptable proposals. Due to the interrelationship of
supplies to be provided hereunder, the Government reserves the right to
issue a single order to that offeror quoting a technically acceptable
product at the lowest evaluated price. Therefore, quotes that contain
less than the entire system provided herein may be determined to be
unacceptable. The offeror shall provide information to support the
quoted price (e.g., a copy of the current catalog or established price
list, three invoices for the same equipment, etc.). Before the
specified expiration date of an offer, the Government may accept an
offer (or part of an offer) regardless if there are negotiations after
its receipt, unless a written notice of withdrawal is received prior
to award. The successful offeror may be requested to provide a written
letter of acceptance within five days of order issuance. Each offeror
shall include a completed copy of the provision at FAR 52.212-3,
Offeror Representations and Certifications Commercial Items (Feb 1999)
with its quote. FAR 52.212-4 Contract Terms and Conditions Commercial
Items (Apr 1998) is incorporated by reference and applies to this
acquisition. The following clause applies to this synopsis/solicitation
and any resulting order. Clause 52.212-5 Contract Terms and Conditions
Required to Implement Statutes or Executive Orders Commercial Items
(MAR 1999) (a) The Contractor agrees to comply with the following FAR
clauses, which are incorporated in this contract by reference, to
implement provisions of law or executive orders applicable to
acquisitions of commercial items: (1) 52.222-3, Convict Labor (E.O.
11755); and (2) 52.233-3, Protest after Award (31 U.S.C 3553). (b)
TheContractor agrees to comply with the FAR clauses in this paragraph
(b) which the contracting officer has indicated as being incorporated
in this contract by reference to implement provisions of law or
executive orders applicable to acquisitions of commercial items or
components: (for paragraph (b) only the following clauses apply to this
acquisition): 52.222-21 Prohibition of Segregated Facilities (Feb
1999), 52.222-26 Equal Opportunity (E.O. 11246), 52.222-35 Affirmative
Action for Disabled Veterans and Veterans of the Vietnam Era (38
U.S.C. 4212), 52.222-36 Affirmative Action for Workers with
Disabilities (29 U.S.C. 793), 52.222-37 Employment Reports on Disabled
Veterans and Veterans of the Vietnam Era (38 U.S.C. 4212), and
52.247-64 Preference for Privately Owned U.S.-Flag Commercial Vessels
(46 U.S.C. 1241). Paragraphs (c) and (d) of FAR 52.212-5 do not apply
to this acquisition. Paragraph (e) of FAR 52.212-5 applies to this
acquisition, and is stated as follows: (e) Notwithstanding the
requirements of the clauses in paragraphs (a), (b), (c) or (d) of this
clause, the Contractor is not required to include any FAR clause,
other than those listed below (and as may be required by an addenda to
this paragraph to establish the reasonableness of prices under Part
15), in a subcontract for commercial items or commercial components --
(1) 52.222-26, Equal Opportunity (E.O. 11246); (2) 52.222-35,
Affirmative Action for Disabled Veterans and Veterans of the Vietnam
Era (38 U.S.C. 4212); (3) 52.222-36, Affirmative Action for Workers
with Disabilities (29 U.S.C. 793); and (4) 52.247-64, Preference for
Privately-Owned U.S. Flag Commercial Vessels (46 U.S.C. 1241) (flow
down not required for subcontracts awarded beginning May 1, 1996).
DFARS clause 252.212-7001 Contract Terms and Conditions Required to
Implement Statutes or Executive Orders Applicable to Defense
Acquisitions of Commercial Items (Jan 1999) is incorporated by
reference. However, for paragraph (b) only the following DFARS clauses
apply: 252.225-7001 Buy American Act and Balance of Payments Program
(41 U.S.C. 10a-10d, E.O. 10582), 252.227-7015 Technical Data Commercial
Items (10 U.S.C. 2320), 252.227-7037 Validation of Restrictive Markings
on Technical Data (10 U.S.C. 2321), and 252.247-7024 Notification of
Transportation of Supplies by Sea (10 U.S.C. 2631). This acquisition
shall be processed in accordance with Simplified Acquisition Procedures
