NOTICE OF SOLE SOURCE PROCUREMENT FOR LTM/LTO SERVICES, MI The purpose of this notice is to inform all parties that the United States Army Corps of Engineers, Omaha District proposes to award a Firm Fixed-Price Sole Source, Site Specific Type Contract, to Whitewater Associates, a woman-owned small business concern located in Amasa, Michigan, a Hubzone locale. The work will be performed at K.I. Sawyer AFB, MICHIGAN, AFB, as authorized by Public Law 103-160, Title XXIX, Subtitle A, Defense Base Closures and Realignments Act for a one-year period with four option years. The work effort includes base-wide groundwater treatment, maintenance of the landfill cap, annual review of the TCE extraction system, and operation & maintenance of the TCE extraction system. Sole Source authority FAR Subpart 6.302-1 will satify the agency requirements. Other authorities and basis for the sole source determination are: 1. Public Law 101-510, Section 2912, Preference for local and small businesses which states, "the Secretary of Defense shall give preference, to the greatest extent practicable, to qualified businesses located in the vicinity of the installation and to small business concerns and small disadvantaged business concerns. 2. Section 7106 of Public Law 103-355 which established a government-wide goal WOSB concerns at not less than 5% of the total value of all prime contract. Although DOD has neither the legislative authority to restrict competition to WOSB concerns, nor the authority to make award WOSB concerns at other than fair-market price, this initiative exemplify DOD's, USACE's, and Omaha District's thrust to improve the participation of women owned small business (WOSB) in their acquisitions programs. 3. Agency Regulation ER 1110-1-263, Chemical Data Quality Management for Hazardous, Toxic, Radioactive Waste Remedial Activities which specify validation of Commercial laboratories for HTRW Analyses. 4. Whitewater Associates is a woman-owned small business concern located in the vicinity of the BRAC installation, an Agency's validated commercial laboratory, presently performing the required services as a subcontractor.
