synopsis/solicitation for commercial items prepared in accordance with
the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as
supplemented with additional information included in this notice. This
announcement constitutes the only solicitation; offers are being
requested and a written solicitation will not be issued. (II) This
solicitation document is issued as Request for Quotation (RFQ)
230-0031-9. (III) This solicitation document and incorporated
provisions and clauses are those in effect through Federal Acquisition
Circular 97-11. (IV) This solicitation is 100% Small Business
Set-Aside. The SIC is 5065 with a size standard of 500 employees and
the NAICS United States is 42169. (V) The items called for by this RFQ
have been identified by a brand name. Offers for an equal product
(including a product of the brand name manufacturer other than the one
described) will be considered for award per Justice Acquisition

existing annunciator system. (VI) The successful offeror shall provide
delivery of all items with 30 days of date of award. (VII) Delivery
hours are 8:00 a.m. to 10:30 a.m. and 11:00 a.m. to 3:00 p.m., local
time, Monday through Friday, excluding Government holidays. Delivery
will be made to the Federal Correctional Institution, 27072 Ballston
Road, Sheridan, Oregon 97378; Phone (503) 843-4442 ext. 144. (VIII) FAR
provision 52.212-1, "Instructions to Offerors -- Commercial Items," is
hereby incorporated by reference. The following are addenda to FAR
Clause 52.212-1: (A) Evaluation Factors for Award: Award will be made
to the responsible offeror whose quote is responsive to the terms of
the RFQ and is the lowest priced technically acceptable offer. (B) The
following provision is hereby incorporated into this solicitation and
resulting contract as an addendum to FAR Clause 52.212-1, pursuant to
FAR Provision 52.252-1, "Solicitation Provisions Incorporated by
Reference": 52.215-18, "Facsimile Proposals" (503) 843-7623. (IX) FAR
provision 52.212-3, "Offerors Representations and Certifications --
Commercial Items," shall be completed and submitted with the offer. (X)
FAR clause 52.212-4, "Contract Terms and Conditions -- Commercial
Items," is hereby incorporated by reference. The following FAR Clauses
are hereby incorporated by reference, pursuant to FAR Clause 52.252-
2, "Clauses Incorporated by Reference": 52.219-6, Notice of Small
Business Set-Aside. The following JAR clauses are hereby incorporated
by addenda: (A) 2852.211-70 Brand-Name or Equal (a) The terms "bid" and
"bidders", as used in this clause, include the terms "proposal" and
"offerors". The terms "invitation for bids" and "invitational", as used
in their clause include the terms "request for proposal" and "request."
(b) If items called for by this invitation for bids have been
identified in the schedule by a "brand name or equal" description, such
identification is intended to be descriptive but not restrictive, and
is to indicate the quality and characteristics of products that will be
satisfactory. Bids offering "equal" products (including products of a
brand name manufacturer other than the one described by brand name)
will be considered for award if such products are clearly identified in
the bids and are determined by the Government to meet fully the salient
characteristics and requirements listed in the invitation. (c) Unless
the bidder clearly indicates in his/her bid that he/she is offering an
"equal" product, his/her bid shall be considered as offering the brand
name product referenced in the invitation for bids. (d)(1) If the
bidder proposes to furnish an "equal" product, the brand name, if any,
of the product to be furnished shall be inserted in the space provided
in the invitation for bids, or such product shall be otherwise clearly
identified in the bid. The evaluation of bids and the determinations
to equality of the product offered shall be the responsibility of the
Government and will be based on information furnished by the bidder or
identified in his/her bid as well as other information reasonably
available to the purchasing activity. To ensure the sufficient
information is available, the bidder must furnish as a part of his/her
bid all description material (such as cuts, illustrations, drawings,
or other information) necessary for the purchasing activity to: (i)
determine whether the product offered meets the salient characteristics
requirements of the invitation for bids, and (ii) established exactly
what the bidder proposed to furnish and what the Government would be
binding itself to purchase by making an award. The information
furnished may include specific references to information previously
furnished or information otherwise available to the purchasing
activity. (2) If the bidder proposes to modify a product so as to make
it conform to the requirements of the invitation for bids, he/she
shall: (i) include in his/her bid a clear description of such proposed
modification, and (ii) clearly mark any description material to show
the proposed modifications. (3) Modifications proposed after the bid
opening to make a product conform to a brand name product referenced in
the invitation for bids will not be considered. (B) YEAR 2000 WARRANTY,
The Contractor represents that the following warranty applies to
products provided under this contract/order/BPA: The Contractor
warrants that the products provided under this contract/order/BPA shall
be able to accurately process date/time data (including, but not
limited to, calculating, comparing, and sequencing) from, into, and
between the twentieth and twenty-first centuries, and the years 1999
and 2000 and leap year calculations. The duration of this warranty and
the remedies available to the Government for breach of this warranty
shall be as defined in, and subject to, the terms and limitations of
the manufacturer's standard commercial warranty or warranties contained
in this contract or the applicable End User License Agreement, provided
that notwithstanding any provision to the contrary in such commercial
warranty or warranties, the remedies available to the Government under
this warranty shall include an obligation by the Contractor to repair
or replace any such product whose non-compliance is discovered and
made known to the contractor in writing at any time prior to June 1,
2000 or for a period of six months following acceptance, whichever is
the later date. Nothing in this warranty shall be construed to limit
any rights or remedies that the Government may otherwise have under
this contract. This warranty shall not apply to products that do not
require the processing of date/time data in order to function as
specified in this contract/order/BPA. (XI) FAR clause 52.212-5,
Contract Terms and Conditions Required to Implement Statutes or
Executive Orders -- Commercial Items is hereby incorporated by
reference. In accordance with FAR clause 52.212- 5, the following
clauses are hereby incorporated by reference in paragraph (b):
