This announcement is published as a Total Small Business Set-Aside action per FAR 52.219-1 and 52.219-6 (this means you must be a small business, quoting the product of a small-business manufacturer); all eligible, responsible sources may submit an offer. The solicitation for commercial items will be prepared in accordance with FAR 13 and the format in FAR subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the ONLY solicitation; quotes are being requested and A SEPARATE WRITTEN SOLICITATION WILL NOT BE ISSUED. Solicitation number / RFQ N00244-99-T-0687 applies. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-11 and Defense Acquisition Circular 91-13. The standard industrial code is 8071 and the business size standard is $5 million. The agency need is for a fixed priced contract for drug and alcohol testing for Navy Public Works in San Diego CA. The statement of work (SOW) for this service follows: Provide controlled substances and alcohol testing, and related record-keeping, reporting, information, training, referral and other administrative services, meeting the requirements of Code of Federal Regulation (CFR), title 49, Part 382 (1997), as amended, for approximately 180 commercial driver licensed (CDL) employees of the Navy Public Works Center, San Diego (NPWC). As necessary part of the performance of these services, the contractor shall develop, implement, and maintain on behalf of the NPWC, a comprehensive controlled substances and alcohol use and testing program, which when followed shall ensure that NPWC shall be in full compliance at all times with all requirements of 49 CFR Part 382 and the regulations cited therein. All data, information, documentation, programs and reports developed or produced under this SOW shall be the property of the NPWC and delivered promptly to the Government at its request. The services to be provided by the contractor under this scope of work include, but are not limited to, the following: a. Provide all materials, specimen collection, shipping, Department of Health and Human Services (DHHS) lab analysis, Medical Review Officer (MRO), administrative services, reporting and testing. Testing program shall include performance of all of the following tests and all related requirements: 1) pre-employment 2) post accident, when the driver is cited resulting from the accident 3) reasonable cause 4) random selection 5) return to duty 6) follow-up b. Provide the administrative and management of data of the CDL controlled substances and alcohol use and testing program and relevant reports to the NPWC and to other government agencies as required by the Contracting Officer's representative. c. Provide notification and scheduling of specimen collection and testing. Specimen collection services for testing shall normally be performed at Government -- designated location (s) within the premises of NPWC, 32nd Street, Naval Station San Diego (NAVSTA Subject to the prior approval of the Contracting Officer's representative, where it is not feasible or practicable to perform specimen collection services at NAVSTA (e.g., where sample collection is necessary to perform post-accident testing following a non-local accident), specimen collection services may be performed at the nearest, convenience and suitable location. In determining the feasibility or practicability of performing specimen collection services at NAVSTA, the Contracting Officer representative's word/decision shall be final. d. Provide the necessary services of a qualified Substance Abuse Professional (SAP) in case of positive drug test results or alcohol violation rates greater than .04. Services to be provided shall include evaluation, recommendation for treatment (if treatment is required) and recommendation for follow-up testing. e. Provide training and training materials for supervisors in detecting alcohol and substance abuse in the workplace. Provide information for treatment (if treatment is required) and recommendation for follow-up testing. NOTE: The preceding list of services is not intended to be all-inclusive. The contractor shall perform whatever services are necessary to ensure NPWC's compliance with all requirements of 49 CFR Part 382 and the regulations cited therein. It is anticipated that during the term of this contract, the Government may have need for CDL employees by other Navy activities, to participate in a comprehensive controlled substances and alcohol use and testing program meeting the requirements of49 CFR Part 382. If in fact this need materializes, the Government reserves the right to request from the contractor from time to time, a proposal to modify the existing contract to include coverage for these additional Navy activities and their employees. The total amount of this additional charge, if an, shall not exceed the number NPWC employees covered under the original contract (approximately 180) or the original contract dollar value. The additional compensation to be paid the contractor for the performance of these additional services is subject to negotiation and the written bilateral modification to the original contract. Nothing in this paragraph commits the Government to order any additional services from the contractor, even if a need for such services is later determined to exist. The first option is for 99 OCT 01 thru 00 Sep 30, the second option is for 00 OCT 01 thru 01 SEP 30, the third option is for 01 OCT 01 thru 02 SEP 30, and the fourth option is for 02 OCT 01 thru 03 SEP 30. Addendum to FAR 52.212-1, Paragraph (b)(5): Offers shall provide an express warranty which at a minimum shall be the same warranty terms, including offers of extended warranties, offered to the general public. Express warranties shall be included in the contract.
