procurement action DTFR53-99-R-00009 (posted to the CBDNet via the EPS
on May 21, 1999, CBD printed issued date: May 26, 1999; with
subsequent modification 01 posted to the CBDNet via the EPS on June 3,
1999, CBD printed issued date: June 8, 1999) in which the Federal
Railroad Administration (FRA) announced its intention to negotiate on
a sole source basis with Greystone Health Sciences to oversee and
promote the reliability, quality control and caliber of laboratory
services provided under a separate FRA contract for toxicological
analysis of samples obtained from various railroad employees subject to
FRA's mandatory Post-Accident Toxicological Testing Program, as
implemented pursuant to Title 49 Code of Federal Regulations (CFR) Part
219 -- Control of Alcohol and Drug Use; and to provide specialized,
expert advice and assistance to FRA in accomplishing its objectives and
mandates under 49 CFR Part 219 and 49 CFR Part 40 -- Procedures for
Transportation Workplace Drug Testing Programs. The applicable
authority for this announced intention was that under 41 U.S.C. 253
(c)(1) as implemented by FAR 6.302-1, "Only One Responsible Source."
The FRA, having now concluded that other responsible sources exist that
are capable of satisfying the agency's minimum needs, no longer has a
reasonable basis to conclude that the agency's minimum needs can only
be satisfied by unique services available from only one source with
unique capabilities. Therefore, the FRA has determined, at its
discretion, that this acquisition will now be conducted on a full and
open competitive basis. This modification does hereby alert interested
parties that a competitive Request for Proposals (RFP) will be made
available for this contracting action. The RFP alone (currently slated
for issuance on or about July 19, 1999) shall establish and specify
the due date for receipt of proposals (currently anticipated for
closing on or about August 20, 1999). The solicitation will be issued
to all firms requesting a copy of the solicitation in writing. Written
requests or other correspondence may be sent by regular mail to T.
Riddle, Federal Railroad Administration, Office of Acquisition and
Grants Services, 1120 Vermont Ave., N.W., Mail Stop 50, Washington, DC
20590; or by express delivery to the same addressee at 1120 Vermont
Ave., Room 6138, Washington, DC 20005. Request for the solicitation,
sent via facsimile transmission to FAX# 202/493-6171, ATTN: T. Riddle,
SOL# DTFR53-98-R-00009, or sent electronically via e-mail to
tom.riddle@fra.dot.gov, will be honored as a written request. If a
prospective offeror chooses to transmit a request by facsimile or
e-mail, the Government will not be responsible for any failure
attributable to the transmission or receipt of the facsimile or e-mail
request (e.g., garbled, incomplete, illegible, delayed, or
misidentified transmissions, incompatibility between sending/receiving
equipment, misdirected mail, etc). Except as specified herein, all
other informationprovided in the previous announcements of this
contracting action, as referenced above, will remain unchanged and in
full force and effect. Prospective offerors failing to meet any
certification, licensure, and/or technical capability requirements
identified in the solicitation will not be considered for award. This
is an unrestricted competitive procurement. All responsible sources may
submit a proposal which shall be considered by the agency. No other
announcements of this proposed contracting action will be issued.
