This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Solicitation number 53SBNB960123 is being issued as a request for quotation (RFQ) using simplified acquisition procedures. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 97-11. This acquisition falls under Standard Industrial Classification (SIC) Code 5045 and the related size standard is 500 employees; however, this acquisition is unrestricted. The National Institute of Standards and Technology's (NIST's) Electron and Optical Physics Division has a requirement for two (2) Hewlett-Packard (HP) Visualize Computer Workstations. THIS IS A BRAND NAME REQUIREMENT. The hardware must be Hewlett-Packard since it has to be compatible with NIST's existing workstations, the associated Hewlett-Packard HP-UX operating systems, and the associated software applications (e.g. compilers, CAD packages, custom data acquisition software, etc.). No other brand workstation will be able to run the HP-UX operating system and the associated applications. The vendor shall deliver all line items FOB Destination to NIST, Building 301, Shipping and Receiving, Gaithersburg, MD 20899; delivery time shall be consistent with industry standards and will be an evaluated factor for award. The provision at 52.212-1, Instructions to Offerors-Commercial Items, applies to this acquisition. The Government will award a purchase order resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors in descending order of importance shall be used to evaluate offers: 1) Technical capability to meet the Government's technical requirements ( all oferors must bid on the brand names); 2) Warranty period; 3) Past Performance; 4) Delivery Time; and 5) Price. Year 2000 Warranty-Commercial Supply Item applies to this requirement. The Contractor warrants that each hardware, software and firmware product delivered under this contract and listed below shall be able to accurately process date data (including, but not limited to, calculating, comparing and sequencing) from, into, and between the twentieth and twenty-first centuries, including leap year calculations, when used in accordance with the product documentation provided by the contractor, provided that all listed or unlisted products (e.g. hardware, software, firmware) used in combination with such listed products properly exchange date data with it. If the contract requires that specific listed products must perform as a system in accordance with the foregoing warranty, then that warranty shall apply to those listed products as a system. The duration of this warranty and the remedies available to the Government for breach of this warranty shall be as defined in, and subject to, the terms and limitations of the contractor's standard commercial warranty or warranties contained in this contract, provided that notwithstanding any provision to the contrary in such commercial warranty or warranties, the remedies available to the Government under this warranty shall include repair or replacement of any listed product whose non-compliance is discovered and made known to the contractor in writing within ninety (90) days after acceptance. Nothing in this warranty shall be construed to limit any rights or remedies the Government may otherwise have under this contract with respect to defects other than Year 2000 performance; Energy Star applies to this requirement. "The Contractor shall provide microcomputers, including personal computers, monitors, and printers, to meet "EPA Energy Star" requirements for energy efficiency. They shall be equipped with the energy efficient low-power standby feature as defined by the EPA Energy Star computers program. This feature shall be activated when the equipment is shipped and shall be capable of entering and recovering from the low-power state unless the equipment meets Energy Star efficiency levels at all times."
