The Naval Air Systems Command (NAVAIR) has identified a need to update the USN's E-6B aircraft organizational-level technical manuals and the applicable Electronic Technical Manual System (ETMS). In order to satisfy its needs, it is NAVAIR's intention to procure the applicable services and supplies on a sole sources basis with TruLogic, Inc, under Federal Acquisition Regulation (FAR) exception cite -- 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." TruLogic owns all the required proprietary scripts required to update the E-6B ETMS. Therefore, neither the Government nor any other firm have the ability to perform these services to develop and produce updates to the E-6B ETMS without the proprietary data owned by TruLogic. Procurement of the necessary proprietary data to allow for competition would result in expensive redundancy and would not be timely nor cost effective. It is expected that the return on investment for the procurement of thedata rights would not be recouped through a competitive procurement.
