A non-competitive negotiation is proposed with Duff-Norton because the Government only possesses a source control drawing for the Elevation Actuator defining the form, fit and function of the Actuator. The only source qualified, as approved and noted on the source control drawing is Duff-Norton, who has proprietary rights to the design of this actuator. The form, fit and function of the actuator assembly are not defined by any nationally recognized industry standard or specification.
