combined synopsis/solicitation for commercial items prepared in
accordance with the format in Federal Acquisition Regulation Subpart
12.6, as supplemented with additional information included in this
notice. This announcement constitutes the only solicitation; quotations
are being requested and a written solicitation will not be issued. This
is a Request For Quotation (RFQ) issued under number 441-054. This
solicitation document and the incorporated provisions and clauses are
those in effect through Federal Acquisition Circular 97-12. This
solicitation is 100 percent set-aside for small businesses who meet the
small business size standard of no more than 100 employees under
Standard Industrial Classification Code 5087. SCHEDULE: LINE ITEM
NUMBER 1: FM200 Fire Suppression Systems QUANTITY: 3 each STATEMENT OF
WORK/SPECIFICATIONS: The Contractor shall deliver and install three
(3) independent FM200 fire suppression systems at the Metropolitan
Detention Center in Brooklyn, New York. One system will be installed in
each of three (3) rooms approximately measuring as follows: 1) 24' x
18' x 12' 2) 20' x 23' x 12' 3) 28' x 15' x 11'. It shall be the
quoter's responsibility to confirm all measurements at the time of the
organized site visit prior to submitting a quotation to the
Government. Each system shall include the following: one (1) cylinder
containing FM200 agent (also chemically known as heptafluoropropane);
one (1) cylinder strap; one (1) control head; one (1) control panel
with battery back-up; one (1) remote pull station; one (1) abort
switch; and, two (2) smoke detectors/alarms. All unnamed parts and
materials, installation and/or operation manuals, labor, and equipment
needed for installation of the systems shall also be provided by the
Contractor at no additional cost to the Government. The Contractor
shall be responsible for integration and testing of all components into
a working system in each room. All three (3) systems shall be tested by
the Contractor in the presence of the Contracting Officer's Technical
Representative to ensure functionality. Initial technical user training
shall be provided by the Contractor to Government staff designated by
the Government. The training shall encompass all areas of the technical
manual(s) specific to the installed systems. SITE VISIT: An organized
site visit has been scheduled for 1 p.m. on September 8, 1999.
Participants will meet at the Lobby of the Metropolitan Detention
Center, 100 29th Street, Brooklyn, New York, 11232 (corner of 29th
Street & Third Avenue). Participants shall register by 1 p.m. on
September 7, 1999 by faxing a request to Raoul Watson at (718)
832-4260. The request shall include all participants names, name of
company represented, company address, and phone and fax numbers.
Attendees will be required to carry at least one form of picture
identification to the site visit. PROVISIONS/CLAUSES: FAR provision
52.212-1, Instructions to Offerors -- Commercial, is hereby
incorporated by reference. The following are addenda to FAR provision
52.212-1: (1) FAR provision 52.212-1 is changed as follows: Paragraph
(e), Multiple offers, is not applicable to this solicitation. The
Government will accept only singe offers. Paragraph (g), Contract
award, is revised to add the following: The Government will award a
contract resulting from this solicitation to the responsible quoter
whose quotation conforming to the solicitation will be most
advantageous to the Government, considering price and price related
factors only. Paragraph (h), Multiple awards, is revised as follows:
The Government will not make multiple awards as a result of this
solicitation. Paragraphs (d), and (i) are not applicable to this
solicitation. (2) The following FAR provisions are hereby incorporated
as addenda to FAR provision 52.212-1: 52.252-1, Solicitation
Provisions Incorporated by Reference: This solicitation incorporates
one or more solicitation provisions by reference, with the same force
and effect as if they were given in full text. Upon request, the
Contracting Officer will make their full text available. The offeror is
cautioned that the listed provisions may include blocks that must be
completed by the offeror and submitted with its quotation or offer. In
lieu of submitting the full text of those provisions, the offeror may
identify the provision by paragraph identifier and provide the
appropriate information with its quotation or offer. Also, the full
text of a solicitation provision may be accessed electronically at

incorporated by reference: 52.237-1, Site Visit. FAR provision
52.212-3, Offeror Representations and Certifications -- Commercial
Items, shall be completed and submitted with the quotation. ADDITIONAL
CERTIFICATION: The following representation shall also be submitted
with the quotation: Compliance with Veterans Employment Reporting
Requirements. (a) The offeror represents that, if it is subject to the
reporting requirements of 38 U.S.C. 4212(d) (i.e., the VETS-100 report
required by the Federal Acquisition Regulation clause 52.222-37,
Employment Reports on Disabled Veterans and Veterans of the Vietnam
Era), it has [ ], has not [ ] submitted the most recent report required
by 38 U.S.C. 4212(d). (b) An offeror who checks "has not" may not be
awarded a contract until the required reports are filed. (31 U.S.C.
1354) FAR clause 52.212-4, Contract Terms and Conditions -- Commercial
Items, is hereby incorporated by reference. The following clauses are
hereby incorporated as addenda to FAR clause 52.212-4: 52.252-2,
Clauses Incorporated by Reference: This contract incorporates one or
more clauses by reference, with the same force and effect as if they

Destination. The following FAR clause is incorporated: 52.252-6,
Authorized Deviations in Clauses: (a) The use in this solicitation or
contract of any Federal Acquisition Regulation (48 CFR Chapter 1)
clause with an authorized deviation is indicated by the addition of
"(DEVIATION)" after the date of the clause. The following JAR clauses
are incorporated by reference: Contracting Officer's Technical
Representative (COTR) (JAR 2852.201-70); and, Unsafe Conditions Due to
the Presence of Hazardous Material (JAR 2852.223-70). FAR clause
52.212-5, Contract Terms and Conditions Required to Implement Statutes
or Executive Orders -- Commercial Items, is applicable to this
acquisition and hereby incorporates the following FAR clauses by
reference: 52.222-21, Prohibition of Segregated Facilities; 52.222-26,

Balance of Payments Program; and, 52.232-34, Payment by Electronic
Funds Transfer Other than Central Contractor Registration. DEVIATION:
FAR clause 52.222-37, Employment Reports on Disabled Veterans and
Veterans of the Vietnam Era contains a deviation to paragraph (f) of
that clause as follows: (f) Subcontractors. The Contractor shall
include the terms of this clause in every subcontract or purchase order
of $25,000 or more unless exempted by rules, regulations or order of
the Secretary. ADDITIONAL REQUIREMENTS/ TERMS/ CONDITIONS: DELIVERY:
For purposes of this contract, delivery shall be considered complete by
the Government upon the successful test of all three installed systems
and completed technical training. The Contractor shall make complete
delivery as defined above within 25 calendar days from the date of
contract award. Delivery and acceptance will be F.O.B. Destination at
the Metropolitan Detention Center, 100 29th Street, Brooklyn, New York,
11232. WORK HOURS: The installation location will be open to the
Contractor 5 days per week, Monday through Friday (excluding Federal
holidays), between the hours of 7:30 a.m. and 3:30 p.m.. The Contractor
shall provide a minimum of 48 hours notice prior to the requested times
to work at the institution and is subject to the approval of the COTR.
COTR: John Interlandi of the Metropolitan Detention Center, Facilities
Department, 100 29th Street, Brooklyn, New York, 718-832-1039, is
hereby designated to act as Contracting Officer's Technical
Representative (COTR) under this contract. WARRANTY: In addition to
implied warranties as provided for elsewhere in this solicitation, the
quoter shall also provide to the Government at least thesame warranty
terms, including offers of extended warranties, offered to the general
public in customary commercial practice. The warranty period will begin
upon complete delivery as defined herein. The Contractor shall be
capable of providing component replacements and/or repairs within 24
hours from an initial request(s) by the Government for problems covered
under the manufacturer's warranty and without further cost to the
Government, including labor. TECHNICAL SUPPORT: The Contractor shall
provide to the Government an access number to a technical support
engineer who can provide callback assistance within two (2) hours of
the initial request. The Contractor shall also have the capacity to
provide an on-site technical representative within eight (8) hours of
the initial request. The Contractor shall also be capable of providing
component replacements and/or repairs within 24 hours from an initial
request by the Government. YEAR 2000 WARRANTY: The Contractor
represents that the following warranty applies to products provided
under this contract/ order/ BPA: The Contractor warrants that the
products provided under this contract/ order/ BPA shall be able to
accurately process date/time data (including, but not limited to,
calculating, comparing, and sequencing) from, into, and between the
twentieth and twenty-first centuries, and the years 1999 and 2000 and
leap year calculations. The duration of this warranty and the remedies
available to the Government for breach of this warranty shall be as
defined in, and subject to, the terms and limitations of the
manufacturer's standard commercial warranty or warranties contained in
this contract or the applicable End User License Agreement, provided
that notwithstanding any provision to the contrary in such commercial
warranty or warranties, the remedies available to the Government under
this warranty shall include an obligation by the Contractor to repair
or replace any such product whose non-compliance is discovered and
made known to the Contractor in writing at any time prior to June 1,
2000 or for a period of six months following acceptance, whichever is
the later date. Nothing in this warranty shall be construed to limit
any rights or remedies that the Government may otherwise have under
this contract. This warranty shall not apply to products that do not
require the processing of date/time data in order to function as
specified in this contract/order/BPA. SEAT BELTS: Executive Order 13043
and the Department of Justice seat belt policy encourages contractors
and subcontractors to adopt and enforce on-the-job seat belt policies
and programs for their employees when operating company-owned vehicles.
QUOTATIONS: Quotations shall be received at the Federal Prison Camp
Allenwood, Regional Contracting Office, PO Box 1000, Montgomery, PA
17752 by 3:30 p.m. EST, on September 17, 1999. Hand-carried quotations
may be delivered to 1049 Allenwood Camp Lane. Electronic or facsimile
