24 -- TRACTORS SOL RFQ428-031 DUE 091799 POC Tom Dufort, Regional Contract Specialist, 570-547-1641, ext. 539 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. This is a Request For Quotation (RFQ) issued under number 428-031. This solicitation document and the incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-12. This solicitation is 100 percent set-aside for small businesses who meet the small business size standard of no more than 100 employees under Standard Industrial Classification Code 5083. SCHEDULE: LINE ITEM NUMBER 1: John Deere Model F1145, or equal. The following firm salient physical, functional, or performance characteristics of the brand name item that an "equal" item must meet to be acceptable for award include: 72" Front Mower; 3-Cylinder; 28 Horsepower Diesel Engine; Hydrostatic Drive; Four-Wheel Drive; and, Two-Post Roll Guard. In addition, the supplied tractors shall be fully capable upon delivery of receiving and using all of the following attachments in accordance with the specified manufacturer's instructions: 4-Point R.O.P. with Canopy (John Deere Part No. BM18354); 51" Rotary Broom (John Deere Part No. 246); and, 47" Snowthrower, Two-Stage (John Deere). QUANTITY: 2 each LINE ITEM NUMBER 2: Auxiliary Hydraulic Installation Kit QUANTITY: 2 each LINE ITEM NUMBER 3: 4 Post ROPS Conversion Kit with Canopy (Requires 2 Post ROPS) QUANTITY: 2 each PROVISIONS/CLAUSES: FAR provision 52.212-1, Instructions to Offerors -- Commercial, is hereby incorporated by reference. The following are addenda to FAR provision 52.212-1: (1) FAR provision 52.212-1 is changed as follows: Paragraph (e), Multiple offers, is not applicable to this solicitation. The Government will accept only singe offers. Paragraph (g), Contract award, is revised to add the following: The Government will award a contract resulting from this solicitation to the responsible quoter whose quotation conforming to the solicitation will be most advantageous to the Government, considering price and price related factors only. Paragraph (h), Multiple awards, is revised as follows: The Government will not make multiple awards as a result of this solicitation. Paragraph (i) is not applicable to this solicitation. (2) The following FAR provision is hereby incorporated as addenda to FAR provision 52.212-1: 52.252-1, Solicitation Provisions Incorporated by Reference: This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer. ADDITIONAL CERTIFICATION: The following representation shall also be submitted with the quotation: Compliance with Veterans Employment Reporting Requirements. The following FAR clause is incorporated: 52.252-6, Authorized Deviations in Clauses: (a) The use in this solicitation or contract of any Federal Acquisition Regulation (48 CFR Chapter 1) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the date of the clause. The following JAR clause is incorporated by reference: Unsafe Conditions Due to the Presence of Hazardous Material (JAR 2852.223-70). FAR clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items, is applicable to this acquisition and hereby incorporates the following FAR clauses by reference: 52.222-21, Prohibition of Segregated Facilities; 52.222-26, Equal Opportunity; 52.222-35, Affirmative Action for Disabled Veterans and Veterans of the Vietnam Era; 52.222-36, Affirmative Action for Workers with Disabilities; 52.222-37, Employment Reports on Disabled Veterans and Veterans of the Vietnam Era (DEVIATION); 52.225-21, Buy American Act North American Free Trade Agreement Implementation Act Balance of Payments Program, Alternate I; and, 52.232-34, Payment by Electronic Funds Transfer Other than Central Contractor Registration. DEVIATION: FAR clause 52.222-37, Employment Reports on Disabled Veterans and Veterans of the Vietnam Era contains a deviation to paragraph (f) of that clause as follows: (f) Subcontractors. The Contractor shall include the terms of this clause in every subcontract or purchase order of $25,000 or more unless exempted by rules, regulations or order of the Secretary. ADDITIONAL REQUIREMENTS/ TERMS/ CONDITIONS: DELIVERY: Delivery and acceptance shall be F.O.B. Destination at the Central Warehouse, Federal Correctional Complex, 2 miles north of Allenwood, Allenwood, Pennsylvania, 17810. WARRANTY: In addition to implied warranties as provided for elsewhere in this solicitation, the quoter shall also provide to the Government at least the same warranty terms, including offers of extended warranties, offered to the general public in customary commercial practice. The warranty period will begin upon complete delivery and acceptance. YEAR 2000 WARRANTY: The Contractor represents that the following warranty applies to products provided under this contract/ order/ BPA: The Contractor warrants that the products provided under this contract/ order/ BPA shall be able to accurately process date/time data (including, but not limited to, calculating, comparing, and sequencing) from, into, and between the twentieth and twenty-first centuries, and the years 1999 and 2000 and leap year calculations. The duration of this warranty and the remedies available to the Government for breach of this warranty shall be as defined in, and subject to, the terms and limitations of the manufacturer's standard commercial warranty or warranties contained in this contract or the applicable End User License Agreement, provided that notwithstanding any provision to the contrary in such commercial warranty or warranties, the remedies available to the Government under this warranty shall include an obligation by the Contractor to repair or replace any such product whose non-compliance is discovered and made known to the Contractor in writing at any time prior to June 1, 2000 or for a period of six months following acceptance, whichever is the later date. Nothing in this warranty shall be construed to limit any rights or remedies that the Government may otherwise have under this contract. This warranty shall not apply to products that do not require the processing of date/time data in order to function as specified in this contract/order/BPA. QUOTATIONS: Quotations shall be received at the Federal Prison Camp Allenwood, Regional Contracting Office, PO Box 1000, Montgomery, PA 17752 by 3:30 p.m. EST, on September 17, 1999.
