402-3407 NIH intends to negotiate and award on a sole-source basis, a
contract to secure patent prosecution services from Foley and Lardner
in Washington, DC for continued prosecution of activities surrounding
patent applications collectively referred to as Keratinocyte Growth
Factor (KGF). It is in the best interest of the Government to continue
the patent prosecution service for KGF with Foley and Lardner since
they have been performing this service from its inception and have
gained a unique knowledge and understanding of the services to be
performed. Transferring these cases to another firm would result in
significant additional cost and the loss of expertise and continuity.
This action is taken under the authority of 41 U.S.C. 253 (c)(1) (FAR
6.302-1(b). The contract shall be for a one year with two options for
additional years. Firms that wish to dispute the above facts should
contact the above contract specialist, to make a detailed capability
statement documenting their ability to provide this. Information
furnished shall include enough material to perform a proper evaluation.
Respondents will not be notified of the evaluation results. See number
