COMMERCE BUSINESS DAILY ISSUE OF SEPTEMBER 30,1999 PSA#2444NOTICE OF INTENT TO NEGOTIATE A CONTRACT WITH THE COMMONWEALTH OF
PENNSYLVANIA USING OTHER THAN FULL AND OPEN COMPETITION The National
Cemetery Administration (NCA), hereby gives notice of its intent to
negotiate a contract for construction of a roadway at Indiantown Gap
National Cemetery, Annville, PA, with the Commonwealth of Pennsylvania
(hereinafter referred to as "Commonwealth"), using other than full and
open competition. The authority for using other than full and open
competition is 41 U.S.C. 253(c)(2). The Commonwealth's Bureau of
Veterans Affairs is constructing and donating a large memorial to
Pennsylvania Veterans on the grounds of Indiantown Gap National
Cemetery. In agreeing to accept the donated memorial, NCA committed to
funding construction of a cemetery roadway to access the memorial.
This roadway is consistent with the cemetery's master plan and was
planned for future construction in any event. Under its contract with
NCA, the Commonwealth will be responsible for (i) preparing and
submitting contract documents (design and construction) of the roadway,
including their submission to NCA for review and approvals; (ii)
competitively obtaining bids from contractors and (iii) overseeing and
managing construction to ensure timely completion. The Commonwealth
has committed to the Veteran community that the monument will be
dedicated on Veterans Day, November 11, 2000. The Commonwealth is
geared-up and well positioned to include the required roadway work in
the construction project for the memorial itself. For a variety of
cogent reasons, a determination has been made that the most efficient
and effective method to accomplishing construction of the roadway is to
contract with the Commonwealth to construct the roadway as part of the
construction project for the memorial. The justification required by
Federal Acquisition Regulation (FAR) 6.303-1 has been prepared and is
available for public inspection in accordance with FAR 6.305. This is
not a request for competitive proposals. The Government will consider
any proposal received within fifteen (15) calendar days from date of
appearance of this special notice in the printed issue of the Commerce
