J -- MAINTENANCE AGREEMENT FOR TSI AEROSOL INSTRUMENTATION OWNED BY NIOSH NOTICE OF INTENT TO SOLE SOURCE. The National Institute for Occupational Safety and Health (NIOSH) in Morgantown, WV plans to purchase a one year routine maintenance greement from TSI, Incorporated for maintenance of aerosol instrumentation owned by NIOSH. Service agreement would cover TSI model 8130, filter tester; model 8110, filter tester; model 8122, PAPR filter tester; model 8160, automated filter tester and model 3934, particle sizer. The service agreement includes one visitation for calibration and service of equipment in addition to emergency services. A service agreement is essential to maintain the primary testing equipment presently being utilized for testing of particulate filters and respirators under 42 CFR 84. TSI controls copyrights, patent rights, trade secrets, technical data, and proprietary information such as schematic diagrams and calibration data which are essential for troubleshooting and repair of these instruments. The Government intends to negotiate on a sole-source basis with the TSI, Incorporated, St Paul, MN. This notice of intent is not a request for quotations. Organizations may respond within 7 days after publication of this notice and demonstrate that they have the expertise and capabilities necessary to meet the stated requirements.
