IN awarded contract N00164-97-D-0016 to Toxco, Incorporated 08 July
1997. Toxco was awarded the contract under full and open competition
procedures. The contract was for the transportation and dispositioning
of Government-owned, 570 lb lithium thionyl chloride batteries. The
contract was awarded to Toxco to disposition what the Government
thought was the total quantity of 4,569 units. The Government places
delivery orders against the contract as batteries are discharged by the
Government. The contract is still on-going. Under the pricing schedule,
Toxco receives somewhere between $1,470 and $1,656 for each battery
they disposition depending on when the order is placed and the quantity
of a given delivery order. In recent months, the Government has
discovered that the quantity of batteries that must be dispositioned is
4,800 rather than 4,569. The Government intends to modify the existing
contract to increase the maximum quantity from 4,569 to 4,800 under
procedures in FAR 6.302-1. It would not be practical nor cost effective
for the Government to pursue competitive procedures for this quantity
increase due to procurement costs, proposal costs, and required
investment by other potential sources. All responsible sources may
submit an offer which shall be considered by the agency. See numbered
