commercial items prepared in accordance with the format in FAR Subpart
12.6, as supplemented with additional information included in this
notice. In accordance with FAR Part 19.502-2 this procurement is a 100%
small business set aside. The announcement constitutes the only
solicitation; proposals are being requested and a written solicitation
will not be issued. This solicitation will incorporate provisions and
clauses that are in effect through Federal Acquisition Circular 97-14.
The Standard Industrial Classification code is 7372 and the Size
Standard is 18 Million dollars. The contractor shall provide all
necessary labor, materials and equipment required to provide commercial
off the shelf application for a case and matter management and
timekeeping system in accordance with the Statement of Need (SON) that
is available upon request. The requirements listed herein are not all
inclusive and the Statement of Need should be reviewed to definitively
assess the requirement. The required database system shall be currently
accessible through a web interface and shall use ORACLE Version 8.0.5
or 8i as the database engine. It shall be prepared for legal office
management, as is it to be used by United States Coast Guard lawyers
and their staffs. It shall be capable of tracking the following:
Matters, Contacts Events, Events with Matters, Organizations, Conflict
Checking, Descriptive Information About a Given Matter Event date, Due
date and a short narrative and Time against given matters. The
application shall have a timekeeping function. The Contractor using
Section 4, Table 1 of the SON for guidance, will propose required
verification methods in their proposal. The following methods may be
utilized to accomplish verification: An element of verification that
uses established mathematical models or simulations, algorithms,
charts, graphs, circuit diagrams or other scientific principles and
procedures to provide evidence that stated requirements were met. An
element ofverification which generally denotes the actual operation,
adjustment or reconfiguration of items to provide evidence that the
designed functions were accomplished under specific scenarios. The
items may be instrumented and quantitative limits of performance
monitored. An element of verification and inspection consisting of
investigation, without the use of special laboratory appliances or
procedures, of items to determine conformance to those specified
requirements which can be determined by such investigations. An element
of verification and inspection that generally denotes the
determination, by technical means, of the properties or elements of
items, including functional operations, and involves the application of
established scientific principles and procedures. Test samples may
undergo any or all of the tests listed in Section 4, Table 1 of the SON
and verified for compliance with any or all of the requirements of the
system. The contractor may propose alternative test methods,
techniques, or equipment, including the application of statistical
process control, tool control, or cost-effective sampling procedures.
Test samples shall meet all test and verification criteria. The
standard and ad hoc reports will be run against the test data provided
by the government to ensure the reports are working properly. This
requirement shall be verified within the CGSW environment, Exchange
5.5, Office 97, Outlook 97, and Microsoft Internet Explorer 4.0. The
minimum workstation hardware within the CGSW environment is currently
an INTEL Pentium 120 MHz-computer system with 32 megabytes (MB) of
random access memory (RAM). No application software executable code can
be installed on the client workstation. All applicable executable code
must reside on the server. The contractor shall provide training for
the administrators of the database and _train the trainer_ training for
approximately 25 individuals in a classroom environment. The contractor
shall provide all training materials. The following provisions are
incorporatedby reference: 52.212-1, Instructions to Offerors_Commercial
Items, the following instructions are added as an addendum to this
clause: Submit offers in two separate volumes as follows: Volume I,
Technical Proposal_Include all technical information required for
evaluation, excluding any reference to cost/price. Divide the technical
volume into the following areas, Technical Approach Area, Past
Performance, and Qualifications/experience of the trainers proposed.
Demonstrate compliance with all minimum technical requirements (SON,
Part 3). Describe features and any data right restrictions impacting
portability, and the maintenance plan (see SON, Part 3.9.9). Enclose a
copy of the standard maintenance agreement. Include proposed delivery
schedule. Training program -- describe program coverage, length of
course, materials furnished and provide resumes of instructor. Past
performance _ include length of time software has been available
commercially, market volume, extent of usage by customer of comparable
size, describe any corporate programs designed to ensure customer
satisfaction, provide results of customer surveys and provide a minimum
of 3 points of reference for customers of comparable size. Volume II,
Price Proposal_ due to availability of space the description of the
price proposal has been included in the SON, Part 2.4. Offerors that
demonstrate their ability to meet the minimum technical requirement
will be invited to conduct a demonstration of their product to evaluate
validation factors as stated below. Demonstrations will be held at the
U.S. Coast Guard Headquarters facility in Washington, D.C. Maximum
time limitation for the demonstration is four hours. In accordance with
FAR 52.212-2, Evaluation_Commercial Items, the Government will award a
contract resulting from this solicitation to the responsible offeror
whose offer, conforming to the solicitation, will be most advantageous
to the Government, price and other factors considered. The following
factors shall be used to evaluate offers: Technical Approach_(a) system
compatibility; (b) web application, (c) legal orientation, (d) service
life, (portability is considered an _exceeds_ area), Maintenance
Performance Factor (availability and features covered are considered
_exceeds_ areas) Past Performance_(a) design & manufacture of software
applications (b) experience on comparable projects within the past
three (3) years (customer satisfaction, market acceptance in legal
community and effort to ensure customer satisfaction are considered
_exceeds_ areas); Training (qualifications, thoroughness and
flexibility are considered _exceeds_ areas) and Price. These factors
are stated in their descending order of importance, all subfactors are
equal within a given factor. The requirement of FAR 52-212-3, Offeror
Representations and Certifications_Commercial Items and 52-212-4,
Contract Terms and Conditions_Commercial Items and 52.212-5, Contract
Terms and Conditions Required To Implement Statutes or Executive
Orders_ Commercial Items must be submitted with offer. A copy of the
Representations and Certifications is available upon request. The
following FAR Clauses under FAR 52.212-5 paragraph (b) (FAC 97-11) are
applicable to this acquisition: 52.203-6, 52.219-8, 52.222-21,
52.222-26, 52.222-35, 52.222-36, 52.222-37, and 52.232-33.
Additionally, FAR clauses, 52.217-9 (inserts to read _preceding year_
and _5 years_), 52.217-5, and 52.217-7 (insert to read _within the
contract performance period_) are included. NOTICE TO
OFFERORS_SOLICITATION OMBUDSMAN PROGRAM It is the policy of the Coast
Guard to issue solicitations and make contract awards in a fair and
timely manner. To further this policy, the Commandant has created the
position of Solicitation Ombudsman who is empowered to investigate
issues raised by prospective offerors and resolve them, where possible,
without expensive and time-consuming litigation. Potential offerors who
believe that a Coast Guard solicitation is unfair or otherwise
defective should first direct their concerns to the cognizant
contractingofficer. If the contracting officer is unable to satisfy the
concerns, the offeror should then contract the Coast Guard Solicitation
