Contract Specialist for N00178-00-Q-1014, campbelllm@nswc.navy.mil. The
Government intends to purchase on a sole source basis software support
and updates for Matlab proprietary licenses from The MathWorks Inc.,
24 Prime Park Way, Natick, MA 01760-1500. The MathWorks is the
developer, designer and manufacturer of this software and holds
proprietary rights in data in providing support of Matlab software. The
Standard Industrial Classification code is 7371 with a size standard of
$18.0 million. The contract shall be a firm fixed priced contract. The
contract period shall be one year. FOB Destination shall apply. The
following is a combined synopsis/solicitation in accordance with
Simplified Acquisition Procedures and supplemental information included
in this notice. This announcement constitutes the only quotation;
quotations are being requested and a written quotation will not be
issued. The quotation number is N00178-00-Q-1014 and is a Request for
Quotations. The quotation document and incorporated provisions and
clauses are those in effect through Federal Acquisition Circular 97-12.
All interested parties shall indicate their interest and capability
with their fax quote at (540) 653-7088 which shall be considered by
Naval Surface Warfare Center, Dahlgren Division, 17320 Dahlgren Road,
Dahlgren, VA 22448-5100. DESCRIPTION: Product description may be
accessed by request via e-mail at: sd11@nswc.navy.mil. SPECIFICATIONS:
License support shall include: License files for annual licenses,
maintenance and support, automatic updates, new product announcements,
internet-based news and services, and access to free product trials.
The Contractor shall provide software updates as released to the
addresses indicated. Updates shall by Y2K compliant in accordance with
clause YEAR 2000 WARRANTY-INFORMATION TECHNOLOGY clause which follows.
Additions and deletions shall be prorated by dividing the yearly
contract amount by 12 and multiplying by the number of covered months.
The following FAR clauses shall apply: 52.252-2, 52.203-3, 52.211-15,
52.222-20, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37,
52.225-11, 52.232-1, 52.232-8, 52.232-11, 52.232-23, 52.232-25,
52.233-1, 52.233-3, 52.243-1, 52.246-16, 52.247-34, 52.249-1, 52.204-3,
52.211-17, 52.222-22, and 52.222-25. The following DFAR clauses shall
apply: 252.232-7000 and 252.204-7004. The following full text clause
applies: Year 2000 Warranty-Information Technology (Sep 1998) (a) The
Contractor warrants that all information technology (IT) (as defined at
FAR 2.101), whether commercial or noncommercial, delivered under this
contract that will be required to perform date/time processing
involving dates subsequent to December 31, 1999, shall be Year 2000
compliant if properly installed, operated, and maintained in accordance
with the contract specifications and applicable documentation. If the
contract requires that specific deliverables operate together as a
system, this warranty shall apply to those deliverables as a system.
(b) "Year 2000 compliant" (as defined at FAR 39.002) means that the IT
accurately processes date/time data (including, but not limited to,
calculating, comparing, and sequencing) from, into, and between the
twentieth and twenty-first centuries, and the years 1999 and 2000 and
leap year calculations, to the extent that other IT, used in
combination with the IT being delivered, properly exchanges date/time
data with it. The "proper exchange" of date/time data shall be in
accordance with the interface requirements specification(s) of the
contract. (c) For line item deliverables which are commercial items (as
defined at FAR 2.101), and which include commercial IT, the terms and
conditions of the standard commercial warranty covering such commercial
IT shall apply in addition to, and to the extent such terms and
conditions are consistent with, this warranty. Any applicable
commercial warranty shall be incorporated into this contract by
attachment. (d) Notwithstanding any provision to the contrary in other
warranty requirement(s) of this contract, or in the absence of any
such warranty requirement(s), the remedies available to the Government
under this warranty shall include those provided in the Inspection
clause(s) of this contract. Nothing in this warranty shall be construed
to limit any rights or remedies the Government may otherwise have under
this contract. (e) Unless specified elsewhere in the contract, the
Contractor will also deliver to the Government a report summarizing any
Year 2000 compliance testing that was performed, and the results
thereof. (f) This warranty shall expire on 31 January 2001, or one
hundred eighty (180) days after acceptance of the last deliverable IT
item under this contract (including any option exercised hereunder),
whichever is later (end of clause). This procurement is DO priority
rated. Offer is due 03 December 1999 no later than 2:00 p.m. (local
NSWCDD time) to: Naval Surface Warfare Center, Dahlgren Division, 17320
