COMMERCE BUSINESS DAILY ISSUE OF JANUARY 10,2000 PSA#2512GOOD FAITH ANNOUNCEMENT FOLLOW-UP FOR PLASTIC TARGETS On November 15,
1999, the Commerce Business Daily published a "good faith" announcement
from Federal Prison Industries, Inc. (FPI) regarding FPI's desire to
manufacture plastic targets for sale to the Federal government. The
announcement explained that FPI did not consider plastic targets to be
a "new product" as defined in FPI's expansion guidelines. The
announcement also stated that FPI recognized that a reasonable person
may construe plastic targets to be a product separate and distinct from
any other item supplied by FPI. The announcement requested that
interested parties submit comments regarding the production of plastic
targets by FPI. As required by FPI's expansion guidelines, comments
were due within 21 days of the publication of the notice. FPI received
several comments from interested parties regarding the "good faith"
announcement. Based on the information in the comments that were
submitted, it is FPI's determination that plastic targets are to be
considered a "new product" in regards to FPI's expansion guidelines. As
a result, FPI would be required to initiate the public involvement
guidelines process, should it choose to manufacture plastic targets for
sale to the Federal government using its mandatory source. FPI has
decided not to manufacture and sell targets to the Federal government
using its status as a mandatory source of supply. This means that FPI
will not initiate the public involvement guidelines process for plastic
targets. However, FPI does intend to competitively bid on this product
for sale to the Federal government. The December 21, 1998, Commerce
Business Daily included an announcement which stated that FPI's Board
of Directors had granted approval for FPI to competitively bid on
products for which it did not rely on its status as a mandatory source
provider. Under this procedure, FPI would not follow the public
involvement guidelines process established by 18 U.S.C. 4122(b) which
is required for new products FPI offers as a mandatory source. A
separate notice has been prepared and issued regarding FPI's decision
to produce targets on a competitive basis, without the use of mandatory
source. Interested parties have a right to raise questions at any time
with FPI's Board of Directors. Any correspondence should be addressed
