Notice of Intent to Sole Source The National Institute of Standards and Technology's (NIST's) Metallurgy Division intends to purchase, on a sole-source basis under the authority of 13.106-1(b), a High Temperature Differential Scanning Calorimeter Model DSC 404/6/F and additional components from Netzsch Instruments, 37 Industrial Boulevard, Suite D, Paoli, PA 19301. To the Government's knowledge Netzsch Instruments' Calorimeter is the only unit that provides the following specifications: 1. Vacuum capability in the measurement chamber of 0.0001 mbar; 2. Computer programmable vacuum and / or inert gas change; 3. DSC operation (not DTA) from room temperature to 1650 degrees C; 4. Heat capacity measurement accuracy of plus/minus 2.5%; 5. Interchangeable DSC and DTA measurement heads; 6. Reproducible Micrometer adjustment system for measurement head positioning. The Government's Research being conducted requires all of these particular specifications. THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIALITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; A QUOTATION IS BEING REQUESTED FROM Netzsch Instruments AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. This solicitation number 53SBNB060020 is issued as a request for quotation (RFQ) using simplified acquisition procedures. This acquisition falls under Standard Industrial Classification (SIC) Code 3826 and the related size standard is 500 employees; however, this acquisition is unrestricted. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-14. The Contract Line Item Numbers (CLINs), Items, and Quantities are as follows: CLIN 0001, DSC 404/6/F High Temperature Differential Scanning Calorimeter -- Temp. Range 25 to 1650 degrees C, consisting of: Base Unit with motorized hoist, high temperature furnace; range 25 to 1650 degrees C; SC sample carrier; type S sensor; DTA/DSC calibration kit. rt to 1500 degrees; Gas metering system for 3 gasses; Evacuating system with diaphragm pump; TA System Controller; Furnace power supply; Basic software package for DSC 404; Computer 500 MHz Pentium III, 64 MB RAM, 6.4 GB Hard drive, 17" Ultra VGA, CD ROM 32x, 3.5" floppy; Hewlett-Packard DeskJet 895C color printer or equivalent; IEE Interface board, 1 each; CLIN 0002, Interchangeable DTA Measurement Head carrier, type S thermocouple, 1 each; CLIN 0003, Software extension for cp measurement, 1 each; CLIN 0004, Set of cp standards, 1 each; CLIN 0005, Alumina pan, 8 each; CLIN 0006, Alumina pan lid, 8 each; CLIN 0007, Pt/Rh pan with Alumina liner, 2 each; CLIN 0008, Spare Alumina liner, 10 each; CLIN 0009, Thin wall Alumina crucible, 6 each; CLIN 0010, Alumina lids for crucibles, 6 each; CLIN0011, Installation and Training. The vendor shall deliver all the line items FOB Destination to NIST, Building 301, Shipping and Receiving, 100 Bureau Drive, Gaithersburg, MD 20899, no later than 12 weeks after the award of the Contract. The provisions at 52.212-1, Instructions to Offerors-Commercial Items, applies to this acquisition. The clause at 52.212-4, Contract Terms and Conditions-Commercial Items applies to this acquisition. The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition, including subparagraphs (11) 52.222-21, (12) 52.222-26, (13) 52.222-35, (14) 52.222-36, (15) 52.222-37, (21)(i) 52.225-21, (22) 52.232-33, 52.227-19. Year 2000 Warranty-Commercial Supply Item applies to this acquisition. The Contractor warrants that each hardware, software and firmware product delivered under this contract and listed below shall be able to accurately process date data (including, but not limited to, calculating, comparing and sequencing) from, into, and between the twentieth and twenty-first centuries, including leap year calculations, when used in accordance with the product documentation provided by the contractor, provided that all listed or unlisted products (e.g. hardware, software, firmware) used in combination with such listed products properly exchange date data with it. If the contract requires that specific listed products must perform as a system in accordance with the foregoing warranty, then that warranty shall apply to those listed products as a system. The duration of this warranty and the remedies available to the Government for breach of this warranty shall be as defined in, and subject to, the terms and limitations of the contractor's standard commercial warranty or warranties contained in this contract, provided that notwithstanding any provision to the contrary in such commercial warranty or warranties, the remedies available to the Government under this warranty shall include repair or replacement of any listed product whose non-compliance is discovered and made known to the contractor in writing within ninety (90) days after acceptance. Nothing in this warranty shall be construed to limit any rights or remedies the Government may otherwise have under this contract with respect to defects other than Year 2000 performance. Energy Star applies to this requirement. "The Contractor shall provide microcomputers, including personal computers, monitors, and printers, to meet "EPA Energy Star" requirements for energy efficiency. They shall be equipped with the energy efficient low-power standby feature as defined by the EPA Energy Star computers program. This feature shall be activated when the equipment is shipped and shall be capable of entering and recovering from the low-power state unless the equipment meets Energy Star efficiency levels at all times."
