THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTES ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. SOLICITATION NUMBER 53SBNB060023 IS BEING ISSUED AS A REQUEST FOR QUOTATIONS (RFQ) USING SIMPLIFIED ACQUISITION PROCEDURES. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-14. The National Institute of Standards and Technology has a requirement for a DVD Analysis System, the DVD200MG Plus Replica Analyzer. The Contract Line Item Numbers (CLIN), quantities, and unit issues are as follows: CLIN 0001, DVD200MG Plus Replica Analyzer with the following specifications: It shall be stand-alone and shall not require a platform. It shall provide real-time analog, digital, logical and physical measurements as outlined in Version 1.0 of the DVD specification as well as DVD-R specification. It shall provide full replica analysis at maximum bit rate in under 50 minutes per layer. Balanced, non-equalized signal outputs shall provide a qualitative real-time response monitor for DVD process development. It shall provide data-to-clock and data-to-data ("Effect Length") Jitter response at any number of user selected spots across the disc. It shall provide buffered signal outputs of EFM+ and PLL clock that can be interfaced with external measurement devices. It shall have the ability to display the video real-time, while simultaneously displaying the PI Error Rate and Variable Bit Rate. It shall allow for the determination at a glance whether an artifact visible on the video is due to a physical error, or a problem with the Moving Pictures Experts Group (MPEG) II encoding, Qty. 1 each. CLIN 0002, Software: The software of the DVD200MG Plus Replica Analyzer shall have simple multiple reference set auto-calibration, pre-set data printing configurations, user-configurable default data views, and highly configurable testing options and graph configurations, Qty. 1 each. CLIN 0003, Hardware: The hardware to support the DVD200MG Plus Replica Analyzer shall include a 266Mhz processor with 32MB memory, enhanced display adapter, a 19" high-resolution color monitor, a 9 PPM printer, and an enhanced video display board. Qty. 1 each. CLIN 0004, A DVD calibration disc shall be supplied to ensure the specified measurement accuracy for DVD200 MG Plus Replica Analyzer. This shall consist of a disc purchased off the shelf and tested with a calibrated DVD player and test results. CLIN 0005, Warranty shall include the repair or replace all parts at no charge including no charge for labor, Qty. 1 year; and CLIN 0006, Manuals, The contractor shall provide all manuals and the Government has the right to reproduce the manuals for its use as necessary; and CLIN 0007, FOB Destination: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the contract, be responsible for any loss of and/or damage to the goods occurring before receipt of the shipment by the consignee at the delivery point specified in the contract; and pay and bear all charges to the specified point of delivery. The contractor shall deliver all line items FOB Destination, to NIST, Building 301, Shipping and Receiving, Gaithersburg, MD 20899-0001. Required delivery time is 30 days after award. The provisions at 52.212-1, Instructions to Offerors-Commercial Items, applies to this acquisition. All interested offerors shall submit the following: 1) Three (3) copies of a quotation which address CLINs 0001-0007; 2) Technical description and/or product literature; 3) Two (2) copies of the most recent published price list(s); 4) The Contractor shall submit a copy of their software license agreement if it is applicable to this purchase. The Contractor is advised that the license agreement must comport with applicable Federal laws, regulations and otherwise satisfy the Government's needs and 5) A completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items which may be downloaded from http://www.nist.gov/admin/od/contract/repcert.htm. All offers should be sent to the National Institute of Standards and Technology, Acquisition and Assistance Division, Attn: Anita K. Tolliver, Building 301, Room B117, 100 Bureau Drive, Stop 3572, Gaithersburg, MD 20899-3572. The Government will award a purchase order utilizing simplified acquisition procedures to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (I) Technical capability of the items offered to meet the Government requirements including the warranty and (II) Price. The clause at 52.212-4, Contract Terms and Conditions-Commercial Items applies to this acquisition. The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition, including subparagraphs (11) 52.222-21, (12) 52.222-26, (13) 52.222-35, (14) 52.222-36, (15) 52.222-37, (16) 52.225-3, (22) 52.232-33 and Department of Commerce Agency-Level Protest Procedures Level Above the Contracting Officer, which can be downloaded from the NIST Web Page located at http://oamweb.osec.doc.gov/conops/reflib/alp1296.htm. Other clauses that apply to this acquisition are 52.227-19, Commercial Computer Software -- Restricted Rights and the Year 2000 Warranty -- Commercial Supply Items. The contractor warrants that each hardware, software, and firmware product delivered under this contract and listed above shall be able to accurately process date data (including, but not limited to, calculating, comparing, and sequencing) from, into, and between the twentieth and twenty-first centuries, including leap year calculations, when used in accordance with the product documentation provided by the contractor, provided that all listed or unlisted products (e.g. hardware, software, firmware) used in combination with such listed product properly exchange date data with it. If the contract requires that specific listed products must perform as a system in accordance with the foregoing warranty, then that warranty shall apply to those listed products as a system. The duration of this warranty and the remedies available to the Government for breach of this warranty shall be as defined in, and subject to, the terms and limitations of the contractor's standard commercial warranty or warranties contained in this contract, provided that notwithstanding any provision to the contrary in such commercial warranty or warranties, the remedies available to the Government under this warranty shall include repair or replacement of any listed product whose non-compliance is discovered and made known to the contractor in writing within ninety (90) days after acceptance. Nothing in this warranty shall be construed to limit any rights or remedies the Government may otherwise have under this contract with respect to defects other than Year 2000 performance. The Contractor shall provide microcomputers, including personal computers, monitors, and printers, to meet "EPA Energy Star" requirements for energy efficiency. They shall be equipped with the energy efficient low-power standby feature as defined by the EPA Energy Star computers program. This feature shall be activated when the equipment is shipped and shall be capable of entering and recovering from the low-power state unless the equipment meets Energy Star efficiency levels at all times. The applicable Standard Industrial Classification Code is 5045 with a size standard of 100 employees. For information, call the POC identified above.
