"BACKGROUND: Property offered consists of one T-43A aircraft, s/n
71-1406, owned and operated by the United States Air Force. This
aircraft was obtained by the USAF Museum as Department of Defense (US
Air Force)excess property. The T-43A was built by Boeing and is the
USAF version of the 737-200. CLOSING DATE/TIME: 24 March 2000, 1600
Hours All proposals must be received by 1600 hours Eastern Standard
Time on 24 Mar 00. Proposals must be clearly marked on the envelope as
follows: "USAFM00-002, Due: 24 Mar 00 at 1600 hours". Proposals should
be submitted on company letterhead and signed by an representative
authorized to commit funds on behalf of the company. Proposals must be
valid for a six month period commencing on 24 Mar 00. Proposals must
be accompanied by an original completed DLA Form 1822, "End Use
Certificate". (A copy of this certificate and instructions for
completion may be obtained by request from USAFM/MUX or via the
internet at www.drms.dla.mil/newsales/html/bidding_forms.html)
Telephonic (including fax) and telegraphic proposals are not
acceptable. INSPECTION: The Bidder is invited, urged, and cautioned to
inspect the property prior to submitting a bid. Property will be
available for inspection at Davis- Monthan AFB AZ. An appointment is
required, please contact Barbara Young to set an appointment time and
date. PHYSICAL LOCATION: Davis-Monthan AFB AZ CONDITION OF PROPERTY:
All property listed is offered for exchange "as is" and "where is". The
Government makes no warranty, express or implied, as to quantity, kind,
character, quality, weight, size or description of any of the property,
or its fitness for any use or purpose. No request for adjustment in
price or for rescission of the sale will be considered. CONSIDERATION
OF PROPOSALS: The Bidder agrees that his/her proposal will not be
withdrawn within the 6 month period specified and that during such
period his/her proposal will remain firm and irrevocable. The
Government reserves the right to reject any or all proposals, including
proposals under which a Bidder would take unfair advantage of the
Government or other Bidders. The Bidder may be required to and agrees
to provide a deposit of 20% of the total bid upon notification that
his/her proposal has been selected as the winning proposal. DEFAULT:
If, after the award, the Bidder (hereinafter Exchanger) breaches the
contract by failure to establish an escrow account within the time
frame allowed by the Exchange, then the USAFM may send the Exchanger a
15-day written notice of default (calculated from date of mailing) and
upon Exchanger's failure to cure such default within that period the
Exchanger shall lose all right, title and interest which he/she might
otherwise have acquired in and to such property as to which a default
has occurred. The Exchanger agrees that in the event he/she fails to
establish an escrow account as required by the Exchange Agreement, the
USAFM shall be entitled to retain as liquidated damages a sum equal to
20% of the dollar value proposal. EXCHANGE OF PROPERTY: An Exchange
between the USAF Museum and the Exchanger will be drafted. After
receipt of Defense Logistics Agency (DLA) approval, the Exchange will
be processed through HQ Air Force Material Command to HQ United States
Air Force for approval. The Exchange process normally takes
approximately 6-8 weeks after receipt of approval from the DLA. DLA
approval normally takes 2-3 weeks. These time frames may be subject to
change based on current military conditions. Upon receipt of final
approval, a copy of the Exchange will be mailed to the Exchanger for
signature. The Exchange will require the Exchanger to establish an
escrow account in the amount quoted in his/her proposal to be utilized
to purchase items from specific suppliers for the USAF Museum. TITLE:
Title to the property offered in Exchange will pass to the Exchanger
upon receipt a signed Exchange Agreement and of official notification
from an FDIC insured institution that an escrow account in the amount
agreed upon has been established for the purpose of purchasing the
items specified by the Museum. ORAL STATEMENTS AND MODIFICATIONS: Any
oral statement or representation by any representative of the
Government, changing or supplementing this solicitation or any
condition thereof, is unauthorized and shall confer no right upon the
Bidder. Further, no interpretation of any provision of the Exchange,
including applicable performance requirements, shall be binding on the
Government unless furnished or agreed to, in writing, by the
Government. ASSIGNMENTS OF CONTRACTS: Any contract awarded under this
solicitation is subject to the provisions of 41 U.S.C 15 which
generally precludes assignment of such contract. MODIFICATION OR
WITHDRAWAL OF PROPOSALS: Proposals may be modified or withdrawn by
written notice and a proposal also may be withdrawn in person by a
Bidder or his/her authorized representative, provided his/her identity
is made known and he/she signs a receipt for the proposal.
CONSIDERATION OF LATE PROPOSALS, MODIFICATIONS OR WITHDRAWALS:
Proposals andmodifications or withdrawals thereof, must be in the
possession of the USAF Museum prior to 1600 Hours, 24 Mar 00. Any
proposal, modification or withdrawal received after 1600 Hours, 24 Mar
00 will not be considered. AWARD OF EXCHANGE: The Exchange will be
awarded to that responsible Bidder whose proposal conforming to the
solicitation will be most advantageous to the Government, price and
other factors considered. A written award mailed or otherwise
furnished) to the successful Bidder within the time frame for
acceptance provided in the Solicitation shall be deemed to result in a
binding contract without any further action by either party.
