The Department of Energy, Albuquerque Operations Office (DOE/AL) will issue a small business set-aside Request for Proposals (RFP) numbered DE-RP04-00AL66765 for technical assistance to the Carlsbad Area Office(CAO). The contractor shall provide expert technical support in the areas of (A) Safety Oversight, (B) Auditing & Assessments for Certification and Independent Oversight, and (C) Environmental Compliance Oversight to assist the DOE/Carlsbad Area Office (CAO) personnel in ensuring Transuranic (TRU) waste activities at the Waste Isolation Pilot Plant (WIPP) are conducted in a safe, efficient, and compliant manner. (A) Safety Oversight: the primary areas of technical expertise required include radiological controls, nuclear safety, waste management, industrial safety and hygiene [Occupational Safety and Health Administration (OSHA), etc.], mining operations and safety [Mine Safety and Health Administration (MSHA), etc.], and DOE Conduct of Operations. Extensive technical knowledge in these areas is required to assist CAO personnel in the performance of comprehensive oversight to ensure safe and compliant operations at the WIPP site. The contractor support activities include, but are not limited to: technical support, reviews, analyses and evaluations of conceptual designs, operational plans, procedures, and other applicable documents, and assistance with the preparation and revision of technical, management, and planning documents. The experience and knowledge of contractor personnel will also be utilized to provide technical expertise and administrative support in performing surveillances and audits and other applicable assessments, such as Operational Readiness Reviews and Readiness Assessments, primarily at the WIPP site. (B) Auditing & Assessments for Certification and Independent Oversight: contractor shall provide technical assistance necessary to establish and maintain the CAO quality assurance (QA) program including providing the QA (NQA-1 certified) and technical staff necessary to perform audits, surveillances, and observations of the M&O contractor, Sandia National Laboratory, participant TRU-waste sites, and CAO. These activities will be performed against CAO program requirements to ensure QA activities and technical processes associated with TRU waste characterization, packaging, shipping, and storage are performed in compliance with CAO requirements. Associated with these activities: providing qualified lead auditors to plan, prepare, and manage audit activities. The contractor shall prepare audit/surveillance/ observation reports, detect problems, reports problems using Corrective Action Reports (CARs), track CARs to completion, and verify completion of corrective actions. The contractor will also provide CAO with support and expertise to maintain CAO databases associated with QA tracking, trending, and reporting. Additional services include: reviewing program documents and operating procedures of CAO, participant contractors, and TRU-waste sites; procedure and CAO QA Program Document (QAPD) preparation and revision; maintain/manage the QA corrective action tracking and trending process; preclude quality problems and effect quality improvement; provide technical assistance in resolving QA issues and concerns, including formally documented program findings as well as questions from project regulators, other DOE organizations and the public (Environmental Protection Agency, New Mexico Environmental Department, Environmental Evaluation Group, etc.); QA training program development and implementation; and other projects and related activities necessary to support the WIPP quality mission. (C) Environmental Compliance oversight: contractor shall provide technical and regulatory support, reviews, analyses, recommendations, and evaluations to CAO staff in support of the Environmental compliance program. This support will address activities under: WIPP's Resource, Conservation and Recovery Act permit, WIPP's operational waste generating activities, Clean Air Act (CAA), Clean Water Act(CWA), Safe Drinking Water Act (SDWA), National Environmental Policy Act (NEPA), and Toxic Substance Control Act (TSCA). The individuals providing the support shall have a comprehensive knowledge of the RCRA regulations, the WIPP RCRA permit, the underlying application, and the Environmental Protection Agency's SW-846 waste characterization methods and a sufficient knowledge of the WIPP authorization basis to identify how changes to the RCRA permit might impact the WIPP authorization basis, and a comprehensive knowledge of CAA, CWA, SDWA, NEPA and TSCA regulations. This support shall include, but not be limited to: RCRA -- technical support for oversight of activities required by the RCRA permit at the waste generator sites and at WIPP; review of proposed modifications to the RCRA permit; review of proposed interpretations of language in the RCRA permit; expertise in the Atomic Energy Act as related to mixed waste characterization and management; expertise in applying creative solutions to unique RCRA waste management issues Environmental regulatory interpretations; advice and strategy on how to deal with the New Mexico Environment Department on RCRA compliance issues; and recommendations for changes to the RCRA permit to make activities conducted under the permit more efficient and/or less costly, while maintaining protection of human health and the environment. CAA, CWA, SDWA, NEPA and TSCA -- expertise in CAA, CWA, SDWA, NEPA, and TSCA; participation in regulatory compliance audits and assessments; CAA, CWA, SDWA, NEPA, and TSCA regulatory review and advice and strategy on how to deal with the regulating agency on compliance issues; CAA, CWA, SDWA, NEPA, and TSCA regulatory permitting/permit modification activities; coordination of activities for the performance demonstration program (PDP); and environmental information management. The contractor shall produce documentation associated with each activity performed. The contractor shall produce the Annual Site Environmental report and the Biennial Environmental Compliance report.
