combined synopsis/solicitation for commercial items prepared in
accordance with the format of FAR Subpart 12.6, as well as the
supplemental information included in this notice. The Patent and
Trademark Office intends to award a sole source contract in accordance
with FAR 6.301-1 (Only one responsible source and no other supplies or
services will satisfy agency requirements). Information Handling
Services, 15 Inverness Way East, Englewood, Colorado 80112 is the only
known source who can provide the required IEEE Electronic Library
product/service via their own server with IP addressing utilized by the
Patent and Trademark Office. The IEEE Electronic Library
product/service is being procured for a twelve-month period. The
acquisition is to acquire the services of IHS's WEB based to assist the
U.S. Patent and Trademark Office (PTO), Scientific and Technical
Information Center (STIC) in providing non-patent literature to the
patent examining corps as a function of the mission of the STIC. The
service is a WEB based database that covers full text journal
information from 1987 to the present. The patent examining corps has a
need for non-patent literature that is used in research to determine
the patentability of inventions. A part of that research requires the
review of current literature in varied fields of engineering and the
IHS databases provide essential information via conferences, meeting,
transactions and proceeding of the IEEE. Information gleaned from this
database improves in the pendency of the Patent Office. The use of the
databases to be ordered will allow the patent examiners to have access
to non-patent prior art that they need to perform their work. This
requirement is for the IEEE Electronic Library via the Internet using
the contractor's server that has the IP addressing capability via the
Internet, full text Internet access of all IEEE publications,
conference, proceedings via the WEB -- 30 simultaneous users. This
announcement constitutes the RFP and is the only solicitation that will
be issued. This solicitation incorporates all of the applicable
provisions and clauses in effect through FAC 97-15, as if stated in
full text, as well as the terms and conditions of FAR 52.212-1. The
proposal shall also include a completed copy of the provision at
52.212-3 entitled Offerors Representation and Certifications Commercial
Items. The award shall include the clauses cited at FAR 52.212-4
entitled Contract Terms and Conditions -- Commercial Items and 52.212-5
entitled Contract Terms and Conditions Required to Implement Statutes
of Executive Orders -- Commercial Items. The evaluation for award will
be done in accordance with FAR 52.212-2 and the following factors will
be used to evaluate offers: (A) Price, (B) Past Performance and (C)
Technical capability of the items(s) offered to meet the Government
requirement. Technical and Past Performance when combined are
significantly more important than Cost or Price. Past
Performance/Experience shall include a minimum of three (3) references
for contracts for similar products/services, which are no more than
three (3) years old. All references shall include current information,
which will allow for verification of the data provided (contract
number, agency or company name, point of contact, current telephone
number and fax number). Evaluation of Past Performance will be based on
information obtained from the references provided by the Offeror, as
well as any other information the Government may have obtained from
other sources. Proposal shall include pricing for the IEEE Electronic
Library product/service for a 12-month period. The Government will
evaluate offer for award purposes in accordance with the above
criteria. A written notice of award or acceptance of an offer, mailed
or otherwise furnished to the successful Offeror within the time for
acceptance specified in the offer, shall result in a binding contract
without further action by either party. Before the offer's specified
expiration time, the Government may accept an offer (or part of an
offer), whether or not there are negotiations after its receipt, unless
a written notice of withdrawal is received before award. A firm fixed
price commercial item contract will be awarded. Any offeror(s)
submitting a proposal pursuant to this announcement shall reference
Solicitation Number 52-PAPT-001011. All interested parties shall submit
a proposal for consideration to be delivered to the PATENT AND
TRADEMARK OFFICE, OFFICE OF PROCUREMENT, 2011 CRYSTAL DRIVE, CRYSTAL
PARK 1, SUITE 810, ARLINGTON, VA 22202, ATTENTION: MS. DORA SANDERS, no
later than 3:00 PM (EST) on April 13, 2000. All offers shall include
the Solicitation Number 52-PAPT-001011 on the outside of the package.
