SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH
THE FORMAT IN FAR SUBPART 12.6, AS SUPPLEMENTED WITH ADDITIONAL
INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE
ONLY SOLICITATION; QUOTES ARE BEING REQUESTED AND A WRITTEN
SOLICITATION WILL NOT BE ISSUED. SOLICITATION NUMBER 53SBNB060054 IS
BEING ISSUED AS A REQUEST FOR QUOTATION (RFQ) USING SIMPLIFIED
ACQUISITION PROCEDURES. Incorporated provisions and clauses are those
in effect through Federal Acquisition Circular 97-15. This acquisition
is not aside for small businesses. The SIC code is 3559 and the
related small business standard size is 500 employees. The National
Institute of Standards and Technology's Semiconductor Electronics
Division has a requirement for a complete low temperature micro-probe
system. The Contract Line Item Number (CLIN), quantity, and unit issue
are as follows: CLIN 0001: programmable temperature controller with
control software, one (1) each; CLIN 0002: refrigerator, one (1) each;
CLIN 0003: manipulators with probe tips, four (4) each; CLIN 0004: a
seven port vacuum chamber with one fused-silica window, one (1) each;
CLIN 0005: accessories necessary for nitrogen gas operation from 80
Kelvin to 400 Kelvin, one (1) set; CLIN 0006: accessories necessary for
liquid helium or liquid nitrogen operation from 10 Kelvin to 400
Kelvin, one (1) set; CLIN 0007 the ability to hold samples of at least
1 centimeter by 1 centimeter and appropriate sample mounting kit, one
(1) each; and CLIN 0008: pumps, regulators, and vacuum accessories
necessary for operation, one (1) set. The system should also have the
following capabilities or traits: 1. temperature stability of 50
milliKelvin or better, 2. temperature resolution of 0.01 Kelvin or
better, 3. temperature sensing near the sample mounting surface, 4.
probes with travel of at least 1 inch by 1 inch by 0.25 inch and
positioning accuracy of 50 micrometers or better, 5. temperature
controller should interface to a computer using RS-232C and IEEE-488
communications, 6. system shall take no more than 20 minutes to cool
from 300K to 80K, 7. system shall take no more than 5 minutes to warm
from 80K to 300K, 8. system must be capable of being made light tight,
9. windows must be frost free at all times, 10. system must be
compatible with zoom microscopes, 11. system must be compatible with an
HP4156 semiconductor parameter analyzer, and an HP4284 LCR meter. The
vendor shall deliver all items FOB Destination to NIST, Building 301,
Shipping and Receiving, 100 Bureau Drive, Gaithersburg, MD 20899-0001.
Required delivery time is 8 weeks from date of award. Acceptance by
NIST end users will take place on site immediately after a satisfactory
inspection to show equipment meets all specifications. The provisions
at 52.212-1, Instructions to Offerors-Commercial Items, apply to this
acquisition. The Government will award a purchase order resulting from
this solicitation to the responsible offeror whose offer conforming to
the solicitation will be most advantageous to the Government, price and
other factors considered. The following factors in shall be granted
equal importance in evaluating offers: 1) Technical Capability to Meet
the Government's Needs; 2) Past Performance. Technical and past
performance when combined, are significantly more important than price.
The clause at 52.212-4 Contract Terms and Conditions-Commercial Items
applies to this acquisition. Additionally, the clause at 52.212-5,
Contract Terms and Conditions Required to Implement Statutes or
Executive Orders-Commercial Items, applies to this acquisition,
including subparagraphs (11) 52.222-21, (12) 52.222-26, (13) 52.222-35,
(14) 52.222-36, (15) 52.222-37, (16) 52.225-3, and Department of
Commerce Agency-Level Protest Procedures Level Above the Contracting
Officer, which can be downloaded from the NIST Web Page located at
http://www.nist.gov/admin/od/comtract/agency.htm. Other clauses that
apply to this acquisition are 52.227-19, Commercial Computer Software
-- Restricted Rights and the Year 2000 Warranty -- Commercial Supply
Items. The contractor warrants that each hardware, software, and
firmware product delivered under this contract and listed below shall
be able to accurately process date data (including, but not limited to,
calculating, comparing, and sequencing) from, into, and between the
twentieth and twenty-first centuries, including leap year calculations,
when used in accordance with the product documentation provided by the
contractor, provided that all listed or unlisted products (e.g.
hardware, software, firmware) used in combination with such listed
product properly exchange date data with it. If the contract requires
that specific listed products must perform as a system in accordance
with the foregoing warranty, then that warranty shall apply to those
listed products as a system. The duration of this warranty and the
remedies available to the Government for breach of this warranty shall
be as defined in, and subject to, the terms and limitations of the
contractor's standard commercial warranty or warranties contained in
this contract, provided that notwithstanding any provision to the
contrary in such commercial warranty or warranties, the remedies
available to the Government under this warranty shall include repair or
replacement of any listed product whose non-compliance is discovered
and made known to the contractor in writing within ninety (90) days
after acceptance. Nothing in this warranty shall be construed to limit
any rights or remedies the Government may otherwise have under this
contract with respect to defects other than Year 2000 performance. All
offerors shall submit the following: 1) Three (3) copies of quotation
which addresses all of the CLINs; 2) Technical description and/or
product literature; 3) Description of commercial warranty, as well as
copy of any and all relevant software licensing agreements; 4) Two (2)
copies of most recently published price list(s); 5) A list of three
contracts completed during the past three years for similar equipment
with the following information: name of contracting activity, contract
number, contract type, total contract value, contracting office and
telephone number, and program manager and telephone number; 5)
information, including relevant contact names and telephone numbers, to
confirm that the vendor has sold a minimum of 10 equivalent probe
stations previously; and 7) A completed copy of the provision at
52.212-3, Offeror Representations and Certifications-Commercial Items
which may be downloaded from http://www.arnet.gov/far/loadmain52.html.
