This is a sole source, combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, and the test program outlined in FAR 13.6 as well as supplemental information provided herein. This non-competitive action will be processed in accordance with FAR 6.301-1 (Only one responsible source and no other supplies or services will satisfy agency requirements). The PTO plans to award a sole source procurement to Dataware Technologies of Bethesda, MD. This effort will include annual subscription to Dataware Premier Maintenance Support, as well as engineering and development services for enhancements to BRS Software Products utilized at the USPTO. Dataware is the developer and only source who can provide BRS and NetAnswer, a suite of classification and search software, which are critical systems currently in operation at USPTO. A previous contractual arrangement was awarded to Dataware for a site license for PTO's unlimited use of BRS and NetAnswer products. The maintenance support to be procured from Dataware will consist of a twelve month agreement to provide specialized support, technical account manager, reports, user group meetings, escalation and expediting of problems in support of PTO's unique searching and classification issues. The engineering and development services will provide the PTO with approximately 450 days of support for specific enhancements that are urgently required to the BRS software. These enhancements are PTO specific issues that are required immediately and can only be performed by the developer and owner of BRS proprietary source code. This announcement constitutes the RFP and is the only solicitation that will be issued. A sole source proposal is being requested pursuant to this announcement. This solicitation incorporates all of the applicable provisions and clauses in effect through FAC 97-16, as if stated in full text, as well as the terms and conditions of FAR 52.212-1. A firm fixed priced commercial items contract (or contract modification) will be issued.
