USC 8287 notice is hereby given that Florida Power and Light (FPL) has
submitted to NASA/KSC an unsolicited proposal for design and
construction of a demand side management project which will increase
the emergency power generation capacity at LC-39 and the Industrial
area of KSC. Because FPL is the only responsible source, under FAR
6.302, that can perform this demand side management project, this
notice of intent is not a request for competitive proposals. However,
all proposals received within fifteen days after the date of
publication of this notice will be considered by the Government. A
determination by the Government not to compete this proposed contract
based upon responses is solely within the discretion of the Government.
Information received will normally be considered solely for the purpose
of determining whether to conduct a competitive procurement. The
following facts warrant the need to pursue this action on a sole source
basis: Florida Power and Light (FPL) is a public utility within the
meaning of section 366.02(1) of the Florida Statutes, and is the
exclusive provider of electric utility service for Kennedy Space Center
(KSC). The emergency generation capability to be acquired by KSC will
be interconnected with FPL's power generation dispatch system so that
FPL can remotely engage and operate KSC's emergency power generation
capability during periods of peak electrical demand. This will in turn
allow KSC to participate in FPL's Demand Side Management Incentive
program and qualify for lower electricity tariffs under the Commercial
Industrial Load Control (CILC) program. To be interconnected to FPL's
power generation dispatch system, KSC's generators must be technically
and operationally compatible with FPL's system so that electricity
generated by KSC during periods of peak demand is brought on line
seamlessly and operated continuously in parallel with FPL's entire
generation grid. While in parallel operation, KSC's generation system
essentially will function as one of FPL'spower generation plants.
Therefore, any technical or operational failure of KSC's power
generation plant can result in interruption of the entire power grid.
For this reason, the Florida Public Service Commission requires that a
CILC participant such as KSC execute an Interconnection Agreement
which gives FPL complete control over the design and construction of
the participant's interconnection facilities. Through a high degree of
control over the design and construction of the interconnection
facilities, FPL can ensure that the interconnection facilities will
support continuous parallel operation without interruption to the
entire power grid. Because FPL is the exclusive provider of electrical
utility service to KSC and is the only source of a demand side
management program that will entitle KSC to participate in the CILC,
and because FPL is required by the Florida Public Services Commission
to be in complete control of the interconnection facilities to be
acquired by KSC (for both FPL facilities and KSC facilities)
acquisition of these facilities from FPL is justified under FAR
6.302-1(b)(3), "Only One Responsible Source" (utility systems). The
Government does not intend to acquire a commercial item using FAR Part
12. See Note 26. Interested organizations may submit their
capabilities and qualifications to perform the effort in writing to the
identified point of contact not later than 4:30 p.m. local time on May
27, 2000. Such capabilities/qualifications will be evaluated solely
for the purpose of determining whether or not to conduct this
procurement on a competitive basis. A determination by the Government
not to compete this proposed effort on a full and open competition
basis, based upon responses to this notice is solely within the
discretion of the government. An Ombudsman has been appointed. See
Internet Note "B". All qualified responsible sources may submit an
