commercial items prepared in accordance with the format in Subpart
12.6; as supplemented with additional information included in this
notice. This announcement constitutes the only solicitation; proposals
are being requested and a written solicitation will not be issued.
This solicitation is being issued as a Request for Quotation (RFQ) and
is being conducted under the Simplified Acquisition Procedures (FAR
Part 13). The solicitation reference number is RFQ 528-06-00 and
incorporated provisions and clauses are those in effect through Federal
Acquisition Circular (FAC) 97-17, dated 4/26/00. This solicitation is
set aside for small business, if two small businesses do not respond,
solicitation will be full and open; the associated Standard Industrial
Classification (SIC) code is 8099 (Size: 5 Million). The VA Healthcare
Network Upstate NY (VAHNUNY) (VISN 2) intends to contract for a
Licensed Dermatologist, with work being performed at the VA Medical
Center in Buffalo known as Western New York Healthcare System.
Estimated Hours of this contract will be for a minimum of 120 hours and
a maximum 240 hours during the course of the contract (regular workday
Monday Friday 8:00 AM 4:30 PM) Minimum 2 Dermatology Clinic Sessions
per week up to a maximum of four (4) sessions per week (minimum of four
(4) hours per session). Contract period will be from Contract award
through September 30, 2000 and 4 quarter option periods (a quarter
option period consists of 3 months each). Option Quarters will be at
the discretion of the WNYHS (Western New York Healthcare System). Rates
submitted are to be hourly for regular workday. Rates for option term
is required. Rates shall be all inclusive. Additional charges for
travel, transport, lodging, meals, etc. will not be paid by VA.
Dermatologist shall be Board Certified. Contractor may be required to
provide upon request of the VA: A current copy of Job Description, a
current, completed Competency Assessment Checklist, A current
performance evaluation, and a listing of relevant continuing education
for the last two years for each Contractor employee who is proposed to
provide services under a contract resulting from this solicitation.
Anticipated date of award is June 15, 2000. Duties: Perform all duties
and responsibilities of a staff Dermatologist. Duties include, but not
limited to, Outpatient consultative and, in appropriate circumstances
requiring longitudinal co-management, continuing care of patients with
Dermotologic disorders. No primary care will be offered. These
services shall be provided in the outpatient setting in at least two
(2) regularly scheduled clinics per week. Exceptions include closure of
the Outpatient Clinic for official holidays. The Outpatient services
provided will be according to current VAMC guidelines for waiting time
in clinic and timeliness of availability of visit for new patients.
Currently these services shall be provided as follows: Patients shall
be seen within fifteen (15) minutes of scheduled appointment.
Dermatology Staff shall: 1) Establish, with the clinic staff, the
clinic profile for scheduling new and follow up patients. 2) Become
familiar with the VAMC formulary and use of the computer system as
needed for efficient practice. 3) Communicate results of consultations
and tests to appropriate providers in inpatient and outpatient
settings. All services shall be performed at the Buffalo VA Medical
Center, Buffalo, NY, using government owned space and equipment. The
individual's primary clinical experience shall be with the adult
population. Must be clinically competent to perform examinations,
diagnosis, render therapeutic treatment, be effective in handling
emergencies, patient management and document in patient records.
Patient record documentation shall be completed within 8 hours after
performance of each procedure. Consultation coverage shall be provided
in addition to the Dermatology Clinic coverage. Consultation and
Dermatology Clinic services shall be rendered in accordance with hourly
rate quoted. All procedures performed by the Contractor shall include
provisions for urgent cases to be handled with first priority. Must be
effective in teaching patient/family education and co-workers. Provide
oversight and recommendations to the Medical VA Care Line Manager on
Dermatological programs and procedures for treatment planning and
follow-up of veteran beneficiaries receiving care. Provide oversight
and assistance to VA and other clinical personnel on Dermatology
support functions necessary for patient therapeutic care. Provide
assistance and advice to VA Program Personnel for developing new
techniques in patient related Dermatology programs. Must be effective
in planning, using administrative judgment and should have sound
decision making skills. Individual will follow and meet all Western New
York Healthcare System policies, rules and regulations. The individual
must pass the Medical Center credentialing process, including no
adverse actions noted on the National Practitioner Data Bank.
Individual will be required to utilize the electronic medical record
and other computer programs available to staff at this Western New York
Healthcare System. Individual will participate in organizational
meetings as requested. Actual times of clinic sessions will be the same
each week as mutually agreed upon by the Contractor and Medical VA Care
Line Manager. Requirement may increase as patient load determines.
There will be a maximum of 4 clinics a week and a maximum of 8 hours a
day with an unpaid lunch break. Interested parties shall submit
information identifying clear and convincing documentation (including
pricing) that they can meet the salient characteristics. Contractor
must supply a separate Price, Technical, and Past Performance
Information for evaluation purposes. A copy of the Dermatologists
License, awards and pertinent data, that will perform the service, is
to be included with the Technical Information. No solicitation document
is available. The evaluation will be based on price, technical
qualifications and past performance in declining order. Offerors shall
include a completed copy of the provision at FAR 52.212-3, Offeror
Representations and Certifications- Commercial Items. The clauses at
FAR 52.212-4, Contract Terms and Conditions- will apply. Addendum to
FAR 52.212-4 SPECIAL CONTRACT REQUIREMENTS Under the authority of
Public Law 104-262 and 38 USC 8153, the contractor agrees to provide
Health Care Resources in accordance with the terms and conditions
stated herein, to furnish to and at the Department of Veterans Affairs
Western New York Healthcare System, the services and prices specified
in the Section entitled Schedule of Supplies/Services of this
contract. 1. SERVICES: a. The services specified in the Sections
entitled Schedule of Supplies/Services and Special Contract
Requirements may be changed by written modification to this contract.
The modification will be prepared by the VA Contracting Officer and,
prior to becoming effective, shall be approved by the VA Under
Secretary for Health or his/her designee. b. Other necessary personnel
for the operation of the services contracted for at the VA will be
provided by the VA at levels mutually agreed upon which are compatible
with the safety of the patient and personnel and with quality medical
care programming. c. The services to be performed by the contractor
will be performed in accordance with VA policies and procedures and the
regulations of the medical staff by laws of the VA facility. d. The
services to be performed by the contractor will be under the direction
of the VA Western New York Healthcare System Chief of Staff. 2. TERM
OF CONTRACT: This contract is effective from date of award through June
30, 2000. The contract is subject to the availability of VA funds. No
service shall be performed by the contractor after September 30, each
year until the contracting officer authorizes such services in writing.
3. QUALIFICATIONS: Personnel assigned by the Contractor to perform the
services covered by this contract shall be licensed in a State,
Territory, or Commonwealth of the United States or the District of
Columbia. All licenses held by the personnel working on this contract
shall be full and unrestricted licenses. The qualifications of such
personnel shall also be subject to review by the Physician Executive
and approval by the VA Facility Director. Each person assigned to work
under this contract shall be licensed by the appropriate board
governing their field of practice. 4. WORK HOURS: a. The services
covered by this contract shall be furnished by the contractor as
defined herein. The contractor will not be required, except in case of
emergency, to furnish such services during off-duty hours as described
below. b. The following terms have the following meanings: (1)Work
hours: Monday through Friday, 8:00 a.m. -- 4:30 p.m. (2)National
Holidays: The 10 holidays observed by the Federal Government are: New
Years Day Martin Luther Kings Birthday Presidents Day Memorial Day
Independence Day Labor Day Columbus Day Veterans Day Thanksgiving
Christmas and any other day specifically declared by the President of
the United States to be a national holiday. 5. PERSONNEL POLICY: The
contractor shall be responsible for protecting the personnel furnishing
services under this contract. To carry out this responsibility, the
contractor shall provide the following for these personnel: -- workers
compensation -- professional liability insurance -- health
examinations -- income tax withholding, and -- social security
payments. The parties agree that the contractor, its employees, agents
and subcontractors shall not be considered VA employees for any
purpose. 6. RECORD KEEPING: The VA operated facility shall establish
and maintain a record keeping system that will record the hours worked
by the contractor's employee(s). Contractor's employee(s) shall report
to the service Administrative Officer, or designee upon arrival at the
VA operated facility. 7. CONTRACT PERFORMANCE MONITORING: Monitoring
of contractors time shall be demonstrated through sign-in/sign-out
sheets. The contractor shall be required to sign an attendance log upon
reporting to work and departing from work. The Contracting Officer's
Technical Representative (COTR), as designated by the Contracting
Officer shall be the VA official responsible for verifying contract
compliance. After contract award, any incidents of contractor
noncompliance as evidenced by the monitoring procedures shall be
forwarded immediately to the Contracting Officer. 8. KEY PERSONNEL AND
TEMPORARY EMERGENCY SUBSTITUTIONS: The Contractor shall assign to this
contract the following key personnel: During the first ninety (90) days
of performance (if options are exercised), the Contractor shall make NO
substitutions of key personnel unless the substitution is necessitated
by illness, death, or termination of employment. The Contractor shall
notify the Contracting Officer, in writing, within 15 calendar days
after the occurrence of any of these events and provide the information
required by paragraph (c) below. After the initial 90-day period of the
contract, the Contractor shall submit the information required by
paragraph (c) to the Contracting Officer at least 15 days prior to
making any permanent substitutions. The Contractor shall provide a
detailed explanation of the circumstances necessitating the proposed
substitutions, complete resumes for the proposed substitutes, and any
additional information requested by the Contracting Officer. Proposed
substitutes shall have comparable qualifications to those of the
persons being replaced. The Contracting Officer will notify the
Contractor within 15 calendar days after receipt of all required
information of the decision on the proposed substitutes. The contract
will be modified to reflect any approved changes of key personnel. For
temporary substitutions where the key person will not be reporting to
work for three (3) consecutive work days or more, the Contractor will
provide a qualified replacement for the key person. This substitute
shall have comparable qualifications to the key person.Any period
exceeding two weeks will require the procedure as stated above. Sums
due the Contractor shall be paid monthly, in arrears, upon receipt of
a properly prepared invoice. The Contractor shall submit invoice to
Chief, Fiscal Service, VA WNY Healthcare System, 3495 Bailey Ave.,
Buffalo, NY 14215. Commercial Items, and FAR 52.212-5, Contract Terms
and Conditions Required to Implement statutes or Executive
orders-Commercial Items, apply to this acquisition. The following FAR
