BIA (605)226-7621 The Oglala Sioux Tribe, Pine Ridge, South Dakota,
has contracted with the Bureau of Indian Affairs to execute the Safety
of Dams program on the Pine Ridge Reservation. Notice is hereby given
that the Oglala Sioux Tribe will receive bids for construction of Kyle
Dam Modifications. Kyle Dam is located immediately north of the town of
Kyle, South Dakota, on the Pine Ridge Indian Reservation. Construction
is estimated between $1.5 million and $3.5 million and will consist of
the following: A new 130-foot wide (crest length) spillway and stilling
basin to be constructed of RCC (roller compacted concrete); Replacement
of the existing outlet works and control structure; Raising the dam
embankment approximately 5-feet; A filter trench and toe drain system
to be constructed at the toe of the dam; Correction and repair of other
deficiencies at the site; and all other miscellaneous work required,
not herein mentioned, but inferred from the construction contract
elements. Bids shall be prepared, mailed and delivered in a sealed
envelope to the Oglala Sioux Tribe, Safety of Dams Office, not later
than 2:00 P.M. MDT (local time-our clock) on Thursday, JULY 20, 2000,
at which time all bids will be read aloud publicly and in the presence
of the bidders and their representatives. The bids will be opened at
the Safety of Dams Office located in the Public Safety Building on Main
Street in Pine Ridge, SD. Bids will not be accepted after the specified
hour and date and will be returned to the Bidder(s) unopened. Bids
which are not prepared and filed in accordance with the Instruction to
Bidders may be rejected. A pre-bid meeting will be held at the Lakota
Trade Center, Main St., Kyle, SD on Thursday, JULY 6, 2000 at 10:00
A.M. MDT, and will include a tour of the project. All potential bidders
are strongly encouraged to attend this meeting. Drawings,
specifications and contract documents may be examined at the offices of
Banner Associates, Inc. in Rapid City, SD, (605) 343-0222, or the
Oglala Sioux Tribe Safety of Dams Office in Pine Ridge, SD, (605)
867-5571. A complete set of Drawings, Specifications, and Contract
Documents may be obtained at the office of Banner Associates, Inc. 1641
Deadwood Avenue, P.O. Box 1140, Rapid City, SD 57709. Copies may be
obtained upon non-refundable payment in the sum of $75.00 for each set
of Contract Documents (with -size drawings) and $90.00 for each set of
Contract Documents (with full-size drawings). The Bidder to whom the
contract is awarded will be required to furnish a construction
performance bond and a construction payment bond to the Oglala Sioux
Tribe in the amount of one hundred percent (100%) of the contract award
for each bond. All bids must be accompanied by a bid guarantee in the
form of a bid bond or a cashier's or certified check made payable to
Oglala Sioux Tribe in the amount of five percent (5%) of the Bidder's
maximum bid price. Preference will be given to organizations that
qualify under the "Buy Indian Act" (25 USC 47) as an Indian economic
enterprise. The eligible bidder shall include in their proposal a
self-certification using the "Representative Declaration, Buy Indian
Act (25 USC 47)" form. By submitting a proposal, the bidder agrees to
comply with the provisions of the Oglala Sioux Tribe's Tribal
Employment Rights Ordinance (TERO). Bids may not be withdrawn after the
time fixed for opening them. The Oglala Sioux Tribe reserves the right
to reject any and all bids, and to waive any irregularities therein.
