synopsis/solicitation for commercial items prepared in accordance with
the format in Federal Acquisition Regulation (FAR) Part 12, Subpart
13.5, and Part 15, as supplemented with additional information included
in this notice. This announcement constitutes the only solicitation;
proposals are being requested and a written solicitation will not be
issued. The solicitation number is DTRS57-00-R-20027 and is issued as
a Request for Proposals (RFP). This solicitation is a small business
set-aside in accordance with Section 15 of the Small Business Act; the
Standard Industrial Classification Code is 3295 and the Small Business
size standard is 500 employees. The U.S. Department of Transportation,
John A. Volpe National Transportation Systems Center (Volpe Center),
Cambridge, MA has a requirement for assisting the U. S. Environmental
Protection Agency, to provide clean fill and topsoil in Libby, Montana.
The clean fill and topsoil will be used as part of site remediation and
restoration at the Railroad Loading Facility in the town of Libby,
Lincoln County, Montana. The quantities listed below include a base
amount with options to increase depending upon the Government s need.
The clean fill is defined as per the Administrative Rules of Montana
(ARM), Title 17 Environmental Quality Part 2, Solid Waste Management
Section. The Solid Waste Management Rule: solid dirt, gravel, rocks and
rebar-free concrete, emplaced free of charge to the person placing
fill, in order to adjust topographic irregularities for agricultural or
construction purposes. The clean topso il will be capable of producing
natural vegetation. Prior to award, the fill and topsoil will be
sampled by the Government to determine if the soil meets state and
federal regulations as clean fill and topsoil for commercial and
residential properties. The fill and topsoil must pass the following
tests: EPA Approved Methods (SW 846 3050A, 6010A, 7471A, 8260A)
including analysis for asbestos in accordance with EPA Approved
Methods. Testing of the topsoil for nutrient levels, concentrations of
organic matter, percent of cation exchange capacity (CEC), and soil
texture. The testing will be conducted by the Government prior to
contract award and also during contract performance at intervals stated
below. The product shall be available upon a scheduled request to
provide the fill and topsoil. The fill and topsoil shall be available
starting July 13, 2000 and will be available through October 30, 2000.
The vendor shall have the capability of providing soil six days per
week (Monday through Saturday) excluding September 4, 2000. The vendor
shall have the capability of providing up to 2300 yd3 of topsoil and
5000 yd3 of fill per week during the availability period stated above.
Manifesting/Record Keeping -- The contractor shall provide receipts
for each truckload of clean fill and topsoil. The receipts shall be
provided to the Volpe Center . Award (s) will be made on line items
selected based upon best value to the Government, and the evaluation
factors listed in FAR clause 52.212-2 below. Provide price proposals to
include the following line items: Item 0001 Clean Fill Del ivered
10,000 yd3 Unit Price $________, per cubic yard; Item
0001AA-Option-Clean Fill Delivered 10,001yd3 up to 65,000yd3 -- Unit
Price $_________, per cubic yard. Item 0002-Clean Topsoil Delivered
5,000 yd3 Unit Price $________per cubic yard, Item 0002AA Option-Clean
Topsoil Delivered 5,001yd3 up to 30,000yd3 -- Unit Price $_________per
cubic yard. Delivery/Site Location: Delivery shall be FOB destination
for all Items. The Railroad Loading Facility, in Libby in Lincoln
County, Montana. The Railroad Loading Facility is accessed by Montana
Highway 37 and is located approximately 5 miles from downtown Libby.
Offerors may propose alternate proposal for providing the soil for a no
delivery price for topsoil or fill. An alternate proposal will be
considered. The provision at 52.212- 1, Instructions to Offerors
Commercial Items, is hereby incorporated by reference. The provision at
52.212-2, Evaluation Commercial Items: Evaluation factors are: (1)
price; (2) acceptable soil test results and (3) availability. If the
contractor passes the soil test and the amount of soil is available,
the vendor with the lowest price will get the award for Item 0001,
0001AA and 0002 and 0002AA. Alternate proposals will be considered by
the Government. The Government s intent is to award 2 or more contracts
from this RFP. The Government will make an award(s) resulting from this
solicitation to the responsible offeror (s) whose offer conforming to
the solicitation will be most advantageous to the Government, price and
other factors considered. The Government intends to order up to a
maximum of 65,000 cubic yards of fill and a maximum of 30,000 cubic
yards of topsoil. The Government understands that 1 contractor may not
be able to provide all 65,000 cubic yards of fill or 30,000 cubic
yards of topsoil, therefore the intent is to award more than 1
contract. Each contractor is only guaranteed 10,000 cubic yards of fill
if awarded contract for line 0001 and 0001AA; or 5,000 cubic yards of
topsoil if awarded line item 0002 and 0002AA. All offerors must include
a completed copy of the provision at 52.212-3, Offeror Representations
and Certifications Commercial Items with their proposal. The clause at
52-212-4, Contract Terms and Conditions Commercial Items is
incorporated by reference. Addendum 1 to 52.212-4 is as follows: After
contract award the Government will samp le and analyze soil in
accordance with the testing listed previously in this document. The
soil will be tested by the Government at least every 1000 cubic yards.
In order to meet project flexibility needs testing will occur either
at the vendor s site or the dropoff location. The vendor will be
informed in writing of the results of the testing. 52.212-5, Contract
Terms and Conditions Required to Implement Statutes or Executive Orders
Commercial Items, applies to this acquisition; additional clauses cited
in 52.212-5 that apply to this acquisition are:1, 3, 5, 7, 11, 12, 13,
14, 15, 16, 22. Two copies of each offer shall be delivered to the
