J- The Naval Air Warfare Center Aircraft Division (NAWCAD) has identified a requirement for the establishment of a Basic Ordering Agreement (BOA) to provide services and materials to provide repair, replacement, on-site field engineering services, modifications, upgrades and spares for the AN/UPX-37. NAWCAD intends to issue the BOA with BAE Systems Technologies located at 1 Hazeltine Way, Greenlawn, NY 11740-1606 on a sole source basis citing statutory authority permitting other than full and open competition title 10, U.S.C. 2304c (1) Only One Responsible Source and No other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1. BAE is uniquely qualified to perform the services as it is the Original Equipment Manufacturer (OEM) of the Digital Interrogator and its subassemblies and BAE is the only company with the proprietary data rights to the system and its subassemblies and requisite engineering expertise to identify faults, make needed repairs, provide the high level system engineering and spares support required for all AN-UPX-37 interrogator sets. Services are to be performed for a period of three years beginning 1 October 2000 through 30 September 2003. Note 22 applies.
