Required: (i) Vessel Characteristics: U.S. or foreign flag
self-sustaining container vessel able to lift minimum 630 twenty-foot
containers at one time (of which 355 are described in (iii) below).
(ii) Speed: Vessel minimum acceptable speed is sixteen (16) knots when
fully laden. (iii) Ammunition: Vessel shall be capable of carrying a
minimum of 355 twenty foot containers of Class 1 ammunition. Vessel
offered must be acceptable for the carriage of explosives in accordance
with International Maritime Dangerous Goods Code (IMDG). In addition to
being fully equipped to carry IMDG Class 1, Vessel must be fully
container fitted either with cell guides or stools (base fittings for
securing containers on tank tops/hatch covers), stacking cones and
container securing devices. Containers loaded with IMDG Class 1
explosives stowed underdeck must be stowed a minimum of 3 meters away
from the engine room bulkhead when the Vessel is fitted wih an engine
room bulkhead insulated to A60 standard. For vessels not fitted with an
engine room bulkhead insulated to A60 standard, there must be a 9 meter
separation. Deck stowed containers must be separated from the bridge,
accommodation spaces and life saving appliances by a minimum horizontal
distance of 8 meters. Vessels offered must be in compliance with all
applicable safety regulations and SOLAS requirements, comply with the
IMDG code and be equipped with the following fire protection equipment
in working order when tendering NOR: 1) main machinery spaces must be
fitted with a fixed fire-detection and fire alarm system and a fixed
fire-extinguishing installation equivalent to SOLAS standards; 2) all
cargo spaces must be fitted with a fire detection system; 3) vessel
must be equipped with a power operated emergency fire pump, which
together with its source of power and sea connections, should be
located outside the machinery space; 4) at least two sets of
self-contained breathing appartus of an approved type must be aboard;
and 5) at leasttwo fireman's outfits of an approved type must be
aboard. If fixed hold lighting is installed, the fittings and wiring
must be intrinsically safe, well protected from mechanical damage, dust
tight and protected from water damage. If portable hold lights are used
they must be completely protected from dust and protected against
projections of water from all directions. Flexible cable should have at
least a steel or copper braid armour with an overall sheath of pvc,
tough rubber or similar material. Owner must warrant that Vessel is
suitable for carriage of such explosives as described herein. Provision
of any fittings, such as fire fighting/detection equipment, and making
good any defects to the Vessel, her gear, her fixtures and fittings to
make the Vessel suitable for carrying the cargo described, including
any necessary certificates/surveys required by competent autority,
shall be for the expense of the Vessel. Vessels are required to have
aboard current editions of the following publications: 1) Medical First
Aid Guide for use in accidents involving dangerous goods (MFAG); 2)
Emergency Procedures for Ships carrying dangerous goods (EMS); and 3)
IMDG code volume relating to IMDG Class 1. (iv) Cargo Gear: Vessel must
be self-sustaining for loading and discharging containerized cargoes.
Vessel must be equipped with 20 ft spreader bar. Spreader bar shall be
supplied by the Vessel Owner. All lashing and securing gear for
containers is to be provided by Owner. (v) Voluntary Intermodal Sealift
Agreement (VISA): Prior to contract performance, U.S. flag Owners shall
be a Participant in VISA and the Vessel must be enrolled in VISA. 2.
Place/Range of Delivery: (MOTSU) Sunny Point, NC 3. Place/Range of
Redelivery: (MOTSU) Sunny Point, NC 4. Charter Period: 70 days with
Government option to redeliver after 30 days with 10 days prior notice.
5. Laydays: Commencing -- 23 JULY 2000/Canceling -- 24 JULY 2000 6.
Terms/conditions/attachments added, deleted or modified: a) Part III(b)
the following is added: "III(b) Under the direction of the Military
Sealift Command, the vessel(s) will be primarily employed in service
between Nordenham, Germany, Ash Shuaiba, Kuwait,and Varna, Bulgaria."
b) III(h)(4) For information, Owner will be required to provide
stevedoring services in Varna, Bulgaria and Ash Shuaibi, Kuwait. c)
Delete Part IV paragraphs (af) and (ag). Add the following as new
Paragraph (af):In addition to the items required in Paragraph II(g) of
the contract, include (1)the invoice number (no more than 18 alpha
numeric characters), (2)CLIN number, (3)expenditure type, (4)vessel
name, (5)port (if applicable), (6)vessel status (FOS, ROS), and (7) and
(8) the appropriate project and task numbers (to be provided upon
award). c) Part V, add the following paragraphs: V(b) Communications
Equipment V(c) Navigational Equipment d) Part V(b)(1)iii, replace "500"
with "400". e) Part XI is revised to read as follows: XI.FAR 52.212-2
EVALUATION -- COMMERCIAL ITEMS (a) The Government will award a contract
resulting from this solicitation to the responsible offer whose offer
conforming to the solicitation will be most advantages to the
Government, price and other factors considered. The following factors
shall be used to evaluate offers. (1)Technical Acceptability. In order
to be determined technically acceptable,the offeror's proposal must
meet all requirements of this solicitation. Award will be made to an
offeror whose proposal is deemed technically acceptable. (2)Flag.
Preference will be given for U.S. flag Vessels in accordance with the
Cargo Preference Act of 1904, 10 U.S.C. 2631. (3)VISA Status. U.S. flag
offerors must be a Participant of the Voluntary Intermodal Sealift
Agreement (VISA) and Vessel must be enrolled in VISA; or must agree to
become a Participant and enroll vessel prior to or on the required
delivery date. In the latter case, in the event that the offeror is
awarded the contract and fails to become a VISA Participant prior to or
on the required delivery date, this contract shall be terminated at no
cost to the Government. (4)Cost. An evaluated price shall be
calculated for each offer based on the charter hire rate offered for
the entire charter period, fuel costs with an operating scenario of 14
days at anchor/in port and 56 days steaming underway at 16 knots, and
other costs, if any. ROS charter hire will be examined for
reasonableness only. (5) Past Performance. Offerors will be evaluated
on their performance under existing and prior contracts for similar
services and as otherwise detailed in the solicitation. Information
obtained from references listed in proposals, other customers known to
the Government, and other sources of useful and relevant information
will be considered. (A) At a minimum, award will not be made to an
offeror who is or within the past three years has been seriously
deficient in contract performance, unless the Contracting Officer
determines that the circumstances were properly beyond the offeror's
control or that the offeror took appropriate corrective action. (B) If
discussions are held, offerors will be given the opportunity to
address unfavorable reports of past performance. (C) Offerors without
a past performance history relating to this solicitation shall receive
a neutral evaluation. While the evaluated price will be of
significantly greater weight than that of Past Performance evaluation,
award will be made to the offeror whose offer represents the most
desirable balance between price to the Government and Past Performance
evaluation. (b)A written notice of award or acceptance of an offer,
mailed or otherwise furnished to the successful offeror within the time
for acceptance specified in the offer, shall result in a binding
contract without further action by either party. Before the offer's
specified expiration time, the Government may accept an offer (or part
of an offer), whether or not there are negotiations after its receipt,
unless a written notice of withdrawal is received before award.
