GOOD FAITH ANNOUNCEMENT Under the provisions of FPI's guidelines process, published March 12, 1997, in the Federal Register and March 25, 1997, in the Commerce Business Daily, FPI submits the following "Good Faith Announcement" for public notice and comment. FPI proposes to resume manufacturing camouflage covers for sale to the Federal government. The National Stock Number for this item is 8415-01-280-3098. This item has been previously produced by FPI. However, FPI has not manufactured this item during the last five years. For this reason, FPI has examined if this item meets the criteria of a "new product" as set forth by FPI's expansion guidelines. For the purposes of FPI's guidelines, an item's Federal Supply Classification (FSC) code is the primary determinant of a "specific product." An item's Standard Industrial Classification (SIC) code is the secondary determinant of a "specific product." Camouflage covers are classified within FSC 8415 -- Special Purpose Clothing and SIC 2399 -- Textile Products, Not ElsewhereClassified. FPI has a long history of producing items within both FSC 8415 and SIC 2399, so camouflage covers do not meet the definition's criteria of a "new product" for FPI. Most of the items within FSC 8415 currently made by FPI are included within specific product groupings, such as "work clothing," "protective clothing," and "gloves." Camouflage covers are not included within any of these specific products. Rather, for the purposes of FPI's guidelines, camouflage covers will be included within FSC 8415 -- Other Special Purpose Clothing. As noted above, FPI believes the camouflage covers do not meet the definition of "new product" set forth by FPI's expansion guidelines. However, FPI recognizes that a reasonable person may construe these items to be a product separate and distinct from any other item supplied by FPI. Under the terms of FPI's expansion guidelines, interested parties may submit comments regarding the production of this item by FPI. In submitting comments to FPI, the following guidelines will apply: 1) Comments will be due within 21 days of the date of this notice; 2) Relevant comments will focus on and address why the item should be considered a new product, separate and distinct from a similar item currently produced by FPI; 3) While the primary purpose of the comments will be to determine if the item should be defined as a new product, comments related to market share and/or the impact that such a production decision may also be considered relevant. All comments received in response to this annoucement will be considered by FPI. All commenters will be advised whether FPI decides to initiate the public involvement guidelines process.
