This is a combined synopsis/solicitation for commercial items proposed in accordance with the format in Federal Acquisition Regulation Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number CS-I-00-016, is issued as a request for proposal, and incorporates provisions and clauses that are in effect through Federal Acquisition Circular 97-18. The standard industrial classification code is 3826 with a small business size standard of 500 employees. This solicitation will result in an Indefinite Delivery/Indefinite Quantity contract and have one contract line item (CLIN). The minimum quantity is one and the maximum quantity is five multi-dispersive x-ray fluorescent (MDXRF) for the lifetime of the contract. The period for ordering is from the date of award through September 30, 2002. The U.S. Customs Service has a need for a computer-controlled multi-dispersive x-ray fluorescence system consisting of a wavelength dispersive subsystem for low atomic weight elements and an energy dispersive subsystem for heavier atomic weight elements, x-ray tub source, atomic sample changer, sample chamber operation under vacuum and helium environment, and analytical software running under Windows NT. (1) The instrument shall be equipped with a 10-position (minimum) wavelength dispersive monochromator assembly and six of which are configured to analyze sodium, magnesium, silicon, aluminum, sulfur and sulfur background. It shall conform to the requirements of ASTM D2622 for the determination of sulfur in petroleum products. (2) The instrument shall be equipped with an energy dispersive subsystem for the analysis of the elements aluminum to uranium. The detector shall be a Peltier-cooled solid state detector with a resolution of 180eV or better for 5.9 KeV x-rays. (3) The x-ray tube shall have a maximum operating voltage to 50kV or higher and a maximumoperating power of 200 watts or higher. (4) It shall have a 24-position (minimum) automatic sample loader and a sample holder with spinner. The sample chamber shall be capable of operating in vacuum and helium environment. (5) The contractor shall provide a PC-based computer running under Windows NT Operating System to control the instrument (6) The analytical software shall be capable of performing standardless analysis using fundamental-parameters method. This standardless analysis shall be capable of analyzing mixtures of oxides or compounds. Delivery shall be FOB destination inside consignee_s premises at the following addresses: (1) U.S. Laboratory Director, 300 South Ferry Street, Suite #300, Pedro, California 90731. Industrial Park, Savannah, Georgia, 31408; and (5) Laboratory Director, U.S. Customs Laboratory, 630 Sansome Street, Suite 1429, San Francisco, California, 94111. Delivery shall be 90 days after award of contract or issuance of delivery order. At the time the instrument is delivered and installed, the contractor shall provide a one-day informal training session. As a minimum, the session shall cover operation, routine maintenance, and the operating software of the system. There is to be no limit on the number of the attendees. The offeror shall provide a syllabus of the proposed informal training with their proposal. A minimum of a 3-day formal training course for a minimum of two students will be provided after installation and familiarization with the instrument on-site at each laboratory location or at the contractor_s facility. This course will provide detailed coverage of operation, method development, troubleshooting and maintenance. Contractor should indicate the location of training in their proposal. Two copies of descriptive literature shall be provided with the proposal to show that the equipment meets the technical requirements. The contractor shall submit a copy or description of the warranty with their proposal. The following FAR clauses and provisions apply: FAR 52.212-1, Instructions to Offerors_Commercial Items; 52.212-2, Evaluation-Commercial Items; with the following evaluation criteria: The evaluation factors for this procurement are Technical Acceptability and Past Performance. Technical Acceptability is more important than Past Performance. The two subfactors for Past Performance are of equal importance. All evaluation factors when combined are significantly more important than cost or price. Technical Acceptability as a minimum, the contractor shall meet the technical requirements stated in the Commerce Business Daily/Request For Proposal. Subfactors for Past Performance will be Customer Satisfaction and Quality of Product or Service. Customer Satisfaction is defined as the end user_s satisfaction with the contractor_s service. Quality of Product or Service is defined as the contractor_s compliance with contract requirements, technical excellence, reliability, maintainability, ease of use of equipment, and prompt after market support. The proposals will be evaluated using the trade-off process described in Federal Acquisition Regulation 15.101-1. For past performance, the contractor shall identify projects with name of individuals that work on them, including telephone number(s), contract number(s), descriptions, and how many firms you have sold this equipment to in the past. Prospective offers/contractors without a record of relevant past performance or for whom information on past performance is not available, the offeror may submit relevant past performance for their key personnel. The Government may use past performance information obtained from other than the sources identified by the offeror. Regardless of the available information, the prospective offeror/contractor who does not have a record of past performance will not be evaluated favorably or unfavorably on past performance; The Government will hold negotiations with all offerors that have been found to be in the competitive range. The competitive range will be determined by the evaluation of the offeror_s technical capability, past performance and cost/price. Those offerors remaining in the competitive range after negotiations, will be required to perform a standardless quantitative analysis. The Customs Laboratory will provide the offerors test samples with the composition for the test. The offeror shall use the instrument being evaluated to conduct the test. The instrument shall detect all the elements in the test samples given to the offeror. The results of the standardless analysis must be within the targeted percentage of the element concentrations. The offeror shall provide the original printout of the analysis results and excitations conditions to the Customs Laboratory by the date specified for submission of final proposal revisions. 52.212-3, Offeror Representations and Certification-Commercial Items; 52.212-4, Contract Terms and Conditions_Commercial Items; 52.212-5, Contract Terms and Conditions Required to Implement Statues of Executive Orders_Commercial Items, will apply to resultant contract: 52.203-6, 52.219-8, 52.219-9, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-3, and 52.232-34. All offerors must include a completed copy of FAR 52.212-3 with their response. Because this is a commercial item, FAR 12.603 (c)(3) (ii) will be used for establishing the solicitation response time.
