The U.S. Environmental Protection Agency (EPA), as a condition of a
settlement agreement, has a requirement for the development of a
Programmatic Environmental Impact Statement (PEIS), along with the
Economic Analysis of the impact of potential mountaintop mining
restrictions for the State of West Virginia. Under the agreement, the
EPA, the Office of Surface Mining (OSM), the COE, and U.S. Fish and
Wildlife Service (USFWS), in conjunction with WVDEP, agreed to develop
a PEIS and an Economic Analysis to assess the impact of mountaintop
mining and valley fill (MTM/VF) practices and the potential economic
impact for the State of West Virginia. At the time of the agreement the
West Virginia State Legislature appropriated funding to the West
Virginia University to analyze the economic impact of MTM/VF on the
West Virginia economy. As this is an ongoing project requiring
additonal funding from the federal level, EPA intends to acquire these
services on a sole source basis from West Virginia University,
Morgantown, WV. This notice is not a request for competitive
