- NOTICE OF CONTRACT ACTION (NOCA). It is the Government's intent to negotiate a FAR Part 15 award on a sole source basis with Litton Laser Systems for the Tactical Air Control Party Laser Range Finder (LRF) requirement. On or about 28 September 2000, the Tactical Air Control Party (TACP) Modernization Program Office, Electronic Systems Center (ESC/DIGR), Hanscom AFB, MA intends to release an RFP for the acquisition of a Laser Range Finder (LRF). As a result of responses to the Request for Information (RFI) -- Laser Range Finder, 22 October 1999, and the Sources Sought Synopsis (SSS) -- Laser Range Finder, 5 May 2000, the Government believes that Litton Laser Systems is the only qualified source currently producing a LRF that meets all the threshold requirements outlined in the Operational Requirements Document (ORD), AC2ISRC (CAF) 307-97-I/II/III, for Tactical Air Control Party Modernization, dated 9 Dec 99. Therefore, statutory authority is 10 USC 2304 (c)(1) as implemented by FAR 6.302-1(a)(2)(i): "only one responsible source". Two requirements TEMP and HEMP are relaxed and are objective requirements. The minimum operating temperature is -4 degrees F vice -10 degrees F and HEMP is an objective. ESC intends to purchase 161 LRFs. Estimated quantities by fiscal year are FY01 -- 59, FY02 -- 89, and FY 03 -- 13. The contractor must complete delivery of the FY01 quantity no later than one year after basic contract award. Delivery of the FY02 and FY 03 quantities, should take place no later than one year after exercise of each subsequent contract option. This notice does not constitute an RFP nor should it be construed as a Government commitment. It does not restrict the Government as to the ultimate acquisition approach. An Ombudsman has been appointed to hear concerns from offerors or potential offerors during the proposal development phase of this acquisition. The purpose of the Ombudsman is not to diminish the authority of the program director, program manager, or contracting officer but to communicate the offeror's concerns, issues, disagreements, and recommendations to the appropriate government personnel. When requested, the Ombudsman will maintain strict confidentiality as to the source of the concerns. The Ombudsman does not participate in the evaluation of proposals or in the selection process. The Ombudsman should only be contacted with issues or problems that have previously been brought to the attention of the program manager and/or contracting officer and could not be satisfactorily resolved at that level. Furthermore, offerors are reminded and cautioned that only Contracting Officers are legally authorized to commit the Government.
