Description

The General Services Administration intends to issue a contract to Foundry Networks under the authority of FAR Parts 12, 13.501(a) _Sole Source Acquisitions_ and 6.303-2 _Content_ through solicitation number 9TER-01-JAL-002. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulations document (FAR) subpart 12.6, as supplemented with additional information included in this notice. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 97-17. This procurement is for the provision of used and new layer 2 and layer 3 switch router equipment. This procurement is for the Infrastructure Systems Engineering Directorate of the Information Systems Engineering Command at Fort Huachuca, Arizona. The proposed contract action is for supplies for which the Government intends to solicit and negotiate with only one source under authority of FAR 13.501(a). Only one responsible source and no other supplier can offer the required equipment. Other products would pose a configuration and compatibility problem with existing systems. A justification for Other than Full and Open Competition has been prepared in support of this acquisition. The provision at FAR 52.212-1, Instructions to Offerors, applies to this acquisition to the extent consistent with a sole source acquisition. Foundry Networks shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. The clause at FAR 52.212-4, Contract terms and Conditions-Commercial Items, applies to this acquisition. The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice is not a request for competitive proposals. All proposals received by 5:00 p.m., PST, 1/16/01 will be considered by the Government. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government.
